Box 728 Southold, New York 11971 TELEPHONE (516) 765-1892 November 25, 1986 7:00 P.M.- REGULAR MEETING The regular meeting of the Board of Town Trustees was held on November 25, 1986 at the Town Hall, Main Road, Southold. The meeting was called to order by President Henry P. Smith at 7:00 P.M. Present were: President Henry P. Smith Vice President John M. Bredemeyer, III Trustee Phillip J. Goubeaud Trustee Albert Krupski, Jr. Trustee Ellen M. Larsen Bay Constable Kent McCarthy - Clerk Ilene Pfifferling Trustee Smith advised that the date for the December field inspections will be held on December 18, 1986 to depart from Town Hall at 12:00 P.M.. The date for the next regular meeting will be held on December 23, 1986 to commence at 7:00 P.M. Moved by Trustee Bredemeyer seconded by Trustee Krupski it was RESOLVED to APPROVE the minutes of the October 30, 1986 regular Trustee meeting. Vote of Board: Ayes: All This resolution was declared duly adopted. Moved by Trustee Bredemeyer seconded by Trustee Krupski it was RESOLVED to APPROVE the minutes of the April 24, 1986 regular Trustee meeting. Vote of Board: Ayes: Ail This resolution was declared duly adopted. Moved by Trustee Bredemeyer seconded by Trustee Krupski it was RESOLVED to APPROVE the JANUARY 1987 mooring renewals. Vote of Board: Ayes: All This resolution was declared duly adopted. Trustee Smith gave the monthly report as follows: Application fees $60.00, Wetland Applications $300.00, Wetland Inspections $45.00, Dock fees $55.00 and Mooring renewal fees $115.00 for a total of $575.00 collected and turned over to the Supervisor's office to be placed in the General Fund. Public Notices: Trustee Smith reported that there were two public notices which are posted on the Town Clerk's Bulletin Board if anyone wishes to review them. III. Communications: From John Guldi regarding dredging. Trustee Smith advised that he will meet with Mr. Guldi to discuss this matter. Trustee Krupski will also attend this meeting. From John K. Watson a letter in favor of the Frederic Endemann Wetland Application. From Anthony Les~io regarding a Notice of Violation. Attorney Richard Cron appeared before the Board regarding this matter. Trustee Smith advised that the D.E.C. is involved as well as the Army Corps of Engineers,regarding this project, From E. Davies Allan, President, Chesterfield Associates, Inc. regarding the Horowitz property. Trustee Bredemeyer will respond to this communication. From Alexander Koke re~ardin8 his wetland application no. 373. Trustee Bredemeyer reported that he had a conversation with Mr. Koke who indicated that he is looking into the matter as far as building plans and that the letter may be obsolete at this time. From A. Prieto re~ardin~ moorings on Corey Creek, Southold. Trustee Smith advised that the Trustees can continue to issue moorings until it is proved otherwise that this is not a R.O.W. and as long as there is room available for moorings. From Louise Tashjian re~ardin~ a dock application in Cutcho~ue. Moved by Trustee Bredemeyer seconded by Trustee Smith it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality RBview Act in the matter of the application of Louise Tashjian for a wetland permit on certain property located at 4955 Stillwater Avenue, Cutchogue. Vote of Board: Ayes: Trustees Smith, Larsen, Krupski, This resolution was declared duly adopted. From Heather Cusack resardin8 a priority list on road run off. Trustee Smith stated that Heather Cusack has done a remarkable job on this project. Trustee Smith advised that the Trustees are to get together with the Superintendent of Highways, Raymond Jacobs, to try to schedule a meeting within the next couple of weeks to further discuss this matter. From John Wickham advisin~ that he would not be available to meet with the Board to discuss his Notice of Violation as he will be out of Town. 10. Thatcher, Jr. President, Fishers Island Conservancy a Thank 11. you for adopting a resolution to petition the Southold Town Board to under take a study of the Fishers Island Aquifer system and impose Conservation measures restricting the non-potable usage of said water when necessary. John R. Guldi, Division of Waterways for Suffolk County resarding dredsing pro~ects. Trustees Smith and Krupski will meet with Mr. Guldi to discuss this matter. Moved by Trustee Bredemeyer seconded by Trustee Smith it was RESOLVED to RESCIND the resolution declared on the wetland application no. 412 for Nicholas Cutrone denyin~ without prejudice the application to construct a 75' bulkhead with two 8' returns on property located on Ruch Lane, Southold. Vote of Board: Ayes: Trustee Smith, Trustee Krupski, Trustee Bredemeyer Nay: Trustee Larsen, Trustee Goubeaud This resolution was declared duly adopted. NICHOLAS CUTRONE - APPROVAL - APPLICATION NO. 412 Moved by Trustee Bredemeyer seconded by Trustee Smith WHEREAS, John H. Geideman on behalf of Nicholas Cutrone applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated June 6, 1986 , and WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a public hearing was held by the Town Trustees with respect to said application on August 28, 1986 at which time all imterested persons were given an opportunity to be heard, and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the Town, NOW, THEREFORE, BE IT RESOLVED that JOHN H. GEIDEMAN ON BEHALF OF NICHOLAS CUTRONE BE AND HEREBY IS GRANTED PERMISSION UNDER THE PROVISIONS OF THE WETLAND OP, DINANCE OF THE TOWN OF SOUTHOLD TO: construct a 75' bulkhead with two 8' returns on property located on Ruch Lane, Southold. This permit will expire on November 25, 1987 if work has not commenced by said date. There are two inspections required and the Trustees are to be notified upon the completion of the work. Prior to the issuance of said permit by the Clerk, the applicant shall file with the Clerk a certificate that he has public liability £nsurance policies insuring against any liability which may arise in the performance of the operations pursuamt to such permit in such amount as shall be fixed by the Trustees, which said policies shall name the Town as a name insured. Please take further notice that this declaration should not be considered a determination made for any other department or agency which may also have an application pendimg for the same or similar project. RESOLUTIONS: ROBERT RYDER - MOORING - APPROVAL Moved by Trustee Krupski seconded by Trustee Goubeaud it was RESOLVED to APPROVE the offshore moorinm permit for Robert Ryder to place an offshore mooring in Mattituck Creek, Mattituck with the provision that the boat will not impede navigation or interfere with any other boat. Vote of Board: Ayes: Ail This resolution was declared duly adopted. EDWARD BOOTH - MOORING - APPROVAL Moved by Trustee Larsen seconded by Trustee Smith it was resolved RESOLVED to APPROVE the moorinm permit as requested bv Edward Booth with the ~rovision that he contacts the Southold Town Park District to see if they will give him permission for the placement of the boat at the Park District Property. Vote of Board: Ayes: All This resolution was declared duly adopted. RICHARD SIRIANO - TRANSFER OF MOORING No. 539 - Mooring Permit No. 1566 Moved by Trustee Smith seconded by Trustee Goubeaud it was RESOLVED to APPROVE the Transfer of Mooring no. 539 Mooring permit no. 1566 in East Creek to Richard Siriano. Vote of Board: Ayes: All This resolution was declared duly adopted. DR. RICHARD LASKIN - LEAD AGENCY DECLARATION Moved by Trustee Bredemeyer seconded by Trustee Goubeaud it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Dr. Richard Laskin for a Wetland Permit on certain property located at 670 Holbrook Lane, Mattituck. Vote of Board: Ayes: All This resolution was declared duly adopted. JOSEPH SUCHER - LEAD AGENCY DECLARATION Moved by Trustee Goubeaud seconded by Trustee Bredemeyer it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Costello Marine on behalf of Joseph Sucher for a Wetland Permit on certain property located at Dawn Drive, Greenport. Vote of Board: Ayes: Trustees Smith, Bredemeyer, Krupski, Goubeaud Abstained: Trustee Larsen This rasoiution was declared duly adopted. Board of Trustees - November 25, 1986 Page 5. HENRY P. SMITH - REQUEST FOR EXTENSION ON PERMIT Moved by Trustee Krupski seconded by Trustee Goubeaud it was RESOLVED to APPROVE the request made by Henry P. Smith for an extension on permit no. 1609 which was amended on April 24, 1986 for the relocation of two soiles in Town Creek, Southold for a period of six months. Vote of Board: Ayes: Trustees Bredemeyer, Krupski, Goubeaud, Larsen Abstained: Trustee Smith THIS RESOLUTION WAS DECLARED DULY ADOPTED. JOHN C. DILLER - LEAD AGENCY DECLARATION Moved by Trustee Larsen seconded by Trustee Krupski it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of John C. Diller for a Wetland Permit on certain property located on Peconic Bay Blvd., Laurel. Vote of Board: Ayes: Ail THIS RESOLUTION WAS DECLARED DULY ADOPTED. OLAF NELSON - LEAD AGENCY DECLARATION Moved by Trustee Smith seconded by Trustee Goubeaud it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Olaf Nelson for a Wetland Permit on certain property located on Fishers Island. Vote of Board: Ayes: All This resolution was declared duly adopted. HENRY STEFFENS - LEAD AGENCY DECLARATION Moved by Trustee Bredemeyer seconded by Trustee Goubeaud it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Henry Steffens for a Wetland Permit on certain property located on Peconic Bay Blvd., Laurel. Vote of Board: Ayes: Ail This resolution was declared duly adopted. 10. ARTHUR C. ESSLINGER - WAIVER - APPROVAL Moved by Trustee Goubeaud seconded by Trustee Krupski Board of Trustees - November 25, 1986 Page 6. 10. Whereas, the Board has carefully considered all of the documentaion submitted concerning this request, and Whereas, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and Whereas, all construction is behing a bulkhead, Now, Therefore, Be it RESOLVED that Mr. Arthur C. Esslinger Be and Hereby is Granted a Waiver of the Wetland Ordinance for a permit to place an 8' x i0' outbuilding for storage of a boat and garden equipment 25' landward of the existing bulkhead on property located at 1515 Arshamomaque Ave., Southold subject to the followin8 conditions: 1. Care shall be taken so as to preclude the entry of any construction material into adjacent waters. 2. Immediately following construction, all areas of exposed soil shall be properly protected with suitable erosion control devices/ and or vegetated to prevent entry of eroded soil into nearby waters. HOWARD BRUSH - LEAD AGENCY DECLARATION Moved by Trustee Krupski seconded by Trustee Bredemeyer it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Howard Brush for a Wetland Permit on certain property located on Peconic Bay Blvd., Laurel. 11. JOAN VON EIFF - LEAD AGENCY DECLARATION Moved by Trustee Larsen seconded by Trustee Krupski it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Joan Von Eiff for a Wetland Permit on certain property located at 405 Pine Neck Road, Southoid. 12. Vote of Board: Ayes: All This resolution was declared duly adopted. 13. LARRY STAHL BY ARTHUR SIEMERLING - LEAD AGENCY DECLARATION 13. Moved by Trustee Larsen seconded by Trustee Krupski it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Larry Stahl for a Wetland Permit on certain property located at West Road, Cutchogue. NEWMAN Moved by Trustee Smith seconded by Trustee Larsen it was RESOLVED that the Southold Town Trustees Waiver the need of a permit for the demolition of his house on property located on Sailor's Needle Road, Mattituck, and Be it further RESOLVED that the Southold Town Trustees Waiver the need of a Wetland Permit as requested by John J. Newman to reconstruct his residence on property located on Sailor's Needle Road, Mattituck to include the sp±lings and in accordance with the survey by Roderick Van Tuyl, P.C. dated February 25, 1986 and with the provision that if there is any significant run off into the creek the property is to be stabilized with a double row of hay bales. 14. DOUGLAS MORRIS - TABLED Moved by Trustee Smith seconded by Trustee Bredemeyer it was RESOLVED that the Southold Town Trustees TABLE the application of Douglas Morris until an Engineers Study is submitted supporting the need of the groin which would include tidal drift, sand drift, littoral drift. 15. The permit shall be automatically suspended with the suction apparatus in the lower pond dismantled if salinity levels are exceeded, the log is not kept accurately, if the flow meter is broken or if the lower pond is below the benchmark. The Trustees discussed the following matters: Helmut Spitzenbur~er - The Bay Constable reported that there is no violation on property of Helmut Spitzenburger located at 560 Gull Pond Lane, Greenport. Diana Tendler - The Bay Constable issued a Notice of Violation to Diana Tendler, property is located at the foot of 9th Street, Greenport. Carlton Latham - The Bay Constable will investigate this matter. There was a waiver granted for pool construction on property located at Sleepy Hollow Lane, Southold. Arleen Oliver - Part time secretary in the Trustee Office has requested an increase in salary. This request will be referred to the Town Board for review. Fees: Moved by Trustee Smith seconded by Trustee Goubeaud it was RESOLVED to APPROVE the following Trustee fee increases to become effective as of January 1, 1987: Waiver fees from $10.00 to $25.00 Docks, Bulkheads and spiles from $5.00 to $25.00 Mooring Renewals from $5.00 to $10.00 and each year it will go up $5.00 until it reaches $20.00 then it can be reviewed again Dock surface fees from .25 to $1.00 a sq. ft. Dredging from $2.00 a cu. yd. to $5.00 a cu. yd. Bulkheading from $3.00 per lin. ft. to $5.00 per lin. ft. Retaining walls $5.00 per lin. ft. BERT ROKE - Mr. Roke has requested to clear trees landward of the pink building on his property. The Trustees visited the site on several occasions and have discussed the matter with Mr. Roke. Moved by Trustee Goubeaud seconded by Trustee Bredemeyer WHEREAS, due to the presence of increasing shorefront development and WHEREAS, it has been shown that over the past years there has been a steady decline in shellfish harvesting do to an increase in the degradation of surface waters and WHEREAS, it is a known factor that the Intertidal Marsh and High Marsh areas are beneficial to the maintenance of estuarine areas due to the ability to filter out pollutants, NOW, THEREFORE BE IT RESOLVED that the Southold Town Board of Trustees would like to maintain, in accordance with the D.E.C. Regulations, a 50 ft. buffer zone on ail applications both pending and new to be measured from the mean high water mark. Vote of Board: Ayes: All This resolution was declared duly adopted. Trustee Bredemeyer and Trustee Goubeaud indicated that they would tentatively like to attend the Association of Towns Meeting to be held in New York City on February 15 thru the i8th. Carlo DeGaudenzi - The Trustees will make another site inspection regarding this matter on December 18, 1986. A letter is to be forwarded to the Conservation Advisory Council requesting their comments on the "Response to Comments on the draft Environmental Impact Statement" regarding the Thomas W. Cramer wetland application no. 312. Harold Wilsber$ - LEAD AGENCY DECLARATION Moved by Trustee Bredemeyer seconded by Trustee Goubeaud it was RESOLVED that the Southold Town Trustees declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the application of Harold Wilsberg for a Wetland Permit on certain property located Ole Jule Lane, Mattituck. From the Town of Southam?ton an invitation to their celebration of 300 Years of Government. Trustee Bredemeyer advised that he would try to attend along with Trustee Ellen M. Larsen. Trustee Bredemeyer asked if the Trustees would like to send a token gift of some clams? The Trustees were in agreement that the gift should be sent. Trustee Bredemeyer advised that the Andros Patent was signed in 1676, ten years before the Dongan Patent was signed. From James C. McMahon, Administrator of Community Development, a letter from the New York State D.E.C. regarding Waterfront access. Steve Latson appeared before the Board to request that the Town Trustees consider closing Hallock's Bay to shellfishing for the Southold Town Scallop Reseeding Program. Trustee Bredemeyer: Well I thought the direction of the Board, at least what was discussed in the field was that a protected buffer be placed on the application. Trustee Smith: Not to my knowledge? Dr. Samuels: Mr. Haje, of En-Consultants could not be here tonight, and he asked me if I would be here in case there were any questions. There is a deteriorated rock groin 150 ft. on the west property line. There is no intent to reconstruct that groin. The groin is composed of the same type of stone that we are going to use for rock armor. So any of the stone that we uncover, and we are undoubtedly are going to run into it when we drive the steel, will be used as part of the armor. There is not intent to reconstruct that groin. Trustee Goubeaud: No, I have some callf from neighbors east of the property who were concerned with the project. They were wondering if the groin was going to be rejuvenated? Trustee Larsen: If the rock groin is deteriorated, does that mean that the rock armor will deteriorate as well? You said that it deteriorated? Dr. Samuels: Well, by deterioration, whats happened to the rock groin is that its been undermined over the years and the rocks have settled. The purpose of the rock armor in front of th steel bulkhead is exactly just that. That is the desired intent for that rock to settle and armor the town of the steel bulkhead so that any waves that hit the bulkhead would first hit the rock, the rock will absorb the wave action, etc., etc. Sal Caiola-Public Hearing Page 2.
