NOTICE IS HEREBY GIVEN that public hearings will be held by
The Board of Town Trustees of the Town of Southold, at the Southold
Town Hall, main Road, Southold, New York on WEDNESDAY, OCTOBER 30,
1985 on the following application for a permit under the provision
ot the wetland ordinance to commence at 8:00 P.M. :
In the matter of the application of Mattituck Inlet Marina
submitted by En-Consultants, Inc. to maintenance dredge within
(2) 45' x 20' travel lift slips to 5' below MLW. Approximately
65 cu. yds. of spoil will be removed from each. Remove (3) high spots
within the marina by maintenance dredging to surrounding depth of
5' Approximately 10 cu. yds. of spoil will be removed from each.
All spoil will be trucked away to the Town Dump. Project is located
on Mill Road, Mattituck, New York.
President Smith opened the meeting and asked if anyone had any
comments for the application:
Roy L. Haje: The project is necessatated by the movement of the
boats docked at the marina. The wash has silted up the bottom.
Those are the three spots that we are requesting to be removed.
The two boat slips are necessary to be dredged so that we can get
boats back and forth.
Trustee Kujawski: I believe this project was approved last year,
but not done.
Trustee Smith: Are there any other comments on this application?
No comments.
President Smith closed the hearing in the matter of the
Mattituck Inlet Marina.

A detailed description and plans of the applicant's activity are inclosed
to assist in your review.
The decision whether to issue a permit will be based on an evaluation of
the probable impact including cumulative impacts of the activity on the
public interest. That decisionwill reflect the ~ational concern for both
protection and utilization of important resources. The benefit which
reasonably may be expected to accrue from the activity must be balanced
against its reasonably foreseeable detrim~nt8. All factors which may be
relevant to the activity will be considered including the cumulative
effects thereof; among those are cooservation, economics, aesthetics,
general environmental concerns, wetlands, cultural values, fish and
wildlife values, flood hazards, flood plain values, land use, oavigaclon,
shoreline erosion and accretion, recreation, water supply and conservation,
water quality, energy needs, safety, food production and, in general, the
needs and welfare of the people.

It should be noted that information submitted by mail is considered just as
carefully in the perfect decision process and bears the same weight as that
furnished at a Public hearing.

Pursuant to Section 7 of the E Species Acc (16 D.S.C. 1531) and
based upon a review of the latest published version of the threatened and
endangered species listing, a preliminary determination is that the
activity under consideration will not affect those species listed or their
critical habitat.
Baaed upon a review of the latest published version of the National
RmglsCer of Historic Places, there are no known sites eligible for or
included in the Register within the permit area. Presently unknown
archeological, scientific, prehistorical or historical data may be lost by
work accomplished under the required permit.
Reviews of activities pursuant to Section 404 of the Clean Water ACC will
include application of the guidelines promulgated by the Administrator,
U.S. Environmental Protection Agency, under authority of Section 404(b) of
the Clean Water Act and the applicant will obtain a water quality
certificate or waiver from the appropriate state agency in accordance with
Section 401 of the Clean Water Act prior to a permit decision.
Pursuant to Section 307(c) of the Coastal Zone Management Act of 1972 as
amended (16 U.S.C. 1456(e)), for activities under consideration that are
located within the coastal zone of a state which has a federally approved
coastal zone management program, the applicant has certified in the permit
application that the activity complies with and will be conducted in a
manner that is consistent ~rlth the approved state coastal zone management
program. By this pablic notice, we are requesting the state's concurrence
with, objection to, or waiver of the applicant's certification. No permit
decision will be made until one of these actions occur. For activities
within thc coastal zone of New York State, the applicant's certification
and accompanying information is available from, and any rodents on, should
be addressed to the New York State Department of State, Division of Local

DESCRIPTION OF WORK
The applicant, Mattituck Inlet Marina, requests Department of the Army
authorization to maintenance dredge 5 specific areas within his marina
with upland disposal in Mattituck Creek at Mattituck, Suffolk County,
New York.
The proposed work includes dredging two small areas to the south
of the dredging area specified under existing Department of the Army
Permit No. 11996 issued on 8 July 1981. The previously authorized
dredging area and the proposed new dredging sites are depicted on the
attached drawing. The applicant estimates that approximately 65 cubic
yards of material from each of the two travel lift slips and
approximately 10 cubic yards of material from three high spots within
the marina would be dredged to a depth of 5 feet below mean low water
and trucked to the Town Dump or other suitable upland site. The
applicant estimates that maintenance dredging would be needed 3-4 times
within the ten year maintenance period.
The stated purpose of the proposed dredging is to allow safe use of
the marina facilities.

NOTICE OF NO SIGNIFICANT EFFECT ON THE ENVIRONMENT
Dated: September 25, 1985
Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that the Southold Town Trustees, as lead agency
for the action described below, has determined that the project,
which is unlisted will not have a significant effect on the
environment.
DESCRIPTION OF ACTION:En-Consultants, on behalf of Mattituck Inlet
Marina to Maintenance dredge within (2) 45' x 20' travel lift slips
to 5' below MLW. Approximately 65 cu. yds. of spoil will be removed
from each. Remove (3) high spots within the marina by m~intenance
dredging to surrounding depth of 5'. Approximately 10 cu. yds. will
be removed from each. All spoil will be trucked away to the Town
Dump. Project is located on Mill'Road, Mattituck, New York.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effect to the environment
are likely to occur should the project be implemented as planned.
Because there has been a response from the Southold Town
Conservation Advisory Council indicating that this project would
not have a significant effect to the environment.
Because there has been no response in the allotted time from
the New York State Department of Environmental Conservation and the
Southold Town Building department, it is assumed that there are no
objections nor comments from those agencies.

The validity of this permit is or may be subject to the approval of other governmental or municipal
authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the
event that such approval is necessary, the holder of this permit shall not commence operations here-
under until such approval has been obtained in writing, The failure to obtain such other approval when
required shall subject this permit to immediate revocation by the Trustees upon receipt by the
Trustees. of written notice from such other governmental or municipal authorities of its refusal or
disapproval.
The applicant does by the acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
dais permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
its officers and employees to enter upon the premises where such operations are being conducted to
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit.
This operation will not substantially: A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town,
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect the health, safety and general welfare of the people of the town.

At a regular meeting of the Board of Trustees held on
October 30, 1985 the following action was taken regarding the
wetland application for Mattituck Inlet Marina:
Moved by Trustee Kujawski seconded by Trustee Bredemeyer
WHEREAS, En-Consultantst Inc. on behalf of Mattituck Inlet Marina
applied to the Southold Town Trustees for a permit under the
provisions of the Wetland Ordinance of the Town of Southold,
application dated July 18, 1985 and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on October 30, 1985 at which time all interested
persons were given an opportunity to be heard, now, therefore, be it
RESOLVED that En-Consultants, Inc. on behalf of the Mattituck
Inlet Marina be granted permission under the provisions of the
Wetland Ordinance of the Town of Southold, New York, akl in
accordance with the application. This permit will expire on
October 30, 1986 if work has not commenced by said date. There
shall be two inspections required; and the Trustees shall be
notified when the project is complete.
Please be advised that a $5.00 inspection fee for the
Wetland Permit is now due and payable. Upon remittance, your
permits will be forwarded by mail.

is hereby given that the Southold Town Trustees, as lead agency
for the action described below, has determined that the project,
which is unlisted will not have a significant effect on the
environment.
DESCRIPTION OF ACTION:En-Consultants, on behalf of Mattituck Inlet
Marina to Maintenance dredge within ~2) 45' x 20' travel lift slips
to 5' below MLW. Approximately.65 cu. yds. of spoil will be removed
from each. Remove (3) high spots within the marina by m~intenance
dredging to surrounding depth of 5' Approximately 10 cu. yds. will
be removed from each. All. spoil will be trucked away to the Town
Dump. Project is located on Mill Road, Mattituck, New York.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effect to the environment
are likely to occur should the project be implemented as planned.
Because there has been a response from the Southold Town.
Conservation Advisory Council indicating that this project would
not have a significant effect to the environment.
Because there has been no response in the allotted time from
the New York State Department of Environmental Conservation and the
Southold Town Building department, it is assumed that there are no
objections nor comments from those agencies.
