The regular meeting of the Board of Town Trustees was held on
June 26, 1986 at the Town Hall, Main Road, Southold. The meeting was
called to order by President Henry P. Smith at 7:00 P.M.
Present were:

Trustee Smith advised that the date for the July field inspections will be held
on July 24, 1986 to depart from Town Hall at 1:00 P.M.. The date for the next
regular meeting will be held on July 31, 1986 at 7:00 P.M.
Moved by Trustee Bredemeyer seconded by Trustee Larsen it was
RESOLVED to APPROVE the AUGUST 1986 MOORING RENEWALS.
VOTE OF BOARD: AYES: ALL
THIS RESOLUTION WAS DECLARED DULY ADOPTED.
Trustee Smith gave the monthly report as follows: Application fees $55.00,
Dock and Ramp fees $1740.25, Wetland Application fees $450.00, Wetland Insp.
fees $95.00, Bulkhead and Dredging fees $396.00 and mooring renewal fees $195.00
for a total of $2,931.25 which has been turned over to the Supervisor to be placed
in the general fund.

RESOLVED to APPROVE the minutes of the May 29, 1986 meeting.

Trustee Smith dispensed with the reading of the public notices, but advised
that they are listed on the agenda and posted on the bulletin board if anyone
wishes to review them.

COMMUNICATIONS:
Gene Kessler, Commodore, Gull Pond Yacht Club, regarding bulkhead repair.
Trustee Smith advised that the Trustees had inspected this site during
routine inspections and this structure is in need of repair. A letter will
be transmitted to the Town Board advising them of this situation and also
advising the Waterway Committee that the entrance to Gull Pond should be
added to the dredging list for future dredging.
From Michael J. Hall, Esq. regarding the George Lamborn Wetland Application
no.38~ Justice Raymond W. Edwards appeared before the Board to answer any
questions the Board may have regarding this application.
Ali M. Agarabi, M.D. regarding Matt-A-Mar Marina. Trustee Smith advised that
this is something that is beyond the Trustees control as there was an agreement
made that Matt-A-Mar would not increase their dock space.
4. Willow Point Association by Joseph Magagnin, President requesting an extension
on their permit. See resolution no. 22.
5. Charles deQuillfeldt, Marine Resources Specialist, II regarding the
Skunk Lane bacterial water quality test results.
6. James H. Small, Deep Hole Drive Property Owners Association regarding
Deep Hole Creek, Mattituck.
7. Supervisor Henrietta Acampora regarding New York State Ban on Striped Bass
fishing.
Royal R. Reynolds, P.E., Sr. Public Health Engineer, Wastewater Management
Section, Dept. of Health Services regarding Thomas W. Cramer Wetland Application
no. 312. The following was read into the minutes by Trustee Larsen at the
request of President Henry P. Smith: Dear Mr. Cramer: I am in receipt of your
letter dated April 17, 1986 concerning the above referenced property. This
Dept. routinely accepts the recommendations of reviews by other agencies,
provided these recommendations conform with the Departments minimum
standards. Any variations from these standards would be forwarded to the
Department's Board of Review. In this specific case, waterless toilets
are not covered by existing standards and any proposals for such would be
forwarded to the Board of review. In addition, this is to confirm that a
permit has been issued for the construction of a water supply well on the
above referenced property. The water supply well must conform to standards
for construction and water quality. Any variations from these well standards
would also be forwarded to the Board of Review. If you have any questions

George A. Cottreli, President, C & L Realty request for a waiver of the
Wetland Ordinance for the replacement of cesspool rings on property located
on Main Road, Southold. Trustee Smith: We are requesting a waiver for
our application for the placement of two cesspool rings. One is 10 ft. in
diamiter and one is 8 ft. in diameter. We feel that what we are doing is
repair and upgrading an antiquated pre-existing disposal system. We will be

working directly with the Suffolk County Board of Health to correct and up-
grade any and all problems with this system. Thank you for your consideration.
Sincerely, George A. Cottral, President of C & L Realty, Inc. Trustee Smith
further advised that a complaint was made, and an inspection was made and
it was determined that the work was within the Trustee jurisdiction. Trustee
Smith further advised that they inherited this problem with the cesspools,
when they took over the property. What they are doing now, is a repair, and
to correct a bad situation that exists in the best way they know how. I
feel that if they work with the Board of Health, under their direction and
guidelines and recommendations, I move that the Trustees give a waiver of the
Ordinance.

WHEREAS, George A. Cottral has requested a Waiver of the Wetland Ordinance
Chapter 97, Articel II, Section 97-22, and
WHEREAS, the Trustees have inspected the property in question and the
surrounding area
NOW, THEREFORE, BE IT
RESOLVED, that George A. Cottral BE AND HEREBY IS GRANTED A WAIVER of the
Wetland Ordinance for the installation of a 10' diameter and an 8' diameter
cesspool rings on the premises located on Main Road, Southold with the
provision that Mr. Cottral work with the Health Dept., under their direction
and guidelines and that the area is stabilized after construction to prevent
erosion or run off.

Trustee Krupski Abstained: Trustee Bredemeyer
This resolution was declared duly adopted.
Mr. William Lieblein appeared before the Board and thanked them for working
with them to correct this situation.

Carrig.

Costello Marine Contracting Corporation, John A. Costello, President regarding
a request to amend his original permit to include the construction of a
56' x 12' retaining wall on property located on Dawn Drive, East Marion for
Albert Breneisen.
Trustee Bredemeyer advised that he inspected the site and saw the work in
progress and the area they are requesting is immediately to the west and
continues with the project as it is and runs directly in line with an
existing bulkhead of a neighbor to the west. It is at and above the MHW and
is in keeping with the surrounding area and would move to amend the permit as
requested by the agent on behalf of the applicant. Also, I would like to
note, the applicant, in an attempt to save some of the trees on the site was
unable to run the lower bulkhead the full length and put a return to the upper
bulkhead, to save the trees. I would also request that be an amendment as
well.

Roy L. Haje, President, En-Consultants, Inc. on behalf of Arnold Blair to
amend a wetland permit no. 407 to remove 560 cu. yds. of fill from the filled
in inlet to Midway Pond, and place behind the bulkhead. Property is located
on Midway Road, Southold.
Moved by Trustee Bredemeyer seconded by Trustee Krupski it was
RESOLVED to DENY the request made by Eh-Consultants, Inc. on behalf of
Arnold Blair to amend application no. 407 to reflect the removal of 560
cu. yds. of fill from the inlet to Midway Pond, and to place behind the
bulkhead.
VOTE OF BOARD: AYES: ALL
THIS RESOLUTION WAS DECLARED DULY ADOPTED.
Madeline S. Haas, Secretary, Mattituck Park Commission requesting a waiver
of the Wetland Ordinance to dredge 500 cu. yds. of spoil in Wolf Pit Lake,
Mattituck. Trustee Smith inspected the site and felt that this is a mainten-
ance project. He advised that through the years the pond has been used for
skating, etc. and that they want to clean out the broken tree limbs and
debris which has collected over the years. This will be paid for by the Park
District.
Moved by Trustee Smith seconded by Trustee Krupski it was
RESOLVED to Waiver the need of a permit for the Mattituck Park Commission to
dredse 500 cu.yds, in Wolf Pit Lake, Mattituck with the provision that dredging is
done to a maximum of 3 ft. and the spoil is to be trucked to an approved upland
site and that the frinse marsh around the pond is not to be disturbed.

requesting a waiver of the Wetland Ordinance for the construction of a covered
deck on property located on Sailor's Needle Road, Mattituck.

WHEREAS, the Board members have personally viewed and are familiar with
the premises in question and the surrounding area, and
WHEREAS, the Board has considered all the documentation submitted concerning
this request, and
WHEREAS, the Board made the following findings of fact:
1. By this request, appellant request permission to construct a covered
deck as proposed on the map of property for John J. Newman at Mattituck,
New York revised May 8, 1986, and
2. The property in question is known as Parcel No. 1000-144-5-30 on the Suffolk
County Tax Map or more commonly known as Sailors Needle Road, Mattituck.
NOW, THEREFORE, BE IT
RESOLVED that Daniel C. Ross on behalf of John J. Newman be and hereby is
Granted a Waiver of the Wetland Ordinance as requested for the construction of

RESOLVED to APPROVE the request made by Abigail A. Wickham on behalf of
Sue Hanauer and Joan Bagley for an extension on Wetland Permit No. 292
for a period of six months. Said permit will expire on January 11, 1987.

for the placement of scallom structures in M~ttituck.

Mark LaRosa request for a WAIVER of the Wetland Ordinance for the construction of a
,16'x 21' x 12' structure on an existing residence located on Albo Drive,
Mattituck.
WHEREAS, THE Board members have personally viewed and are familiar with
the premises in question and the surrounding area, and
WHEREAS, the Board has considered all the documentation submitted
concerning this request, and
WHEREAS, the Board made the following findings of fact.
1. By this request appellant requests permission to construct a
16' x 21' x 12' addition to an existing dwelling as proposed on the map
of property surveyed for Mark & Lorraine LaRosa situated at Laurel,
Dated August 31, 1983, and
2. The property is known on the Suffolk County Tax Map as Dist. 1000,
Section 126, Block 2, Parcel 12, or more particularly known as
Albo Drive
Accordingly, on motion made by Trusteee Bredemeyer seconded by Trustee
Krupski it was
RESOLVED that Mark LaRosa be and hereby is granted a Waiver of the Wetland
Ordinance as requested for the addition to an existing dwelling on property
located on Albo Drive, Laurel, subject to the following provisions:
1. Care shouldbe taken so as to preclude the entry of any construction
material into the wetland area.
2. Immediately following construction, all areas of exposed soil shall be
protected with suitable erosion control devices and/or vegetated.

18. James H. Redman, Marine Resources Specialist, III regarding the National
Shellfish Sanitation Program Manual of Operations.
Trustee Bredemeyer advised that there is a form that any involved agency or
concerned individual can submit issues for consideration to the National
Shellfish Sanitation Coference. Trustee Bredemeyer continued to advise that
the Conference is held annually, and advised that group promulgates the rules
that we live with as far as creek closures.
19. Referral from Assemblyman Joseph Sawicki, Jr. regarding the Richmond Creek
Farms Application.
20. Ruth Emerson Cooke regarding property located on South Harbor Road, Southold.
Copy of her letter with survey will be forwarded to the Town Attorney to
review and draw up the necessary paperwork for same.
The Board recessed the regular meeting to hold the following Public Hearings

RESOLVED that the Southold Town Trustees declare itself lead agency in
regard to the State Environmental Quality Review Act in the matter of
the application of En-Consultants, Inc. on behalf of Arnold Blair for
a Wetland Permit on certain property located on Midway Road, Southold.

Moved by Trustee Bredemeyer seconded by Trustee Krupski it was
RESOLVED to APPROVE the request for Patrick E. Lyons to place an
offshore stake with pulley line to onshore stake in Narrow River, Orient
using public property as access. Placement is to be at the extreme northern
end of the ramp.

19. BERT ROKE - AMENDMENT TO APPLICATION
Moved by Trustee Bredemeyer seconded by Trustee Larsen it was
RESOLVED to amend the configuration of the dock as requested by the
Land Use Company on behalf of Bert Roke to reflect a straight configuration
rather then the "T" configuration proposed, with the provision that if there
is a problem with interference or with navigation that the dock will have
to be reconstructed to the "T" configuration proposed.

There was a discussion held regarding road run off. The Trustees would like
to meet with the Town Board at a work session to discuss the severity of this
situation.
Trustee Larsen reported that funds were going to be cut out of the budget
from Cooperative Extension for Sea Grant. Trustee Larsen advised that Cooperative
Extension would stay afloat somewhat, but Sea Grant, if this bill is not passed'
will probably go under.

RESOLVED that a letter is to be sent to Congressman William Carney, State Senator
Alfonse D'Amato and Senator Daniel Patrick Moynihan in support of the bill for

The Trustees discussed their fee schedule. The Trustees decided to raise the
Trustee application to $10.00 verses the $5.00 fee that is now charged.
There will be a $10.00 fee charged for Special Purposes (Waivors, Determinations
on the need of any permits, as an on site inspection has to be conducted prior
to a determination).
In regard to the Wetland Applications the Clerk will have to check on the
~ossibility of raising this fee, as it may require a Local Law by the Town
oard regarding this matter.

Mike Mooney, North Fork Marine: I'm the contractor for the job. The problem is
there is he wants to retain the old wall, except where it is bowed out.
Add strength, per se, thinking once that once buried in sand, the old wall
won't~ deteriorate any more. And it will give it more strength, as it does
take a beating there. He would like to retain that, he wants us to move
the concrete out of the way, put the concrete back in front of the wall when
the wall is built. It is a high energy area, even on a southwest breeze in the
summer time. We would prefer and have it built 18" in front. Ail of those walls
in that area are shot, they will all have to be done. So he is not looking at
anything that they will not be doing in the next couple of years. It will not
have a scouring effect. Now it is running out, because he needs to have it
done.
Trustee Larsen: I have no problem with this. It is open bay and not encroaching
on Trustee Land, and it is keeping in place with what is there.
Trustee Krupski: How does he stand with the adjacent neighbors there?
Mike Mooney: All the neighbors tie in straight across there. They are all
pretty well shot in that area. When he called us up, there were neighbors
with pick up trucks trying to pull the bulkhead back up. If we go 18" in
front, we are going to put sand in there, there is clay there now, and the
sand will help the drainage.
Trustee Smith: If there are no other comments, (no comments) I will close this

Trustee Smith: Are there any comments on this application for or against?
Mr. John Costello: There is an existing bulkhead on this canal. Mr. Sucher is
an elderly-gentlemen that has a small boat. His wife is slightly handicapped,
she limps quite a bit, I believe she is in her eighty's. We would like to
put a float in along side of the bulkhead. Every attempt is going to be made
not to infringe upon navigation. So that they can get down to get to their boat.
Trustee Smith: This is in line with the neighbor has now?
Mr. Costello: Yes, it is. It is directly along side of the bulkhead. The
existing bulkhead is about 7 ft. out at low tide now.
Trustee Smith: Does anyone have anything to say on this application. No comment.

Trustee Smith: In the matter of the application of J. H. Geideman on behalf
of Helmut Spitzenburger to construct a 143' bulkhead, 38' x 16'
patio and dredge (70 Cu. Yds.) and to place behind the bulkhead. Property
is located on Gull Pond Lane, Greeport. Are there any comments?
Jean Marriner: The C.A.C. recommends that this application be denied. This
project has been completed. Council recommends that a fine be imposed or that
the applicant be required that the structure be moved back. The action should
have some type of punishment as it se~ a precedent for fast land.
Trustee Smith: Is there any one else who has anything to say?
John Costello: I was wondering if the Board will send me a copy of the
application? I happen to be a principal and an adjoining property owner
to this project. I did not know that it was being done. I was never
notified by any agency. I believe that the dredging was done on my property.
This obligation, I will look into this. I believe I should have been notified.
I am not sure where the bulkhead is in relation to the property line. I would
be curious to find out if the bulkhead was put on my property or theirs.
Trustee Smith: I believe that if he got a D.E.C. permit, and I am not sure
if he has, he would have to notify by registered mail, the adjoining property'
owners, of this application.
Trustee Krupski: On the application it says that he has DEC approval.
Mr. Costello: The D.E.C. doesn't notify you.
Trustee Smith: The applicant does.
Mr. Costello: No it is suppose to be published or the ARmy Core has jurisdiction
writing a letter saying that there is an application in effect and asking if
there are any comments or objection.
Trustee Smith: I know that when I had mine, I had to notify everyone and his
brother.
Mr. Costello: If I could I would appreciate a copy of this application. I don't
think that you should make a decision, possibly I could object.

Trustee Smith: WOuld you see that John Costello of Costello Marine gets a
copy of this application.
Mr. Costello: I think that it should be required and I don't know if it would
be by my attorney or the Town's proving that this is on his property. That the
dredging is taken place on his property. I'm sure that he is not allowing
me to dredge any one elses property.
Mr. Spitzenburger: My name is Spitzenburger, and this is in regard to my
property. I am here for any questions. I have an original permit in 1981
from the Army Corp of Engineers and from the DEC. I didn't commence the
project without the permit from the ARmy. I was unaware that I needed a permit
from the Town, so I did not apply, In 1981 as far as I knew I did not need a
permit from the Town. Subsequently I was fined and I paid a fine and I ask
the Board to approve the application.
Trustee Smith: Do you have D.E.C. Permits that are current.
And Army Corp?
Mr. Spitzenburger: Yes, I do. They have been extended.
Trustee Larsen: This man has been fined. These bulkheads have been put in
in line.
Trustee Smith: The bulkhead has been put in in line with the neighbors,
All of the Trustees looked at this project. We thought it was a good project.
Mr. Costello: I don't object to the project. I would like to know where his
property ends. I would have liked to have been notified. I own the bottom of
the canal. I think that the people should be able to use the bottom.
Trustee Bredemeyer: This Board does not give notification to the adjacent owneres.
ARe you chiding us into this responsibility of looking into this as the re-
sponsibility of the Board?
Mr. Costello: You don't give someone permission to put something on someone
elses property?
Trustee Krupski: We have the application with the survey. We went down there
and looked at the property, it looks like a good project.
