The Board of Town Trustees took the following action during its regular meeting held on
Wed., June 22, 2005 regarding the above matter:
WHEREAS, En-Consultants, Inc. on behalf of FAITH BEISER & KEVIN BUCCINA
applied to the Southold Town Trustees for a permit under the provisions of Chapter 97
of the Southold Town Code, the Wetland Ordinance of the Town of Southold,
application dated June 1,2005 and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on June 22, 2005, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of FAITH BEISER &
KEVlN BUCClNA to construct a two-story, one-family dwelling with attached outdoor
shower; install a pervious driveway, drainage system of drywells, and concrete retaining
wall for proposed sanitary system proposed more than 100' from wetlands; and
establish a 50' non-disturbance/non-fertilization buffer to remain natural and undisturbed
adjacent to on-site freshwater wetlands, and all as depicted on the survey prepared by
Stanley J. Isaksen, Jr. last dated July 18, 2005.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

CONSERVATION ADVISORY COUNCIL
TOWN OF SOUTHOLD
At the meeting of the Southold Town Conservation Advisory Council held Tues., June
14, 2005, the following recommendation was made:
Moved by Jack McGreevy, seconded by Tom Schlichter, it was
RESOVLED to recommend to the Southold Town Board of Trustees APPROVAL WITH
CONDITIONS of the Wetland Permit application of FAITH BEISER & KEVlN BUCCINA
to construct a two-story, one-family dwelling with attached outdoor shower; install a
pervious driveway, drainage system of drywells, and concrete retaining wall for

The CAC recommends Approval of the application with the Condition a vegetation plan

]'he proposed action involves the construction of a two-story, one family dwelling with attached outdoor
shower~ install a pervious driveway, drainage system or drywells and concrete retaining wall for proposed
sanitary system. Test hole indicates that groundwater is 2.6' from surface. High quality freshwater
systems occur to the south, and southwest of the parcel. An intermittent stream occurs on site. The
subject pamel and surrounding parcels water supply is via private wells.
Construction best management practices proposed by the applicant include:
1. The establishment of a 50' natural and undisturbed buffer south of the intermittent
stream/wetland. A 100' jurisdictional buffer from the wetlands systems to the south and
southwest.
2. The establishment of a hay bale line and silt fence 50' from intermittent stream wetland
boundary.
3. The installation of a pervious driveway and drywells
4. An elevated septic system with retaining wall.
The proposed action has been reviewed to Chapter 95. Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based
upon the information provided on the LWRP Consistency Assessment Form submitted to this department,
as well as the records available to me, it is my recommendation that the proposed action is generally
CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided
that the following standard best management practices are implemented.
A fence is proposed to be installed on the northeast side of the structure. Require that the
applicant show a building envelope on the final plat to determine limits of furore
construction.
2. Employ the following water quality protection measures to further the intent of LWRP
Policies 1, 5, and 6:
a. Impose limits of clearing of the area not included within the building envelope (to be
determined).
Additionally it is recommended that the Board of Trustees apply the following best management practices
for landscaping, lawn establishment and maintenance of the lawn post construction to further protect the
water quality of wetland systems and the aquifer:
l. Install and preserve, existing native landscapes and natural ground covers.
2. Choose native plants for landscaping.
3. Choose disease-resistant and drought-tolerant plants.
4. Minimize lawn areas, replacing turf with native trees and understory.
5. Use integrated pest management (IPM) techniques, including beneficial insects.
6. Use appropriate grass varieties (e.g., sun tolerant vs. shade tolerant).
7. Take steps to improve soil structure (annual or periodic soil aeration, additions of organic
matter, etc.).
8. Leave grass clippings on the la,sm as mulch.
9. Cut la'am no shorter than 3" to encourage deep roots.
10. Do not overwater la'ams (excess irrigation causes soil nutrients to be lost).
Additionally, where fertilization is proposed:
1. Apply a maximum of 1 lb. of nitrogen per 1000 square feet in any one application, with a
cumulative application of no more than 2 lbs. per 1,000 square feet per year.
2. Choose fertilizers where the water-soluble nitrogen is no more than 20% of the total nitrogen
in the mixture.
3. Choose organic fertilizers, whereby all nitrogen in the mixture is non-synthetic.
4. Keep equipment properly calibrated to avoid over-application.
5. Don't apply fertilizers and pesticides within 100 feet of surface waters and wetlands.
6. Apply product only during growing season (typically mid-March through mid-October).
7. Don't apply fertilizers when it is raining, or when rain is likely to occur within 24 hours
Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.

The proposed project entails the development ora residential building parcel situated between two existing
houses. The majority of the proposed construction is located beyond Chapter 97 wetlands jurisdiction, and
the portion of the work located within 100 feet of wetlands will be separated from the wetlands during
construction by a project-limiting fence and staked haybales, and permanently by a 50-foot
non-disturbunce/non-fertilzation buffer to remain natural and undisturbed. The sanitary system will be
located beyond wetland jurisdiction; and the site will be equipped with a drainage system of leaders,
gutters, and drywells to recharge runoff. Therefore, the proposed development of the site will have no
significant adverse impacts on the adjacent freshwater wetlands.

A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coaxtal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable with the L'C, rRP policy
standards and conditions. If an action cannot be certified as consistent with the LWRP policy
standards and conditions, it shall not be undertaken.
