New York 11971-0959 CONSERVATION ADVISORY COUNCIL TOWN OF SOUTHOLD MINUTES Tues., March 15, 2005 Down's Farm Preserve 6:00 PM A meeting of the Southold Town Conservation Advisory Council was held Tues., March 15, 2005 at Down's Farm Preserve. Present Were: Don Wilder, Chairman Tom Schlichter, Member Doris McGreevy, Member Jack McGreevy, Member Alicia Marin, Member Jennifer Mannino, Member Lauren Standish, Secretary Absent Were: William Cook, Jr., Member Peggy Dickerson, Trustee CALL TO ORDER Chairman Don Wilder called the meeting to order at 6:00 PM CHAIRMAN'S ANNOUNCEMENTS Chairman Don Wilder will attend the Board of Trustees Regular meeting on Wed., March 23, 2005. REPORTS Jack McGreevy attended the meeting held by the Board of Trustees to discuss the changes to the mooring code, on Tues., March 1,2005. The Council will prepare their recommended changes to Chapter 97 - Wetland Code to submit to the Trustees for their next meeting. APPROVAL OF MINUTES Moved by Don Wilder, seconded by Tom Schlichter to Approve the Minutes of February 14, 2005. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by Don Wilder, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit application of SIM MOY to construct a single-family dwelling, attached rear deck, pervious driveway, retaining wall and sanitary system. Located: 750 West Lake Rd., Southold. SCTM#90-2-1 The CAC recommends Disapproval of the application because of the following reasons: The concern with raising the septic system and the proximity to the water table. The concern with drainage. The concern with a suitable buffer area. Status and condition of the bulkhead is unclear. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Tom Schlichter, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of KEVlN O'MALLEY to construct 114' of bulkhead in front of existing; reconstruct deck and railing inkind/inplace; dredge in front of bulkhead to -4.0; reconstruct 4'X 7' cantilevered platform leading to (2) 3'X 12' ramps onto (1) 5'X 34' and 5'X 24' floating docks. Located: 175 Dawn Dr., GreenporL SCTM#35-5-21 The CAC recommends Approval of the applicati'on with the Condition treated lumber is not used on the decking of the pool and a 10' non-turf buffer is installed landward of the bulkhead. Vote of Council: Ayes: All Motion Carried Moved by Doris McGreevy, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application o fSALVATORE PRATO to maintenance dredge existing channel to a depth of-4.0' and -6.0' below mean Iow water, remove approx. 376 cy. of dredge spoil and remove off property to an approved upland site. Located: 580 Wiggins Lane, Greenport. SCTM#35-5-28.30 The CAC recommends Approval of the application with the Condition of a 10' non-tuff buffer landward of the bulkhead. Vote of Council: Ayes: All Motion Carried Moved by Doris McGreevy, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of DANIEL FOX to maintenance dredge existing canal to a depth of-4.0' to -6.0' below mean Iow water. A total of 426 cy. of dredge spoil will be removed and deposited at an approved upland site. Located: 470 Wiggins Lane, Greenport. SCTM#35-4-28.28 The CAC recommends Approval of the application with the Condition of a 10' non-turf buffer landward of the bulkhead. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Tom Schlichter, it was RESOLVED to recommend to the Southold Town Board of Trustees APPPROVAL WITH A CONDITION of the Wetland Permit application of JOCKEY CREEK TRUST CIO KATHLEEN DEVORE to construct 175' of bulkhead immediately in front of existing bulkhead using C-Loc vinyl sheathing. Located: 635 Lighthouse Lane, Southold. SCTM#70-6-30 The CAC recommends Approval of the Application with the Condition of a 50' non-tuff buffer landward of the bulkhead. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Jennifer Mannino, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit application of NORMAN & JUDITH SHAPP for the existing docking facility, consisting of a 3'X 30' timber dock, 3'X 12' ramp, and a 6'X 16' floating dock. Located: 485 Orchard Lane, Southold. SCTM#89-2-7 4 The CAC recommends Disapproval of the application because the existing docking facility does not match the submitted plans. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Tom Schlichter, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of MONICA KREISCHER to replace/reconstruct the existing timber bulkhead located within the northern section of subject property with a vinyl sheathed bulkhead. Located: 825 Harbor Lights Dr., Southold. SCTM#71-2-16 The CAC recommends Approval of the application with the Condition of a 50' non-turf buffer landward of the bulkhead. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Tom Schlichter, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of PAUL MALONEY to remove the existing 4'X 25' catwalk and dispose of same. Replace with new 4'X 25' catwalk, in-kind leading to a 32"X 16' ramp onto a 6'X 20' floating dock secured by (2) 2-pile dolphins. Located: 1020 Goose Creek Lane, Southold. SCTM#78-8-3 The CAC recommends Approval of the application with the Condition the total length of the docking facility does not exceed 1/3 the width of the creek. Vote of Council: Ayes: All Motion Carried Moved by Doris McGreevy, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of ANNA & RICO VERTICCHIO to dredge an approx. 70'X 40' area to a depth of -4.0' below AMLW. Patch bottom half @ 50' of existing bulkhead below lower stringer with vinyl sheathing. Install a new bulkhead @ 28' around existing drainage culvert. Install a 4'X 5' cantilevered platform leading to a 32"X 20' aluminum ramp leading to a 6'X 30' floating dock secured by one pile and two - 2-pile dolphins. Located: 980 Manhasset Ave., Greenport. SCTM#34-5-20 The CAC recommends Approval of the application with the Condition of a 6'X 20' floating dock rather than the proposed 6'X 30' floating dock, and the plans are submitted to the Town Engineer for final approval. The CAC has a concern with interference with the existing docks in the area. Vote of Council: Ayes: All Motion Carried Moved by Doris McGreevy, seconded by Jennifer Mannino, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of MICHAEL ZEVlTS to construct a single- family dwelling, attached rear porch/deck, fence, driveway, and sanitary system. Located: 1450 West Lane, Southold. SCTM#88-6-18.5 The CAC recommends Approval of the application with the Condition of a 50' non-turf buffer and a split-rail fence. The CAC recommends the applicant save as many trees as possible. Vote of Council: Ayes: All Motion Carried CHRISTOPHER & PEGGY MILONAS for the existing beach stairs and deck on the bluff. Located: 2400 Sound Dr., Greenport. SCTM#33-1-14 The CAC did not make an inspection, therefore no recommendation was made. LEWIS & HELAINE TEPERMAN request a Wetland Permit for the existing beach house. Located: 1225 Aquaview Ave., East Marion. SOTM#21-2-16 The CAC did not make an inspection, therefore no recommendation was made. Moved by Don Wilder, seconded by Tom Schlichter, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of DECLAN MEAGHER to construct a second-floor addition, expansion of the first floor, enclosed screened-in porch, and in- ground swimming pool. Located: 750 Blue Marlin Dr., Southold. SCTM#57-1-29 The CAC recommends Approval of the application with the Condition of a 20' non-turf buffer, drywells and gutters are installed to contain the roof run-off, and if a new sanitary system is required, it should be installed landward of the dwelling. Vote of Council: Ayes: All Motion Carried PETER NEYLAND to reconstruct the existing deteriorated timber bulkhead with vinyl sheet bulkhead along same line; maintenance dredge approx. 330 cy. of bottom to obtain a depth of 5.0' below mean Iow water, use 100 cy. of spoil as backfill material, dispose of balance of spoil material at an upland location. Located: 60 Bayview Dr., East Marion. SCTM#37-4-5 The CAC did not make an inspection, therefore no recommendation was made. Moved by Don Wilder, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit application of JOSEPH LOGIUDICE to construct a 4'X 108' fixed timber catwalk with (4) tie-off piles. The catwalk is proposed to be elevated a min. of 4' above the AHWM and will utilize (4) 4"X 4" piles with a depth of penetration 6'+, and (26) 6" dia. timber piles with a depth of penetration of 10'+. (4) 10" dia. CCA timber tie-off piles are proposed. Located: 10995 North Bayview Rd., Southold. SCTM#79-5-20.13 The CAC recommends Disapproval of the application because of the following reasons: The installation of the structure would cause disturbance to the marine habitat. The CCA pilings would have a negative impact on the environment. Excessive bottom coverage. The proposed dock is inconsistent with the present shoreline structures. There is a concern with the negative impact the docking facility would have on the neighboring shellfish hatchery. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Jack McGreevy, it was RESOVLED to TABLE the Wetland Permit application of NICHOLAS CASSIS to construct a single-family dwelling and to clear within 100' of the wetlands. Located: Ninth St. Greenport. SCTM#45-6-9.1 7 The CAC Tables the application because the members were unable to access the site because the gate was locked. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Doris McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of JOSEPH GONZALEZ to construct a second-story addition on an existing, one-story, one-family dwelling and install a drainage system of drywells. Located: 2700 Ole Jule Lane, Mattituck. SCTM#122-4-14 The CAC recommends Approval of the application with the Condition drywells are installed landward of the house. Vote of Council: Ayes: All Motion Carried DISCUSSION AND RECOMMENDATION OF APPLICATIONS TO AMEND PERMITS Moved by Don Wilder, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Amendment application of CHRISTOPHER & GLORIA GROOCOCK to Amend Permit #5485 to demolish the existing wood frame house, with the exception of the existing foundation, include the distribution of the excavated soil from the digging of the new foundation onto the existing lawn area between the house and the top of the bank, construct a retaining wall along the top of the present bank, and upgrade the existing septic system. Located: 1030 West Creek Ave., Cutchogue. SCTM#103-13-8 The CAC recommends Approval of the application with the Condition there is no turf from the rear of the house to the water, a berm and a hay bale line are installed to direct run-off away from the wetlands, and the existing piles of dirt surrounding the trees are removed immediately. Vote of Council: Ayes: All Motion Carried Moved by Doris McGreevy, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APROVAL WITH A CONDITION of the Amendment application of MICHAEL FERBER to Amend Permit #398 to rebuild and extend the existing catwalk and return the floating dock to its previous position, and to Transfer Permit #398 from Walter Honings to Michael & Marlene Ferber. Located: 1825 Gull Pond Lane, Greenport. SCTM#35-4-15 The CAC recommends Approval of the application with the Condition of a 6'X 20' floating dock, and the total length of the docking facility does not exceed 1/3 the width of the creek. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Tom Schlichter, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Amendment application of STRONG'S MARINE to Amend Permit #5654 to install 20 linear ft. of sheathing on the interior side of the north/south bulkhead adjacent to the travel-lift. Located: Camp Mineola Rd., Mattituck. SCTM#122-4-44.2 Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Amendment application of WILLIAM & DIANE BEARDSLEE to Amend Permit #5958 to upgrade the existing septic system. Located: 435 Beachwood Rd., Cutchogue. SCTM#116-4-24 Vote of Council: Ayes: All Motion Carried The next meeting of the Conservation Advisory Council has been set for Monday, April 11, 2005 at 6:00 Pm at Down's Farm Preserve. There being no further business to come before the Council, the meeting was adjourned at 8:00 PM.
