The proposed Local Law entitled, "A Local Law in relation to No Parking areas along Peconic Bay
Boulevard" reads as follows:

A Local Law entitled. "A Local Law in relation to No Parking areas along Peconic Bay
Bonlevard".
BE IT ENACTED by the Town Board of the Town of Southold as follows:
Purpose - Parking associated with tbe Park District beach located along Peconic Bay Boulevard in
Mattituck }las resulted in overfl,)w parking along both sides of Peconic Bay Boule~ ard, as ~ell as
along both sides of the ends of Sigsbee Avenue and Marlene Lane. This parking overllow has resulted
itl a dangerous conditiou, which, impedes the access and maneuverability of emergency x chicles.
Accordingly. it is necessary to limit parking in the immediate vicinity along Pcconic Bay Boulevard to
one side of the street only. and lo prohibit parking at the ends of Sigsbee Road and Marlcne Lane
~x ithin 30 feet of their intersections with Peconic Bay Boulevard.

follows:
§ 92-41. Parking Prohibited at all times.

IV. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law sball be adjudged by any court of
competent jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or
any part thereof other than tile part so decided to be unconstitutional or invalid.
V. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing xxith the Secretary of State as pro~'ided by
laxx.
COUNCILMAN WICKHAM: .)md that is the substance of this proposed local ia~x, it has appeared on
the Town Clerk's bulletin board outside and it has appeared its a legal in the local newspaper.
SUPERVISOR HORTON: Thank you, Councihnan Wickham. And sir, if you would care to address
the Board on this hearing, feel fi'ce to do so.
ED MCGLONE: My name is Ed McGlone, I am the vice-prcsident of tile Marlene Owners
Association. Though I am itl agreement to the no parking, it presents a hardship to the people on
Sigsbee and Marlene itl tile sense that if yon had no parking on both sides and you could give us a pass,
it is stopping us from going to our own beach, the beach that belongs to Marlene Lane and the beach
that belongs to Sigsbee. If you come down with anything on the block, you are not able. to drop it off
or do anything or park your car 1 know that it might be, it is an emergency condition and that is tile
reason, it is dangerons. But we also bare a problem at the other end when the CVS comes in and ~e

have a dangerous condition there. Everything has to exit and enter on Marlene, so you are addressing
the dangerous condition at tile end of the street and uot looking into what we have on 25 as an exit and
entrance for all those trucks and also, restricting us from going out on our own street that we live on.
We will never be able to make a left hand mm there an.whore, we will have to lnake a right hand turn.
No~x we have a problem when we go down the street we will not be able to stop and drop our children
and our equipment offat tile beach. Also, there is, on the new fence lhat you put up, there is, someone
opened it up ....
SUPERVISOR HORTON: Where is the fence, sit'?
]3..IR. MCGLONE: [t is on the l',/[attituck park.
SUPERVISOR HORTON: That wasn't erected by tile Town.
MR. MCGLONE: Yes, it was.
SUPERVISOR HORTON: It was erected by the Mattitnck Park District.
MR. MCGLONE: Oh, okay.
SUPERVISOR HORTON: Of which we don't have regulatory authority.
MR. MCGLONE: I stand corrected. But you might realize that the people are using that to go in to
not pay the $5 parking that you have in the park itselfi Somewhere, if it is not this cornmittee, then
am wasting 3,our time but that is the reason for all tile parking on Peconic Bay and if that was
addressed maybe half of the parking would not be blocking our beach that we xx ant to get to
SUPER\qSOR HORTON: Right.
MR. MCGLONE: [t is a dangerous condition and I am for the no parking but I am also fin' letting the
people that live there, on those immediate streets, to have some kind of way to be able to go down
there and park their car, maybe a sticker or something to that effect.
COUNCILMAN ROMANELL[: Can I ask you a question? Tile beach that belongs 1o tile Marlene
residents, people on Marlene. There really is no parking lot, am I correct?
MR. MCGLONE: You are absolutely correct.
COUNCILMAN ROI\4ANELLI: Your right of way is just that little ~xalkway opposite Marlene that
goes down to the beach. So you don't have parking. Ifa Marlene resident wants to, you lmve to drive
down there and either park on the road or park in the park district parking lot? You do have no parking
lot': You guys have to park on the side of the street when you want to go to tile beach':
MR. MCGLONE: No.

SLPPERVISOR HORTON: We need to figure out, so what I am hearing from you and this local lax*.,
was at tile direct request of residents in your community and I am pleased that you are here to voice
yonr support but also some other aspects to the issue.
MR. MCGLONE: It presents a hardship.
SUPERVISOR HORTON: You are saying that you support this no parking but tile issue is still
ontstanding of how will residents within your association access the beach if they can't park on the
side of the road when they go there?
MR. MCGLONE: Yes. Because you are coming up Marlene with no parking, you are coming up
Sigsbee ~ith no parking. And it is a dangerons condition.
SUPERVISOR HORTON: We can do a couple of things here. We can, after we close this healSng, we
can hold the resolution and not vote on it this evening and have a couple of To;*. n Board members and
maybe even a couple of members from tile Plamfing Staff work with you or we can enact this, if you
think that is the right tiling to do and obviously the Board has to think it is tile right thing to do; we can
enact this and then reach out m~d work with you for an alternate plan to address the concerns you have
voiced.
MR. MCGLONE: Right. With all due respect to tile Board, I have no problem with what you have
got there now, except it you even increased it to no parking on tile olher side it x*.ould be apropos for
anybody to COlne along and stop, and drop and go.
COUNCILM.~N ROMANELLI: The *.xay it is going right now, it is only going to be no parking on
the north side of Peconic Bay Boulevard, so the south side of the Boulevard still parking will be
allowed along the fence going down to Marlene. That is the way tile proposal is. There is only no
parking on the north side.
MR. MCGLONE: Bnt it will only increase the residents on Marlene or Bay coming down, to go to the
prixate beach, will not be able to get to their own beach. And that is my. ....
SUPERVISOR HORTON: Okay.
MR. MCGLONE: It is a problem.
SUPERVISOR HORTON: Right. I think we have got a. we *.*.'ill reach out and work with you on that,
moving forward. Exactly. Work tlu-ough tile To*.vn Clerk's office, to get some suggestions to address
your concerns.
MR. MCGLONE: Not to take any more of your time, if that is a dangerous condition down Ihere ....
SUPERVISOR HORTON: It wasn't in response to a dangerous condition, it was in response to ,.*.,hat
man.,,' residents felt was a nuisance and people parking there when they shouldn't be parking there
throughout tile evening.

MR. MCGLONE: Well, if that is the reason, it doesn't sa3' it. It states dangerous. That ~ts the wording.
SUPER\qSOR HORTON: Right. And the public safety coucern, did rear when emergency vehicles
need to get down there and back to turn around. So xx e can adopt this this evening and then work with
you to address the, perhaps a permit that will be specific to, you kno`.x, an identifying sticker tot'
residents of....
MR. MCGLONE: That would be ~eat if we had some sticker to be able to get there but we are not
going to unless you bare no parking on both sides.
SUPERVISOR HORTON: Councilman Wickham just made the recommendation that a couple of
Town Board members meet with you to speak with you, maybe even get down there and we have two
Mattituck residents here, Dan Ross and Bill Edwards, to get with you...
MR. MCGLONE: Sounds good.
SUPERVISOR HORTON: So Dan Ross `.`.'ill reach out to you within the week to set something up and
address it and talk to you one on one and come tip with a more solid proposal and we will }told this oft'
this evening.
MR. MCGLONE: Thank you.
SUPERVISOR HORTON: Thm~ you, sir.
UNIDENTIFIED: [ think whal his concern might be, with parking only on the south side of the street
that it will actually block access to their beach. I think that is '.,.:hat he was drMng at. So, ~xhat he was
saying `.`.,as if you could have no parking on both sides and then use a permit to gain access to gain
access to the south side. I think that is what he was referring to.
SUPERVISOR HORTON: Right and hopefully, our two Councilmen will be as swift as you were in
picking that tip and work with him. Thanks a lot, Eric. Would anyone else like to address the Board
on this specific hearing? (No response) We will close this heating.
