Geoffroy Penny and Henry and Ann Wong to the Debra A. Roth 2012 Family Trust, as
they are the new owner of the subject parcel effective July 14th, 2022.
I have enclosed a copy of the executed deed for your records, along With an
executed Affidavit, Owner's Authorization, Owner's Transactional Disclosure Form,
Agent's Transactional Disclosure Form, and an attorney escrow check payable to the
Town of Southold in the amount of$250.00 for the required transfer fees for all five (5)
permits.

Dear Mr. Penny:
The Board of Town Trustees took the following action during its regular meeting held on
Wed., March 21 , 2007 regarding the above matter:
WHEREAS, GEOFFROY L. PENNY applied to the Southold Town Trustees for a permit
under the provisions of Chapter 275 of the Southold Town Code, the Wetland
Ordinance of the Town of Southold, application dated January 16, 2007, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed timber access
walk be found Inconsistent with the LWRP, and offered no recommendation on the
proposed flagpole, and,
WHEREAS, a public meeting was held by the Town Trustees with respect to said
application on March 21, 2007, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,

WHEREAS, the proposed timber access walk does not comply with the standards set
forth in Chapter 275 of the Southold Town Code,
WHEREAS, the Board has determined that the proposed timber access walk will affect
the health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees deems the proposed timber access walk to be
Inconsistent and the proposed flagpole to be Consistent with the Local Waterfront
Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and,
BE IT FUTHER,
RESOLVED, that the Board of Trustees DISAPPROVES the application of GEOFFROY
L. PENNY to Amend Permit #6069 o construct a 36"X 45' timber access walk a min. of
3' above grade because only one dock is permitted per residential lot pursuant to
Chapter 275-11; Construction and operation standards, Section C, Item 2c, and,
BE IT FURTHER,
RESOLVED that the Board of Trustees hereby APPROVES the Amendment to Permit
#6069 to install a 20-25' flagpole adjacent to the existing deck, and as depicted on the

The proposed action has been reviewed to Chapter 268,Waterfront Consistency Review of the Town of Southold
Town Code and the Local Waterfront Revitalization Program(LWRP)Policy Standards. Based upon the
information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the
records available to me,it is my recommendation that the proposed action is INCONSISTENT with the denoted
following Policy Standards and therefore is INCONSISTENT with the LWRP.
Policy 6 Protect and restore the quality and function of the Town of Southold ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and
regulations for all Andros Patent and other lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit
conditions.
The proposed action involves the the location of a second dock structure(catwalk) on a parcel; Only one dock
is permitted per residential lot pursuant to & 275-11; Construction and operation standards Section C Item
2c which states:
(c) Regulations for the placement and configuration of docking facilities
[11 Residential docks. [Amended 10-11-2005 by L.L.No. 17-20051

I. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This

The Board of Town Trustees took the following action during its regular meeting held on
Wed., January 19, 2005 regarding the above matter:
WHEREAS, Patricia C. Moore, Esq. on behalf of GEOFFROY PENNY applied to the
Southold Town Trustees for a permit under the provisions of Chapter 97 of the Southold
Town Code, the Wetland Ordinance of the Town of Southold, application dated
November 1, 2004 and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on January 19, 2005, at which time all interested persons were given an
opppo un-i o e ear ;and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,

WHEREAS, the structure complies with the standards set forth in Chapter 97 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of GEOFFROY PENNY
to reconstruct the existing 232' bulkhead, in-place with plastic interlocking sheathing,
and matching the existing elevation, with the condition helicoils are used in lieu of
deadmen in order to avoid disturbance to the marsh, a 15' non-turf buffer is installed
between the lawn area and the wetlands, and all as depicted on the plan prepared by
Robert H. Fox last dated January 27, 2005.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of$50.00 per inspection. (See attached schedule.)

Batter piles inside the boat basin presented problems for
the owner in that it would reduce the usable space inside the
boat basin, the owner expressed concern that the batter piles
would interfere with vessel maneuverability inside the boat
basin and adversely impact navigation, particularly in the
entrance channel to the boat basin.
We have incorporated your recommendations with regard to
the construction of the replacement bulkhead and we show the
existing bulkhead & piles cut to the mud line .

Bulkheads & Seawalls:
Diagonally installed Helix anchors offer a cost-effective alternative
to battered piles and buried deadmen for securing sheetpile (steel,
vinyl, and fiberglass) and timber bulkheads. Disturbance to the
landscaping, swimming pools, and other structures is avoided, and all
work can be performed from the water side. Threaded adapters are

The Benefits:
High-Holding:
Our anchors derive their holding from the soils into which they are
screwed. The Square Shaft anchors are installed with the aid of hydraulics to
screw the anchor through resisting soils. Our anchors have been repeatedly
tested by Mother Nature and tugboats with load measuring equipment
The results of the first test (performed in Vineyard Haven, Massachusetts,
under the watchful eye of area harbor masters, a marine industry reporter,
and a representative of Boat/US) are typical of all the load tests performed.

Long Life:
Our high-load marine anchor is built on a solid, square shaft measuring 1
3/4" on a side. It is protected with hot-dipped galvanizing, and the termination
includes a
1 1/8" shackle which encircles the shaft and connects to the anchor rode
(Seaflex elastic rode, chain, rope, and cable have all been used successfully).
Compare the mass of steel in our shaft with the steel in the eye of a
mushroom or the staple in a deadweight block.
Insurance Premium Discounts:
Two national marine insurance companies offer discounts to boat owners
and marina managers who secure their boats and floating docks with a Helix
anchor. A third insurance company prepared a pamphlet on moorings in
which it described our anchors as "exceptionally effective". Copies of the
letters and pamphlet are available.
Environmentally Friendly:
Because these anchors don't drag around the harbor bottoms and can be
effective with shorter scopes, these anchors are preferred in environmentally
sensitive areas and have been recommended by some state agencies and
scuba-diving tour companies.

Dear Ms . Westerlind;
Enclosed please find revised plan for the
replacement of existing bulkhead, in kind and in
place . The contractor, myself, Southold Town Trustee
Jimmy King, Charles Hamilton and Chris Arfsten met at
the owner' s property to review the plan.
We discussed the use of Helix anchors and tie
rods to secure the rebuilt bulkhead. The Helix
anchors are an environmentally appropriate alternative as the
anchors can be installed with almost no disturbance to the
wetlands . The anchors are installed from equipment in the boat
basin or from the water without equipment placement in the
wetlands . We have enclosed sales information from the
manufacturer for your information. This product would mitigate
the concerns raised by your department and would provide an
acceptable environmentally appropriate alternative to the owner.
Mr. Hamilton was familiar with the product, however, he
requested additional information and submission of the design,
and said he would consider this alternative . This alternative
was acceptable with Trustee King, the owner and recommended by
the contractor.
Batter piles inside the boat basin presented problems for
the owner in that it would reduce the usable space inside the
boat basin, the owner expressed concern that the batter piles
would interfere with vessel maneuverability inside the boat
basin and adversely impact navigation, particularly in the
entrance channel to the boat basin.
We have incorporated your recommendations with regard to
the construction of the replacement bulkhead and we show the
existing bulkhead & piles cut to the mud line .
We thank you and Mr. Hamilton for taking the time to review
the plans in the field and look forward to your consideration of
the alternatives .
