BLEVINS SCTM #104-5-23 r Ms. Herold, following action was taken by the Board of Town Trustees ing its regular meeting held on October 27, 1994 regarding above matter: REAS, OSCAR & B~T~ BLEVINS applied to the Southold Town stees for a permit under the provisions of the Wetland inance of the Town of Southold, application dated August 4 16, REAS, said application was referred to the Southold Town servation Advisory Council for their findings and ommendations, and REAS, a Public Hearing was held by the Town Trustees with pect to said application on October 27, 1994 at which time interested persons were given an opportunity to be heard, REAS, the Board merabers have personally viewed and are ~iliar with the premises in question and the surrounding area, REAS, the Board has considered all the testimony and Amentation submitted concerning this application, and, ZEAS, the Board has determined that the project as proposed not affect the health, safety and general welfare of the Dle of the town, THEREFORE BE IT, RE~OLVED, that the Board of Trustees approves the application of OSCAR & BETH BLEVINS to relocate existing house to parallel property lines in order that a 24' X 24' garage may be built on th~ east side of house, a 12' X 33' deck on west side of house, a ~ull foundation instead of concrete block piers, an enlargement of existing second floor, and enclose an existing scSeened porch. They do not ave an obDection to this request. Fherefore, we are in agreement that as a condition of the ~ranting of a permit by the Board of Town Trustees, the ~xisting sanitary system will be abandoned and filled, and a new sanitary system will be placed on either the ~aywaters or Mason Drive side of the house and outside the required setback from the wetlands. ?lease let me know if you need additional information. I have had discussions with both that department and the New York State Department of Environmental Conservation about relocating the sanitary system. The revised location for the system is in the area of the existing system that is to be abandoned. The new system will conform to current standards for a sanitary system and is not closer to the wetlands than the existing system. The NYSDEC did require an additional 15 feet of buffer at the wetlands line, and this has been indicated on the new drawings. I am requesting that the Board of Town Trustees review the enclosed submittal with the purpose of issuing an amendment to the permit. We are not able to comply with the requirement "move cesspools to front yard as far away from wetlands as possible" because of a conflict with other regulations. An application for relocating the sanitary system was filed with the Suffolk County Department of Health Services as requested by Thomas Fisher, Building Inspector. The plan showed the sanitary system located near test hole 2 as requested by the trustees' permit. The SCDHS has denied the relocation of the sanitary system. In order to conform to their requirements, the location of the sanitary system has to be a minimum of 100 feet away from neighboring wells or be no closer to neighboring wells than the existing sanitary system on the west side of the property. There is no location on this property where the sanitary system can be located 100 feet from neighboring wells. Also, the new location of the sanitary system is closer to the well located on the property to the north and closer to the wells located on the two properties across Mason Drive to the south. The SCDHS has denied our request because the safety of drinking water is first priority, and they feel the relocated sanitary system will adversely affect the 3 neighboring wells. Furthermore, the SCDHS would require the installation of a new well on this property. The existing well would be downhill from the new location for the sanitary system ~r. Krupski October 4, 1995 page two and subject to contamination from the sanitary system. Both the $CDHS and a representative from Kreiger Wells have informed us that only shallow wells are possible in this area. A deep well, which could be placed closer to a sanitary system, cannot be used in this area because there is no potable water at a greater depth. An additional problem is that relocating the well to the east side of this property would bring it closer to neighboring sanitary systems and therefore subject to pollution from them. The Suffolk County Department of Health Services has informed us that they will approve only the existing location of the sanitary system because the new location cannot conform to their requirements. The maintenance of potSble water for this and adjoining properties is the most important consideration. Roy Reynolds of the SCDHS is handling this application, H.S. Reference No. R10-95-0109.
