The final lift of asphalt or asphalt wearing course has been placed throughout the subdivision in a satisfactory manner. This item would also include the parking areas for the Club House Site Plan. Signage and pavement markings have also been installed and meet the minimum requirements of Town Code. All required landscaping has been completed in a satisfactory manner. The developer is in need of a Certificate of Occupancy for the overall facility. As per Mr. Verity, the building construction is virtually complete. However, Due to the fact that site plan construction has not yet been finished, the Building Department cannot issue a final C.O. In an effort to expedite or offer a solution to his dilemma, the developer has proposed the creation of a bond or letter of credit to guarantee the completion of the project as approved. Since the weather is currently the determining factor related to a timely completion of the project, his offer is not considered an unreasonable request. I have reviewed this matter with Mr. Verityand he has agreed that a temporary C.O. could be issued if a bond was posted. I have reviewed the Cost Schedule dated 1/26/05 supplied by the developer. The incomplete construction items required for conclusion of the project, are, but should not be limited to, the items listed in the estimate as supplied by the developer. The total estimate of $100,000.00 should be more than adequate to cover the costs of all incomplete construction items. At this time, one additional requirement should be considered. Barricades should be placed around all areas of the site where incomplete construction items may be considered hazardous. In addition, temporary signage may be necessary to control site access or indicate an appropriate traffic pattern that would also serve to protect the occupants of the site. BASIS OF APPLICATION: Southold Town Zoning Code Article III, Section 100-31B-7 for golf course, golf dub-house and related golf facilities and amenities, including but not limited to tennis courts and a swimming pool on a site of approximately 160.29 acres. The remaining acreage (62 acres, more or less) is pending subdMsion approval at this Ume with the Town Planning Board. Golf Club-House (principal building). The setbacks of all new buildings meet the required setbacks and locations of the Zoning Code, as shown on the amended Plan dated December 3, 1998, prepared by Young & Young,i L.S. The C-c)lf Club-House and related buildings will be in conformance with all New York State Fire Prevention and Building Codes and rules as to handicap, fire and safety issues. The uSe as a golf course and related fadliUes is reasonable in relation to the District in which it is located, the adjacent use district, and nearby and adjacent residential uses, The special Exception use will be in harmony with the intent and purpose of the Zoning Code. This ~oning use is authorized by the Southold Town Zoning Code subject to Special Exception review and approval by the Board of Appeals. This use will conform to the standards prescribed in the ordinance and in fact is a less intensive use for the property when compared to other allowable uses such as subdividing the entire parcel. This project is pending reviews with the Town Planning Board (and other applicable agencies) under the site plan regulations as to parking, landscaping buffers, drainage, curb cuts, etc. All parking is on this site (not along any side streets or other off-site areas).
