We have reviewed the narrative supplied with your letter and feel that it is important to point out the location of the project site in relation to the areas discussed. As shown on the location map found in the upper right corner of the work plan, the project site is privately owned land just south and east of Cedar Beach Road. Although located within the outlined area shown on the map attached to your narrative, it is a considerable distance away from the SCCC Marine Science facility, the beach facing Shelter Island Sound on which Least Terns nest, and the marsh found on the west of the beach. Construction of the dock and subsequent usage on a private basis by the owner will have far less impact (if any) than activities of pedestrians and vehicles on the beach itself. In fact, the creek is presently used by several small boats at the present time and also has several docks. The shallow water depths prevent usage of the creek by large boats, and only small, shallow draft craft can operate here. thus, these types of boats do not create excessive wake, noise or pollution from bilge, exhaust or sewage. Based upon this, we do not feel that the project can have any adverse effect upon the marine re- sources of the area. The NYSDEC concurs and we have previously supplied you with a copy of their permit. Therefore, please proceed with processing of this application. Please note that the proposed project is located in both a state designated tidal wetland and a state designated significant coastal fish and wildlife habitat. Accordingly, questions (C)(2)(a) and (C)(2)(c) on the Federal Consistency Assessment Form (FCAF) should have been answered "Yes". Plesse submit a revised form which includes an assessment of the impacts of construction and use of the proposed docking facility on the tidal wetland (coastal policy 44) and the fish and wildlife habitat (policy 7) (a habitat narrative is enclosed to assist you in this assessment).
