Box 1179 Southold, New York 11971-0959 Telephone (631) 765-1892 Fax (631) 765-6641 May 23, 2005 Mr. Thomas Olsen 2804 South Main Street Newfane, New York 14108 BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD RE: THOMAS OLSEN SCTM# 106-1-31 1600 SOUND BEACH DR., MATTITUCK Dear Mr. Olsen: The Southold Town Board of Trustees reviewed the survey prepared by Joseph Ingegno last dated April 6, 2005 and determined the proposed wall to be built between the road end at Sound Beach Drive and the above referenced property to be out of the Wetland jurisdiction under Chapter 97 of the Town Wetland Code and Chapter 37 Coastal Erosion Hazard Areas in the Town Code. Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, without a permit. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Freshwater Wetlands, Tidal Wetlands jurisdiction, and Coastal Erosion Hazard Area, which may result from your project. Such precautions may include maintaining adequate work area between the freshwater wetland boundary, tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. However, any activity within 100' of a Wetland line or seaward of the Coastal Erosion Hazard Area would require permits from this office. This determination is not a determination from any other agency. If you have any further questions, please do not hesitate to call. Albert J. Box 1179 Southold, New York 11971 Attention: Board of Trustees To Whom It Mry Corcem: Enclosed is a recent survey of the property that my brother Raymond and I own at 1600 Sound Beach Drive in Marrituck. We would like to create a barrier on the west side of our p~operty that will separate our property fi.om the public parking lot on Sound Beach Drive. The construction will be a Iow wall that will begin at the end of the bulk head and will run to the curve at the end of the property. The wall will start at approximately four feet in height and slowly taper down to road level before the curve, complimenting the existing elevations of the house and property. The material that the wall will be constructed of is not agreed upon at this time, but I assure you that it will be tastefully done in either wood or stone. The existing concrete walk and base will be remowd and the area behind the wall will be back filled and landscaped. If there are any further questions, please contact me at 716-778-7208.
