Dear Mr. Costello:
The following action was taken by the Board of Town Trustees
during its regular meeting held on June 21, 2000 regarding the
above matter:
WHEREAS, Costello Marine Contracting Corp. on behalf of RICHARD
FRAKER applied to the Southold Town Trustees for a permit under
the provisions of the Wetland Ordinance of the Town of $outhold,
application dated MaY 15, 2000 and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on June 21, 2000 at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises In question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of
RICHARD FRAKER to remove and replace existing piles and
construct 134'-6" of new bulkhead (incl. 5' north return and 7'
south return) with "C-Loc" vinyl sheathing of 14' and 16'
lengths in front of existing bulkhead with the condition of a
10' non-turf buffer behind the bulkhead.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within slx months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

At the meeting of the Southold Town Conservation Advisory Council held Tuesday, June 13,
2000, the following recommendation was made:
Moved by Bill McDermott, seconded by Melvyn Morris, it was
RESOLVED to recommend to the Southold Iown Board of Trustees APPROVAL WITH A
CONDITION of the Wetland Permit Application of RICHARD FRAKER 107-6-1 to removed
and replace existing piles and construct 134'-6" new bulkhead (incl. 5' north return and 7' south
return) with "C-Loc" viny~ sheating of 14' and 16' lengths in front of existing bulkhead.

I have just returned from a trip and found the above Notice of Violation which my wife signed for
at the Post Office in my absence.
A Hearing before the Board of Trustees is requested.
My application for a permit requested permission to build a replacement bulkhead
directly in front of the existing deteriorated bulkhead - a distance of 18 inches.
When Mr. King looked at my bulkhead prior to issuance of the permit, he said: '1 don't
see any problem with building in front of the existing bulkhead, but you will not be able
to grow anything within 10 feet."
When I received the DEC permit in the mail, it was stipulated that the 18-inch
extension was denied and mandated that I had to build the replacement bulkhead
in the exact same place as the existing (deteriorated) bulkhead.
On the basis that there was to be absolutely no change to the property as it has
existed for 30 years, it was my understanding that the ten foot "buffer" was negated
by denial of permission to extend the bulkhead forward 18 inches.
Since I was never sent a copy of the Town Permit, there was never any intent to
push the envelope to acquire anything that didn't exist before.
As a retired Senior Citizen, it was a financial burden to replace this bulkhead. As a
Conservationist, I felt an obligation to replace it to preclude any situation that would possibly
jeopardize our waterway.
Your consideration of rescinding this violation would be most appreciated.
