This application must be filled in by typewriter or ink and submitted to the Building Department with the following:
A. For new building or new use:
I. Final survey of property with accurate location of all buildings, property lines, streets, and unusual natural or
topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal (S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains less than 2.!10 of t% lead.
5. Commercial building, industrial building, multiple residences and similar buildings and installations, a certificate
of Code Compliance from architect or engineer responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
B. For existing buildings (prior to April 9, 19.57) non-conforming uses, or buildings and"pre-existing" land uses:
1. Accurate survey of property showing all property lines, streets, building and Unusual natural or topographic

The Zoning BoaTd of Appeals held a public hearing an this application on May 15, 2003,
at which time written and oral evidence were presented. Based upon all testimony.

Board finds the following facts to be true and relevant
APPLICANT'S REQUEST: The applicant proposes to remove the preexisting building
containing nonconforming setbeas, and requests an area variance to locate a new

this proposal and the existing conditions at the site. The bluff was found by the County

the toe of the bluff appeared to be In tact, and there was no physical amass established
to the beach from the top of the bluff The general topography is sloping away from the
bluff face, and the land Itself Is entirely vegetated with grasses and some landsoapmg.
The only other agency approval submitted for the record was Permit 05706 from the
Southold Town Board of Trustees Issued February 26, 2003.
RBASSON$ FOR BOARD ACTIt7N: On the bash of testimorry presented, materials
submitted, and personal Inspections, the Board made the following findings:
1. Grant of alternative relief noted below will not produce an undesirable change In the
character of the neighborhood or a detriment to nearby properties. The board believes
the proposed 45 ft. setback would be too dose and Intrudes within the 100 ft, restneted
building area. The property Is a nonconfnrming lot consisting of 25,129 sq. ft.. Improved
with a small building situated close to the seat side line at 2.4 feet and close to the
northerly bluff at 39.7 feet. The board concludes that the greater setback and conditions
set forth below are more In keeping with the established character M the n""IbOrhood
and not be adverse or detrimental to nearby properties. The location Of ft now dwell"
will also conform to the ourrenl code requlremenbs with regard to mininwm side yard and
front yard setbacks.
2. The benefit sought by the applicant can be achieved by some method feasible for the
applicant to pursue other than the area variance requested. Applicant can in"ase the
setback from the bluff as noted In the grant al alternative rellef noted below.
3. The requested variance at 45 feet Is substantial, with a 55% reduotfon of the code's
100 ft. minimum setback; and while the board believes a setback at least 50 feet from
the top of the bluff is substantlal, ft Is less offensive.
A. The relief requested was seH-created when this nonoonforming lot was acquired with

5. No evidence hat) been submitted to this board to suggest that the grant of alternative
relief will have an adverse Impact on physical or environmental oondltlons in the

Dear Mr. Hurtado:
Based on the information you have submitted, the New York State Department of Environmental
Conservation has determined that the property landward of the wood wall located at the top of the bluff Lis
shown on the survey prepared by Harry P. Hillebrand dated 7/27/02 and last revised on 7.%19/04 is beyond
Article 25 jurisdiction.
Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6NYCRR Part 66 1) no
permit is required under the Tidal Wetlands Act. Please be advised, however, that no construction.
sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional
boundary, as indicated above, without a permit. It is your responsibility to ensure that all necessary
precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface
or vegetation within Tidal Wetlands jurisdiction which may result from your project. Such precautions moy
include maintaining adequate work area between the tidal wetland jurisdictional boundary and your project
(i.e. a 15' to 20'wide construction area) or erecting a temporary fence, barrier, or hay bale berm.
Please be further advised that this letter does not relieve you of the responsibility of obtaining an% necessary
permits or approvals from other agencies.

Dear Mr. Hurtado:
The Southold Town Board of Trustees reviewed the survey prepared by Michael James
Hillebrand last dated January 21, 2004 and determined the proposed demolition of the
existing dwelling and construction of a new single-family dwelling to be out of the
Wetland jurisdiction under Chapter 97 of the Town Wetland Code and Chapter 37 of the
Town Code.
Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the
Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion
hazard area as indicated above, without a permit. It is your responsibility to ensure that
all necessary precautions are taken to prevent any sedimentation or other alteration or

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, February 26, 2003 regarding the above matter:
WHEREAS, J & C HOLDINGS LP applied to the Southold Town Trustees for a permit under
the provisions of Chapter 97 of the Southold Town Code, the Wetland Ordinance of the Town of
Southold, application dated January 23, 2003, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
February 26, 2003, at which time all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold
Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of J & C HOLDINGS LP to
add a 39.8' X 33' addition to the existing 20.4'X 26.4' residence, with the condition that
drywells and gutters are installed to contain the roof run-off, and as depicted on the approved
plan dated July 27, 2002 and last revised March 3, 2003.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Permit to construct and complete project will expire two years from the date the permit is signed.
Fees must be paid, if applicable, and permit issued within six months of the date of this
notification.
Inspections are required at a fee of$5.00 per inspection. (See attached schedule.)

Conservation has determined that the property landward of the wood wall located at the top of the bluff as
shown on the survey prepared by Harry P. Hillebrand dated 7/27,102 and last revised on 7/19/04 is beyornl
Article 25 jurisdiction.
Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6NYCRR Part 66-1 ) no
permit is required under the Tidal Wetlands Act. Please be advised, however, that no construction,
sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional
boundary, as indicated above, without a permit. It is your responsibility to ensure that all necessary
precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface
or vegetation within Tidal Wetlands jurisdiction which may result from your project. Such precautions nu y
include maintaining adequate work area between the tidal wetland jurisdictional boundary and your project
