The office of the Board of Trustees has inspected the above referenced property as per
your request for landscaping within the Trustees 100' jurisdiction from Tidal Wetlands,
as per Chapter 97 of the Town Code.
The area landward of the bulkhead is defined as a beach/high marsh area and contains
meadow wetland species including salt hay grass (Spartina patens), black grass (Juncus
gerardii), marsh elder (Iva frutescens), groundsel bush (Baccharis halimfolia); these are
all protected wetland species as defined in Chapter 97. The Trustees would not allow any
topsoil, fertilizers, irrigation, lawn seed or turf in this area.
If the owner wants to do landscaping other than lawn, they may apply for a permit for
activity within 100' of tidal wetland vegetation. The Trustees would only allow native
plantings in that area that would not require any fertilizers or irrigation, such as beach
grass, additional Baccharis or patens plants, bayberry, red cedar, and Rosa rugosa. This
office and/or the NYSDEC can provide you with a more extensive list of allowed native
Plants. Please contact this office for a wetland application for plantings within Trustee
jurisdiction.
Enclosed is a copy of the survey with the highlighted area of existing lawn and oak trees,
showing that lawn is allowed landxvard of that line.
