The Board of Town Trustees took the following action during its regular meeting held on
Wecnesday, April 30, 2003 regarding the above matter:
WHEREAS, Land Use Ecological Services, Inc. on behalf of DONALD W. SUTER applied to
the Southold Town Trustees for a permit under the provisions of Chapter 97 of the Southold
Town Code, the Wetland Ordinance of the Town of Southold, application dated February 28,
2003, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for taeir findings and recommendations, and,
WHEREAS, a Public Heating was held by the Town Trustees with respect to said application on
April 30, 2003, at xvhich time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WH ~REAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold
Town Code,

At the meeting of the Southold Town Conservation Advisory Council held Wednesday,
March 12, 2003, the following recommendation was made:
DONALD W. SUTER to add an extension {o the existing framed garage. Existing
co~crete driveway to be removed and replaced with pervious stone. Construct an
addition on the northern side of the existing single-story house as well as enclosing
existing screened porch. Approx. 100 cy. of fill from an upland source will be utilized.
Proposed additions will still maintain lot coverage percentage under 20%.

The CAC did not make an inspection, therefore no recommendation was made.

Project Description:
Applicant proposes to add extension to existing flamed garage. Existing concrete driveway to be
removed and ~placed with pervious stone. In addition, applicant proposes to build an addition on
the northern side of existing single story house as well as enclosing existing screened porch.
Approximately 100 cy of fill fi~man upland source will be utilized. Proposed additions will still
maintain lot coverage percentage under 20%.
Variance Request:
A variance is hereby requested to the 75' setback requirement contained in Article 25 of the New
York State Environmental Conservation Law for a principal building or structure. The setback of
47' recuires a 32' variance to the setback contained within Article 25 for the proposed extension~
Reasons Supportin~ The Grantin~ Of A Variance Are As Follows:
l.) Thc owner is subject to a practical difficulty due to the size of the lot and the limited
building area.
2.) The extension is located on the north side of the dwelling and therefore will not impact
wetland resources.
3.) This project would maintain lot coverage below 20%.
4.) There is an existing dwelling located on the parcel and the enclosure of an existing deck and
the construction of a small extension will not adversely affect the wetland resources.

Dear Mr. Krupski:
Enclosed please find (3) revised surveys in regards to the above referenced project. These surveys have been
revised as per the recent town trustee meeting held 4-30-03 to depict dry wells proposed to contain roof runoff. The
18" h~gh timber retaining wall east of the residence has been removed from the survey, and the proposed fill required
has been reduced from 100 to 25+/- cubic yards.
