RE,: Update on project with respect to the Town Engineer and SCDPW letter dated 1/27/05 on the
culvert with legal opinion.
Staff Recommendation: That the PB accepts the Town Engineers letter and consider adding the wording
to the approval on the culvert.

StaffRecommendation: The PB considers adding a condition that the cross over access is shown for
future development. The applicant will have NYSDOT approval in the near future and the PB consider
setting the public hearing at the February 14, 2005 for March 14, 2005.

detailing the bond estimate amount for work not competed.
Staff Recommendation: That the Planning Board consider voting resolving that the Town Board
consider the letter of credit as a condition for the PB recommending the conditional c/o to the Building
Department.

This proposal is to set-offa 7.04 acre (Lot 1) from 26.69 acre parcel (Lot 2) in Orient (SCTM#
1000-15-2-15.1).
This application will be classified as a Standard Subdivision on February 14th. The applicant
requests an extension of conditional final approval due to expire on February 10, 2005 and the
issuance of final approval. Three outstanding items remain. The park and playground fee has
increased to $7000.00. The applicant submitted $5000.00 and must submit an additional
$2000.00. The Orient Fire District is requiring that the road be widened to 15' and be extended
with gravel 50' past the fire cistern upon which the applicant has agreed. Presently all C&R's
have been filed and if the PB would like to incorporate within a C&R an additional C&R filing
wilt be required. I recommend that the Fire Districts conditions be included as a resolution of
final approval stating that the work must be complete prior to the issuance of a certificate of
occupancy. The applicant has produce one map with a DOH exemption stamp (the PB requires
all maps to be signed). The mylars and remaining paper prints are not signed by the DOH, the
applicant maintains that due the fact that the lots created are over 5 acres, the DOH will not sign
the mylars. I have a call into the DOH to verify the statement.

Applicant needs to request extension of time for conditional final approval. Upon the
Town Attorney's approval of the legal documents, final approval can be issued and the
Planning Board Chair can endorse the final maps.
