Mr. Robertson has asked me to submit my opinions on
the problem of additional spoil areas that have become
necessary to complete the dredging project of Broadwater
Cove.
Mr. B. J. Annabel, many others and m~self have worked
on th~$ project from the start. We feel that the lack of
Ispoil .a~ea is not an uncommon problem. It has been a
problem in most all other Southold Towh dredging projects.
We think our Supervisor, Mr. Albertson, will agree with us
on this.
Enclosed is a copy of a letter from Mr. R. M. Kammerer,
Commissioner of Public Works, which emphasizes this need for
spoil areas.
A few days after the dredging had started we were asked
So try to acquire more spoil area than was shown on the map
est of the inlet. This area was acquired and the dredging
~roJect kept going. A few days after that we were notified
that more spoil area was needed, preferably on Fishex~aen,s
Beach, East of the inlet which was not originally designated
as spoil area. This area also was acquired so that the
dredging could progress.
From both additional areas East and West of the inlet we
acquired several parcels of land from people who were against
this project from the start. After they saw the excellent
jlob that was being done and the type of hydraulic fill they
~ould receive they took it. We don't blame them.
We were also asked to find other additional inland
spoil area not shown on the map. One reason fur these
a~ditional spoil areas is that all the area mapped out North
of Eugene's Road was not acquired. We met with Mr. Evans
and Capt. Hanses and showed them what might be possible to
a~quire. It was explained to us that the area South of
EUgene's Road would be a good area if the owner would permit
alfour foot dike on the South and West sides. No dike around
the trees and the Town roads would act as the rest of the dike.
T~e pipe line would run across this area to the area diked
N~rth of Eugene's Road. They could pump in one area while the
ot~er settled and vice versa from the same line. In our opinion,
thms seems to be a sensible operation. This area was acquired
with these conditions and it was stated that if any of the
t~ees were damaged it wouldn't matter as most of them would be

You had a potantially difficult meting to handle last

a few items of diecueaica, unchallenged at the times that are ob-
viously incorrect and deserve to be so recorded.
Co-m~der Ke~n~*f mentioned a constant rising of the
coast (or sin~n~ of the sea) and the resultant closing off and
stagnation of estuaries and marshes. According to cu~:~nt
geological teaching the situation on the East Coast is one of a
submergent or sinking coast. Mr. Xen-~ Cf is correct when he pleads
ignorance in these matters.
Win Davids and 1~ll Boebe played the old tune that things
were better in the old d~e far in excess of fact and good taste.
~nce ~- remembrances date back to 1935, I can safely sa~ that
Win Davids' trip into the creek in a 12 ton sloop came on a spring
tide and does not represemt normal navigation even in those ch~.
Mr. Beebe mentions the water being quite deep during
his memorable gunning expeditious. Since m~ time out here (since
1933) paz~lels his, I can sa~ in all as~nestness that the increased
depth of water he commented on was an illusion fostered by his
b~'.oo~ height.
We beard mush last night about the difficulty of
navigation of a 15 - 16' boat other than at half to full tide.
In fact we know that an 18 t Homelite powered Thompson can get
in and out at all but the lowest neap tides.
Let us also look at the proper~y owners who are com-
plaining of this problem. They undoubtedly bought their property
at a price co-.musu~ate with the comclition of the waterfront
(less cost, less navigation), Moose Cove versus Fisher.~m's Beac~
=l~ the
for e,,m~le. To now expect Town's peO~ to share the
cost of ~.~2roving their berg purs as so t ~l 1 ogical.
For many years, Alvah, you used your marinas and access
channels "as is" or dredged them at ~r own expense. I bet you

Dear Dr. Graham:
I have been asked to acknowledge your letter of
September lq.
We too are concerned about the possible destruction
of valuable wetlands in the Lon~ Island area. With reference
to the dredging at Cutehogue Harbor, we eon~mented to the
Corps of Engineers along with the Fish and Wildlife Service
as follows:
"In view of the foregoing, therefore, we reeo~nend that
the per, it be issued only with the following conditions--
"1. That dredging in East Creek be delayed until after
April i to allow removal and transplanting of shellfish stocks.
"2. That the applicant remove the shellfish from
East Creek and transplant these shellfish to a suitable location.
"3. That both the removal and transplanting of shellfish
stocks be coordinated and directed by the New York State Division
of Fish and Game.
"q. That spoil deposited on the east shore of Broadwater
Cove be diked or confined so as to prevent any zlxnbaek into the
waterway.
"5. That all channel dimensions be limited to bottom widths
of 60 feet and depths of 5 feet at m.l.w."
The penmit was issued May 17 with no conditions other than
those routinely stated in every permit. We, of course, are not
in a position to tell the Cor~s w~at to do and, therefore, are
1/3hired to comments or advice. I am sure the Comps has their
problems too and felt they were doing right in issuin~ a permit
as they did.

Dear Mr. Albertson:
Your proposal for improvements to Broadwaters Cove has been under
consideration by this office following your request for cement on
possible effects on fish and wildlife interests. In general, we can
say, that the impact does not seem too severe.
Your total proposed dredging would remove about 42 acres of bay
bottom, as we estimate from the map which you provided. This will be
some loss of feeding grounds to waterfowl which use this area quite
extensively. The circulation within the Cove should be improved by
the proposed dredging. This could have a beneficial effect on some of
the organisms on which the ducks feed. This may compensate, at least
part~, for the loss of plants which will be destroyed in the dredging.
The Bureau of Marine Fisheries has looked at this area and con-
sidered its value as a shellfish producer. They informed me that
,shellfish production within the Cove is quite minor. The proportion
of bottom lost in dredging is relatively ~,~!1, and will not have
much interest to shellfisheries. Here again, it can at least be
lhoped, that improved circulation may encourage shellfish in this area.
We are concerned, of course, at the continual small losses to our
i waterfowl habitat. If these dredging operations can be kept to the
minimum, which will accomplish the other desirable purposes, we can
lessen the impact on waterfowl. If this channeling could be kept to a
75 foot bottom width and a maximum depth of not over six feet, it
would, of course, reduce the loss of waterfowl feeding grounds. A six
foot depth should allow eventual recovery of the watefowl foot plants,
even in the channel. Holding the width to 75 feet obviously reduces
the total acreage effect.
We are usually most concerned with the deposition of spoil.
This frequently has the greatest impact on wetlands. It would be a
decided advantage to fish and wildlife interests if this project would
use the maximum possible amount of spoil on your beach improvement
section. This would reduce the quantity which you would be required
to dispose of in the marsh area on the northwest end. ~ now have a

elpin~ them select spoil sites to reduce fish and wildlife losses. We
ould expect to do this on your proposal when it comes up for permit
fpplications. We hope this procedur~ will be of benefit to our interests
n your proposal.
In summary, there will be a loss to waterfowl which may be partly
ompensated. There will be a minor loss in shellfish, which may be
ompensated by improved circulation. The total impact can be lessened
y width and depth reduction and careful spoiling. Adjustment of the
hannel to remove the least possible islands, would also be desirable.
I hope the foregoing will adequately explain our position, and
you will be able to go ahead with your project. If we can be of any
further help, please let me know, and we will consult with you at your
convenience.

Dear Mr. Albertson:
In accordance with your request, we have reviewed
the two sheets entitled "Map Showing Proposed Dredging
in Broadwaters Cove, Town of Southold, Suffolk County,
New York", and have made an investigation of the site of
the proposed project.
The proposed dredging is in three branches, extending
northerly from Cutchogue Harbor on Peconic Bay, called
East or Eugene's Creek, Mud Creek, and Broadwaters Cove.
In our opinion, the proposed dredging of a channel in
these salt water estuaries about eight feet below mean Iow
water will have no harmful effect on the fresh water wells
in the vicinity.

We represent 100 property owners in the Town of Southold
whb wish to protest the proposed dredging operations by the Depart-
me~ of Public Works, Suffolk County, New York in order to prevent
or, ~.n any event, limit the extent of the dredging operations.
These property owners have signed a petition addressed
to you and the other Trustees of the Town of Southold requesting that
y~u hold a public hearing at which all of the residents of the Town
of Southold may be heard and the Trustees be advised of the wishes
and desires of the property owners for whom they are acting as Trus-
t~es under the provisions of the Edmond Andross Charter.
It is the hope of the petitioners to present to you at said
h~aring facts, evidence and arguments in order to induce the Trustees
tq take such action to protect the rights and interests of the proper-
ty owners as the Trustees may deem proper and necessary after holding
such a public hearing,

The undersigned being the owners of properties located
in the Town of Southold set opposite their respective names,
hereby petition the Trustees of the Town of Southold to
hold a public hearing on the proposed dredging by the Depart-
ment of Public I'torks, Suffolk County in Cutchogue Harbor,
Little Peconic Bay, at Southold, Suffolk County, New York,

Department of Public Works, Suffolk County, for a Department
of Army permit to dredge in Cutchogue Harbor, Little Peconic
Bay, Town of Southold, Suffolk County, New York and such per-
mit has or may be granted, and,
WHEREAS, the said Department of Public Works, Suffolk
County proposes to proceed with said dredging operations, and
WHEREAS, the Trustees of the Town of Southold are the
owners of the waters on which such dredging operations are
proposed and of other rights which ownership and rights are
in trust for the "freeholders and inhabitants~ of the Town
of Southold, and ~'their heirs successors and assigns~', in-
cluding the undersigned, pursuant to the provisions of the
Edmond Andross Charter or Patent vesting such ownership and
rights in said trustees as the successors of the original
grantees pursuant to said Patent or Charter dated the 31st
day of October, 1676, and,
~HEREAS, the aforesaid ownership and ri~ts in trust for
the freeholders and inhabitants, etc., of the Town of Southo]

notice, by advertisement, by newspaper publication or by such
other method as in the opinion of the trustees will reasonabl
