The following recommendations were made by the CAC at its regular
meeting held Tuesday, November 15, 1988:
RESOLVED to recommend to the Southold Town Trustees approval of
Wetland Application No. 667 of Robert G. Kassner on behalf of Nunnakoma
Waters Association Inc. to dredge channel, approximately 3600 c.y. of
material to be hydraulically removed and pumped to adjacent beach
nourishment.
Corey Creek, Southold. Southerly end of Wampum Way.
RESOLVED to recommend to the $outhold Town Trustees approval with
stipulations Wetland Application No. 668 of Mattituck Inlet Marina for
proposed dock and dredging. The CAC approves with the stipulation
that the proper gradient is maintained to prevent the distruction of
the bank and grasses. Also, due to the large number of boats and
the popular use of the marina the CAC feels the Southold Town Trustees
should require a pumpout facility at the marina.
Mill Road, Mattituck.
RESOLVED to recommend to the Southold Town Trustees approval of
Wetland Application No. 669 of Marie Nerosyan to remove and replace
(in same location and configuration) 23 l.f. of existing timber bulkhead
and attach to existing bulkheads to north and south. An 8~ return
to be constructed on north side. Replace and existing stairway and
8' x 11' fixed dock with a 4' x 20' walk. Maximum 10 c.y. of spoil to
be removed from in fornt of bulkhead to 3' below MLW and used as backfill.
Mesrobian Drive, Laurel.
RESOLVED to recommend to the Southold Town Trustees approval of
Wetland Application No. 671 of Daniel C. Mooney to install and maintain
three fence posts and 16' split rail fence, The CAC wishes to state,
for the record, that it feels that this type of application is not necessary
and the applicant slqould be refunded the application fee.

RESOLVED to recommend to the Southold Town Trustees approval of
Wetland Application No. 670 of George Anderegg, Jr. to remove and
replace (in same location and configuration) 57 I.f. of existing timber
bulkhead and two 4' returns. Backfill with concrete to be brought ill.
Note: I~ulkhead to be removed is second existing bulkhead, first bulk-
head will remain.
9045 Nassau Point Road, Cutchogue
RESOLVED to recommend to the Southold Town Trustees disapproval
with recommendations of Wetland Application No. 678 of Geoffrey L. Penny
to add retaining wall around man-made boat basin and maintenance dredge.
The CAC recommend disapproval of the retaining wall because no need
is shown and the CAC has a policy not to recommend retaining walls
on protected areas in creeks.
The CAC recommends, however, the following:
1. Two angled returns which are a continuation of the existing
bulkhead. Returns should be angled to minimize wetland intrusion,
and fill behind the returns.
2. Oredge area not be 4' to MLW. Recommend a gentle slope be
established to shoreline.
3. Recommend the applicant keep a 20' to 30' natural buffer zone.
Mason Drive, Cutchogue.
RESOLVED to recommend to the Southold Town Trustees approval of
Wetland Application No. 656 of Martin W. Kruse to construct 45' of 4'
catwalk, 80' of 6' dock, 8' x 40' float dock with a 20' ramp and related
mooring pilings. The CAC recommends approval, however, would like
to note that the length of the dock exceeds the Trustees' guideline of
75'.

WEAKEN OR UNDERMINE THE LATERAL SUPPORT OF OTHER LANDS IN THE VICINITY.
OTHERWISE ADVERSELY EFFECT THE HEALTH, SAFETY OR GENERAL WELFARE OF THE
PEOPLE OF THE TOWN.

plete because it. does not have a topographic map showing
elevations or depths in the project area.

Dear Mr. Thurber:
There are several misconceptions in your October
6, 1988 letter. Prior to preparing this applica-
tion an on-site meeting was held betweeen Mr. Charles
Hamilton of the Bureau of Marine Habitat Protection,
the Southold Board of Trustees, and the applicant.
The purpose of that meeting was to develop an alterna-
tive which would be most acceptable to all involved
regulatory agencies. The initial inquiry of the
property owner was whether the existing bulkheading
could be continued southward and the inter-nidal
marsh removed by dredging. This met with disfavo~
from Mr. Hamilton. As an alternative he suggeste6~
that docks be placed around the inter-tidal marsh
and that dredging to create deep water occur off them.
While this alternative would not create as much us-
able docking area, my client decided to adopt it
in the reasonable hope and expectation that it would
be more likely to be approved.
It was not and is not our intention to remove any
of the inter-tidal marsh. It is our intention to
deepen tile existing open watel area to allow boats
of the size and caliper regularly associated with
this marina to utilize the new dock. As stated pre-
viously these docks will be used as in-water maintenance
areas rather than permanent moorings.
We are very disturbed by the tone and thrust of
this letter given our efforts as outlined above.
Therefore before we go to additional expense as
described on page two of your letter, we request
the opportunity to meet with you and BMHP person-
nel to clarify precisely what is being requested.
We look forward to bearing from you to arrange a
mutually convenient date.

which is the subject of a residential subdivision proposal.
2. Southold Shores- The Planning Board feels that this is
primarily under the jurisdiction of the Trustees, therefore
they feel the Trustees should be le~d agent. However, the_
Planning Board would be willing to review any proposed
· charges to the upland area and make recommendations to the
Trustees regardzng the design of new parking areas or
drainage systems.

Pursuant to 15 CFR 930.58, the following data and information is necessary
to enable the Department of State to adequately assess the coastal zone effects
of this proposed project.

Although an additional 435' of floating dock is planned, the
application indicates that no additional boats will be accommodated
bY this marina expansion. Please explain this apparent conflict.
Also, supply a more exact figure which reflects the number of boats
now using the marina. What will the proposed dock be used for, if not
to provide mooring for more boats?

The installation of either fixed or portable pumpout facilities at
t~is marina may be a necessity. Please discussed your clients'
reasons for not installing vessel~.pumpouts. Are any available in the
vicinity of the marina? Where are the nearest pumpouts located? WhWt
are the lengths and dPaft-s of the boats that are now and will be
utilizing this marina?
Please provide a profile view of the proposed dredging area from a
north-south perspective, showing the dredge area slope and edge in
relation to the nearby intertidal marsh vegetation. How will the
wetland be protected during the dredging operation?
Please indicate the distance from the 265' dock section to the
opposite shore of Mattituck Creek at low and high tides. What are the
creek depths off this dock section?

endangered species listing, a preliminary determination la that tbs

Based upon a review of the latest published version of the National
Register of Historic Places, there are no known sites eligible for or
included in the Register within the permit area. Presently unkn. own

work accomplished under the required permit.
Reviews of activities pursuant to Section 404 of the Clean Water Act will
include application of the guidelines promulgated by the Administrator,
D.S. Environmental Protection Agency, under authority of Section 404(b) of

Pursuamt to Section 307(c) of the Coastal Zone Management Act of 1972 as

DESCRIPTION OF WORK
The applicant, Mattituck Inlet Marina, requests Department of the Army
authorization to dredge with ten years maintenance and install a floating
timber pier assembly in Mattituck Creek at Mattituck, Suffolk County,
New York for the stated purpose of increasing mooring capacity.
The work would involve the dredging of a 70 foot wide by 165 foot long
area to a depth of -5 feet below mean low water removing approximately
500 cubic yards of material. Also proposed is the insta'lation of
an "L" shaped floating timber pier assembly consisting of 2 sections;
east-west would be 8 feet by 170 feet north-south section would be
8 feet by 265 feet. A 4 foot by 16 foot hinged walk-ramp off .the
existing bulkhead would be installed to provide access to the floating
piers.
The applicant also plans to maintenance dredge twice during the ten
year life of the permit, if issued, removing approximately 100 cubic
yards of material per event. All dredged material from initial and
subsequent dredging activities would be placed in an upland site, where
it would be suitably retained from reentering the waterway.

Dear Mr. Haje:
The Department of State has completed its evaluation of your Federal
Consistency Assessment Form and certification that the above proposed permit
activity complies with New York State's approved Coastal Management Program,
and will be conducted in a manner consistent with this program.
Pursuant to 15 CFR Section 930.63, and based upon the project information
submitted, the Department of State concurs with your consistency certification
subject to the following conditions:
1, To prevent or minimize the discharge of vessel wastes into Mattituck
Creek:
(a) A portable vessel waste pumpout facility shall be installed to
service boats with marine toilets.
(b) Signage shall be posted indicating that vessel wastes must not be
discharged into Mattituck Creek (sample language attached).
(c) A "no-discharge" clause shall be included in dock lease or rental
agreements (sample language attached).
In order to further minimize water quality impacts in Mattituck Creek
due to the proposed work, dredging shall not take place between June 1
and September 30 of any calendar year.
In order to minimize disturbance to the existing vegetated tidal
wetland, dredging shall not occur within fifteen feet (15') of the
edge of this vegetated wetland.

the Division of Regulatory Affairs at the address and t~ephone noted below.

shall be protected from the weather and posted in a conapicinns location

At least 48 hours prior to commencement of the project, the permittee shall
complete and return the top portion of the enclosed receipt for~ certifying
that he is fully aware of and understands all provisions and conditions of
this permit. Within one week of completion of the permitted work, the
bottom portion of that form shall also be completed and returned.
For projects involving activities to be accomplished over a period er more
than one year, the permittee shall notify the Regional Permit Administrator
in ~riting at least 48 hours to the c~encement of resumption of work each
year.
If project design modifications take place after permit issuance, the
permittee shall submit the appropriate plan changes for approval by the
Regional Permit Administrator prior to undertaking any such modifications.
The permittee is advised that substantial modification may require sub-
mission of a ney applicatipn for permit.
All necessary precautions shall be taken to preclude contnmtnation of any
wetlands or water~ay by suspended solids, sediment, fuels, solvents,
lubrica~ts, epoxy coatings, paints, concrete, leachate or any other
enviroomentally deleterious materiels associated with the project work.
Any failure to comply precisely with all of the terms and conditions of
this permit, unless authorized in witing, shall be treated as a violation
of the Environmental Conservation Law.
The permittee is advised to obtain any permits or approvals that may be
required from the U.S. Department of Army Corps of Engineers, NY District,
26 Federal Plaza, Ne~ York, NY 10278, (Attention: Regulatory Functions
Branch), prior to c~encement of work authorized herein.
The granting of this permit does not relieve the permittee of the
responsibility of obtaining a grant, eas~nt, or other necessary approval

if ownership is not noted on the survey itself.

Letter from En-Consultants dated 9/9/85 describes the
proposed dredge area to be 200 feet by 1600 feet; while
the submitted plan indicates all dredging to be within the
marina, close to the ends of the longer docks, the entire
creek width is 200 feet. Therefore the stated outer limits
of dredging would extend dredging beyond marina perimeter to
the opposite shore.

Plan by En-Consultants (9/9/85) indicates 5 foot depth below
mean low water (MLW) in the marina. However, Lewandowski
survey of 11/19/88 indicates area south of southern dock is
either shoal and mudflats area or is less than 3 1/2 feet
below MLW.

From a site inspection on 8/25/88 DEC staff discovered an
oyster reef in the area south of the existing southern most
dock which indicates this shoal has a high fish and wildlife
habitat value.
(7)
Due to inaccuracies of the En-Consultants 9/9/85 plan dredging
as authorized would allow dredging of intertidal marsh-high
meadow areas destroying the values of these wetlands and
likely cause increased shoreline erosion.
(8)
Since the Eh-Consultants 9/9/85 plan does not show the inter-
tidal marsh-high meadow tidal wetlands areas on the southern
part of the property which were also discovered on the 8/25/88
site inspection extensive buffers had not been included in the
issued permit to be protective of tidal wetlands values and
shoreline integrity.
In view of the above inaccuracies (1), (3), (4); materially false
information (2), (5); and new information (6), (7), (8), the Department
intends to modify this permit, pursuant to 6 NYCRR Part 621.14(a) of the
Uniform Procedures Act (as revised 12/88) as follows:
The permitted dredging areas are to be limited to 100 feet
(maximum) width by 800 feet length extending from the northerly property
line south to the northern side of the existing southern most dock and
extending east from the existing bulkhead to the eastern end of the
floating docks.

Before any work is to be conducted on the site, a revised accurate
survey showing existing field conditions must be submitted. A revised
accurate survey incorporating the revised project description must also
be submitted.
Ail other terms and conditions remain as written in the original
permit.
In accordance with 6 NYCRR Part 621.14(c) within 15 days of the
date of this Notice you may submit a written statement giving reasons
why the permit should not be so modified, or requesting a hearing, or
both.
If you do not submit such a statement in this regard, the permit
will be modified as stated above effective January 25, 1989.

Dear Mr. Haje:
The NYS ~epartment of Environmental Conservation has further reviewed this
proposal in light of your snbmittal of January 5, 1989, and notes that the
following information still needs to be submitted for this agency to conduct
its review:
(1) Revised project description including details as to areas,
depths and amounts of dredging.
(2)
Statement as to Alternatives with Supporting Data as
requested in my ~etter to you dated 10/6/88. Also consider:
impacts due to prop wash from boats, scouring away of inter-
tidal marsh and disturbance to the shoal area; reconfiguration
of existing marina within existing dock perimeters to possibly
allow more dockage without expanding to the south into valuable
natural areas.
(3) A statement as to why the proposal is reasonable and necessary,
whether for mooring of boats for transients or for repairs.
(4) Details as to who owns the bottom.
(5) Statement as to the practical difficulty of continuing the
operation of this marina without the proposed expansion.
Please be advised that expanding south of the existing southerly dock and
dredging the shoal will likely involve a hearing before a decision can be made.
