TERMS .'.nd CONDITIONS The Permit~ee Mattituck Inlet Marina residing at Mill Roadt Mattituck, N. Y, as part of the consideration for the issuance of the permit does understaml and p~escribe to the fol- lowing: 1. That the said Board of Trustees and the Town of Southold ~e relmsed from any ami al/ damages, or claims for damages, of suits ~ directly or indirectly as a result of any oper- ation performed pursuant to this partoit, and the said Parmittee will, at his or her own expense, defend any and all such suits inlti~ted by third parties, and the mid Permittee ~,m~ fall ~b~it~ with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold 2. That this Permit is vaiid for a period of 12 mo~ which is comldamd to be the estimated time required m complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later dat~ 3. That this Permit should be retained indefinitely, or as long as the said P=~mlttee w/shes to maintain the structure or project involved, to provide evidence to anyone concerned that ~uth- orization was originally obtained. 4. That the work involved will be subject to the inslx*etion and approval of the Board or its agents, and non-compliance with the provisions of the originating application, may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall he no interference with the right of the public' to pass and repass along the beach between high and low water marks. 7. That if furore operations of the Town of Sonchold require the removal and/or altr. ratioas in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, she work sha~l cause unreasonable obstrucaon to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work or proiect herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee or the completion of the wock auth- orized. 9. Y. 11971 Dear Mrs. Hataire: I am again appealing to you and the Board to resolve the matter of the fee for the dredge spoil for Mattituck Inlet Marina. Both NYSDEC and Corps permits have been received as well as Southold Town approval. The applicant is anxious to begin work so the area will be prepared for the spring season. It is only a question the fee to be imposed which is delaying the subject. I am sure that the situation can be amicably resolved between the applicant and the Board. The last time I had spoken with Mrs. Hataier, I was informed that it was the position of the Trustees that a $2/yard fee must be imposed. Looking at the number of yards which must be removed, the requested fee would be astronomical and would in fact exceed the cost of the project itmelf. Please be aware that the proposed work is maintenance and is not new work. As this work must be done on a periodic basis to continue operation of the facility, it is a great hardship to the owners to impose such a large application fee for every instance. Would it not be more appropriate to charge a fee for initial dredgin~ and waive future fees for maintenance of that facility? My clients have attempted to find a "public" use for the spoil as either beach nourishment, road sanding, etc. but to no avail. The owners have no use for the spoil and would be happy to offer · to the Town for any legitimate use they can think of. Please continue to process the application taking into account these comments. To continue to insist upon the fee~ impose§ a hardship upon my client and others who, might find themselves in the same position in the future. If the Town hopes to maintain the marinas which are so important to the image and economv of the Town of Southold, I am sure it can resolve the situation. RESOLVED to recommend to the Southold Town Board that a wetlands permit not be required in the matter of the maintenance dredging proposed by Mattituck Inlet Marina because there are no wetlands involved.
