6:00 p.m. - Charnews, Daniel and Stephanie: This proposal is to subdivide a 23.4004-
acre parcel into two lots where Lot 1 equals 3 acres and Lot 2 equals 20.4004 acres. The

The public hearing was closed.
WHEREAS, this proposal is for a clustered conservation subdivision to subdivide a
53.77-acre parcel into five lots where Lot 1 equals 46.22 acres, Lot 2 equals 3 ,acres,
Lot 3 equals 1.5 acres, Lot 4 equals 1.3 acres and Lot 5 equals 1.7 acres in thE; A-C
Zoning District; and
WHEREAS, the Development Rights are proposed to be sold to the Town of Southold
upon 46.22 acres (Lot 1); and
WHEREAS, the clustered open space is equal to 41,774 sq. ft. and is included within
and apart of Lot 2; and
WHEREAS, on September 13, 2004, the Southold Town Planning Board granted
conditional sketch approval upon the map prepared by John C. Ehlers, LS dated as last
revised September 5, 2003; and
WHEREAS, by letter dated December 12, 2004, the Cutchogue Fire District determined
that no additional fire protection is needed for this project; and
WHEREAS, by letter dated December 14, 2004, the Suffolk County Planning
Commission determined that the project is a matter for local determination; and

WHEREAS, on May 6, 2005, the applicant submitted Health Department approval for
the proposed project; be it therefore
RESOLVED, that the Southold Town Planning Board finds that because this proposal is
for a Conservation Subdivision, the requirement of street lights is inconsistent with the
character and land use of the area and is hereby waived; and be it further
RESOLVED, that the Southold Town Planning Board hereby grants conditional final
approval upon the plat prepared by John C. Ehlers, LS, dated as last revised May 24,
2005, subject to the following conditions:
1. Submission of the filed Declaration of Covenants and Restrictions.
2. Submission of the filed Road and Maintenance Agreement.
3. Final review and approval of the Road and Drainage Plan by the Town
Engineer.
4. Submission of the Bond Estimate for the proposed improvements and
landscaping. Upon approval of the Bond Estimate by the Town Engineer, a
Performance Guarantee will need to be submitted for approval by the Town
Board.
5. Payment of the Park and Playground Fee in the amount of $10,500.
6. Submission of a copy of the executed Contract of Sale for Development
Rights.
7. Submission of 5 mylar and 8 paper plats with the Suffolk County Department
of Health stamp of approval affixed to each sheet.
This approval is conditioned upon the satisfaction of the above conditions withi~ six (6)
months of the date of this resolution unless an extension of time is requested by the
applicant and approved by the Planning Board.

The following resolution was adopted by the Southold Town Planning Board at a
meeting held on Monday, June 13, 2005:
The final public hearing was closed.
WHEREAS, the applicant, Patricia C. Moore, propose a site plan for an alteration and
addition of 2,206 sq. ft. to the 1,890 sq.ft, existing office with a 770 sq. ft. apartment and 200
sq.ft, car port on a 0.92 acre parcel in the RO Zone; and
WHEREAS, Patricia & William Moore, are the owners of the property known as 51020
State Road 25 located on the e/s/o State Road 25, approximately 783' n/o the
intersection with Jockey Creek Drive in Southold. SCTM#1000-70-2-8; and
WHEREAS, on December 3, 2004, a formal site plan application was submitted for
approval; and
WHEREAS, on March 7, 2005, the New York State Department of Transportation
reviewed and approved the Highway Work Permit 100-04-0715; and
WHEREAS, on March 3, 2005, the Architectural Review Committee reviewed and
granted conditional preliminary approval of the architectural drawings and associated
site plan materials with conditions; and the Planning Board has accepted this approval
and determined it to be satisfactory; and
WHEREAS, on March 31,2005, the Southold Town Zoning Board of Appeals reviewed
an application and granted a special exception and area variance under appeal number
5636 with 3 conditions and the Planning Board incorporates this in this approval; and

WHEREAS, on April 12, 2005, the applicant submitted to the Southold Town Planning
Department all the materials required in the March 3, 2005 A.R.C approval and the
Planning Board has accepted this submission and determined it to be satisfactory; and
WHEREAS, on April 14, 2005, the Southold Fire District recommended that fire
protection is adequate and the Planning Board has accepted this recommendation; and
WHEREAS, on May 10, 2005, the Southold Town Planning Board, acting under
the State Environmental Quality Review Act (6 NYCRR), Part 617.5 made a
determination that the proposed action is a Type II and not subject to review; and
WHEREAS, on May 16, 2005, the Southold Town Engineering inspector reviewed and
approved the proposed drainage with conditions and the Planning Board has accepted
his recommendation; and
WHEREAS, on May 19, 2005, the Suffolk County Department of Health Services
reviewed and approved an application under the reference number C-10-05~0007; and
WHEREAS, on May 23, 2005, the Southold Town Building inspector reviewed and
certified the site plan for "Professional Office and Accessory Apartment" use; and
WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of
Public Hearing, has received affidavits that the applicant has complied with the
notification provisions; and
WHEREAS, the following four items are incorporated and included in the site plan:
All outdoor lighting shall be shielded so that the light source is not visible from
adjacent properties and roadways. Lighting fixtures shall focus and direct the
light in such a manner as to contain the light and glare within property
boundaries. The lighting must meet the Town Code requirements.
The trench drain indicated at the entrance be of adequate size and the Town
Engineer recommends a fifteen (15) inch diameter drainage pipe to the leaching
basin.
3. All signs shall meet Southold Town Zoning Codes and shall be subject to
approval of the Southold Town Building Inspector.
4. Based on the land banked parking the Planning Board has the right to review the
parking requirements again if a change of use is proposed; and
WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold
have been met; be it therefore

RESOLVED, the Southold Town Planning Board has reviewed the proposed action to
the policies of the Town of Southold Local Waterfront Revitalization Program and has
determined the action is consistent provided that the best management practices
outlined in the June 8, 2005 memo prepared by the LWRP Coordinator are
implemented; and be it further
RESOLVED, that the Southold Town Planning Board grant final approval of the site plan
prepared and certified by Angel B. Chorno, Architect, dated January 6, 2005 and last
revised May 17, 2005, and authorize the Chairperson to endorse the final site plans
subject to a one year review from the date of issuance of the building permit.

adopted the following resolutions:

Letter of Credit #050602 in the amount of $164,245.00; and
WHEREAS, the applicant has submitted the Administrative Fee in the amount of
$9,854.70; and

action to the new information.
5. Submit a determination from the Town of Southold Board of Trustees and the

The project is located on soils identified as "fill", therefore, no archeological survey will
be required.
Sketch plan approval is conditional upon the submission of the preliminary plat within

The Southold Town Planning Board, as lead agency, has determined that the proposed
action described below will not have a significant effect on the environment and a Draft
Environmental Impact Statement will not be prepared.

Description of Action:
This standard subdivision proposes to subdivide a 6.78-acre parcel into 2 lots where Lot
1 equals 4.407 acres with an existing dwelling and Lot 2 equals 2.616 acres
(SCTM#s1000-78-7-5.3 and 5.4).
Reasons Supporting This Determination:
An Environmental Assessment Form has been submitted and reviewed. The
determination was based upon the following:
The applicant has submitted an ERSAP map for the proposed action.
Public water is supplied to the area by the Suffolk County Water Authority,
although the site itself is not specifically connected to public water. The
closest water main to the site is located on the south side of Main Bayview
Road, located approximately 325 south of the building envelope. It is
estimated that the one proposed residential lots will use approximately
300 gallons of water per day.
Sanitary disposal within the proposed subdivision will be managed by on-
site underground sewage leaching systems. In 1978, the Long Island
Regional Planning Board published the Long Island Comprehensive
Waste Treatment Management Plan (208 Study). The 208 Study
identified eight (8) hydrogeologic zones in Nassau and Suffolk Counties.
These zones were distinguished based upon differences in underlying
groundwater flow patterns and water quality. The subject site is located
within SCDHS Groundwater Management Zone IV, which according to
Article VI of the Suffolk County Sanitary Code, has an allowable flow of
600 gallons per day (gpd) per acre in areas served by public water.
Therefore, the allowable nitrogen bearing flow for the overall 1.17 acres
site is 702 gpd. The sanitary design flow is computed using SCDHS
manual Standards for Approval of Plans and Construction for Sewage
Disposal Systems for Other Than Single Family Residences. The manual
establishes the design flow as follows:

300gpd x 1 dwellings 300gpd
Therefore, the proposed application would conform with Article VI of the
Suffolk County Sanitary Code and would not be expected to adversely
affect groundwater quality provided propedy functioning systems are
designed and installed. No substantial adverse change in existing air
quality, ground or surface water quality or quantity, traffic or noise levels;
nor are a substantial increase in solid waste production; a substantial
increase in potential for erosion are expected to occur if the proposed
action is implemented as planned.
The property is located in the Federal Insurance Rate Map FIRM Zone
AE. The elevation of groundwater beneath the subject site is less than 3
feet above mean sea level (msl) according to the Test Hole data. The
direction of groundwater flow is expected to be lateral and toward the
Goose Creek which lies to the north and east of the site. The depth to
groundwater (3 feet) coupled with the soil type (Fill, Dredged Material) is
known to hinder function and result in constraints on the location of septic
system.
The ERSAP map indicates that the topographic elevation on-site ranges
from approximately 5 feet NGVD, Therefore the risk of flooding of the

parcel is significant and the construction of the home must conform
to FIRM standards.
Pursuant to Section A106-56 vegetative clearing will be restricted to 50
percent of the buildable lands. In addition the Southold Town Trustees
are requiring a 50 non-disturbance buffer and 100' "no action"
jurisdictional buffer from the delineated wetland, therefore, no significant
removal or destruction of lar.qe quantities of vegetation is expected to
OCCMF.
The upland area is located immediately adjacent to the high marsh area
and serves as a habitat and corridor for wildlife. Due to the location and
vegetative structure of the proposed development on Lot 2. Interference
with the movement of wildlife species within this area is expected to be
Iow. No impacts to resident or migratory fish is expected.
The Planning Board has requested a determination form the New York
Natural Heritage Program, no information has been received to date.
The project is located in the south of and within Goose Creek a listed
Critical Environmental Area as designated pursuant to subdivision
617.14(g) of New York State Environmental Conservation Law.
The Suffolk County Soil Survey (1975) identifies soils of Lots 1 and 2 as
FD (Filled, Dredged Material) therefore, the proposed action is not
expected to impair the character or quality of important known historical or
archaeological resources.
Lot 1 is improved with a unremarkable single family residence and Lot 2 is
unimproved, no architectural impacts will occur.
Impacts to the viewshed from Main Bayview Road and the surrounding
residential lots will be partially minimized through vegetative screening as
a result of the height of the existing vegetation and the establishment of
clearing limits on Lot 2. Therefore impacts to the aesthetics of the
community or neighborhood character have been minimized.
No major change in the use of either the quantity or type of energy will
occur.
No creation of a hazard to human health is expected to occur.
The proposed action will not cause a substantial change in the use, or
intensity of use, of land including agricultural, open space or recreational
resources, or in its capacity to support existing uses.
Based upon such, no significant adverse impacts to the environment are expected to
occur should the project be implemented as planned.

As per a request from your office, I have completed a final inspection for the above referenced
project. The road base has been brought up to a final design grade that allows most of the runoff
generated on site to dissipate within the road shoulder areas and not impact access over the new
stone blend road. Street trees have been planted and the shoulder areas have been seeded to meet
the minimum requirements of Town Code. At this time, the roadway is considered accessible to any
and all emergency equipment and all of the required construction items listed in the Bond have been
completed in a satisfactory manner.
The initial Curb Cut to August Lane is constructed of blue stone blend and is considered
stable. However, one o1' the developers has inquired about the possibility of constructing a concrete
or begin block apron adjacent to August Lane within the Town Right-of-Way. I have discussed this
matter with the Highway Superintendent and he has agreed that this would be considered an
improvement to the esthetics of the area and also helps minimize the Town's maintenance of the
shoulder. This construction item would be the responsibility of the developers but is not considered
part of the original Bond Estimate. Therefore, at this time, it is recommended that the Bond for this
project be released.

The following resolution was adopted at a meeting of the Southold Town Planning
Board on Monday, June 13, 2005:
WHEREAS, Cross Sound Ferry Services, Inc. received site plan approval with
conditions from the Southold Town Planning Board for the entire site on February 1,
2002; and
WHEREAS, the final approval of the site plan expired on February 1,2005 and the
attorney for the applicant sought to extend such approval; be it therefore
RESOLVED that the Southold Town Planning Board grant a six-month extension from
February 1, 2005 to August 1, 2005 to the final approval with conditions, subject to
fulfillment of the following new condition which must be met by the close of the
extension:
All site improvements shown on the site plan date signed February 1,2002 be
completed and all conditions be met as approved in the resolution dated December
11,2001.
