The regular meeting of the Board of Town Trustees was
on :4ay 29, 1986 at the Town Hall, Main Road, Southold.
President Smith opened the meeting at 7:00 P.M.

Trustee Smith advised that field inspections will be held on June 19th
departing from Town Hall, Southold at 1:00 P.M. and that the next
regular meeting of the Board will be held on June 26, 1986 at 7:00 P.M.
Trustee Smith: May I have a motion to approve the July 1986
mooring renewals?
The Board discussed the mooring renewals. Seeing that there has been a
number of applications for permits in the Hallocks Bay area and other
creeks in the Town, it was determined that there is a letter to go
out with the mooring renewal permits advising that if off/on shore
stakes are not being utilized that they will not be renewed in the
future so that someone else may utilize that location.
Moved by Trustee Bredemeyer seconded by Trustee Krupski it was
RESOLVED that the July mooring renewals be and hereby are approved
subject to a letter being sent out with the renewals advising that
if there is a pattern of nonuse that their permit will not be renewed.
Vote of Board: Ayes: All
This resolution was declared duly adopted.
Trustee Smith gave the monthly report as follows.for April 1986:
Application fees $30.00, Wetland Application fees $700.00, Wetland
Inspection Fees $30.00, Bulkhead and Dredging ~ees $1,041.00 and
Mooring Renewal Fees $185.00 for a total amount of $1,986.00

Trustee Smith: The public notices on this agenda are posted on
the Town Clerk's Bulletin Board if anyone wishes to review them.
The next item on our agenda is our communications:
1. From Gregory J. Blass, Presiding Officer of the Suffolk County
Legislature regarding Deep Hole Creek, Mattituck.
Trustee Smith: Are there any comments on this communication?
Trustee Larsen: It seems that there is a R.O.W. which is owned by
an association in that area which the Trustees looked at. The
Trustees doubt that this Association would be willing to give up
this R.O.W.?
Trustee Bredemeyer: I would recommend that a letter is forwarded
to Mr. Gregory Blass since he has repeatedly gone to bat for the
Town to get this creek open.
Trustee Goubeaud: From discussion I had with an individual,
believe that this property is owned by Mr. Parker Wickham.
Trustee Smith: Former Trustee Krank Kujawski had looked into this
matter and the price of the property was very high. So there was
nothing else available at this time.
Trustee Smith: It is the County's job to maintain the mouth of the
creeks.
Trustee Goubeaud: We have a responsibility to the Community.
Trustee Smith: Yes, I agree we have a responsibility to the
Community, but we have no money.
Trustee Goubeaud: What about closing the creek to navigation? We
can't allow it to be open because of shoaling. I suggest that we
request the Bay Constable to post Deep Hole Creek advising that
it is closed to navigation due to shoaling.
Moved by Trustee Goubeaud seconded by Trustee Bredemeyer it was
RESOLVED to forward a letter to the Bay Constable, Gregory Blass,
Suffolk County Legislature, Third Coast Guard District, Dr. L. Koppelman
and Mr. John Guldi advising that Deep Hole Creek, Mattituck is closed
to navigation until such time as this problem is mitigated, subject
to checking with the Town Attorney.

The Board continued to discuss this matter and it was the consensus
of the Board that this action would protect the town from any liability.

From Vera Wilson and Others a communication on the Richard
Cantwell application. The Trustees have requested more
information on this matter, and we have not received it as
yet.
3. From Frank Heroy regarding the Bay Avenue, East Marion trenching,
which I believe is done now.
4. From Frank Heroy regarding the Bay Avenue, East Marion trenching,
again.
From Costello Marine Contracting Corp. a D.E.C. permit for Joseph
Sucher for our information.
From Fay V. Small regarding Deep Hole Creek again. Mrs. Small
was inquiring about the environmental aspects of the shoaling
of the creek.
From Trustee Ellen M. Larsen communication regarding the
Albert Koke Application. Trustee Larsen requested that this
communication be tabled until all of the information is submitted
on the project as requested by the Trustees.
8. From Vera Wilson regarding the Richard Cantwell application.
9. From Charles T. Hamilton, D.E.C. a copy of the D.E.C. permit
for Alexander Koke.
10. From Charles deQuillfeldt, Marine Resources Specialist, II,
N.Y.S., D.E.C. regarding Spat Collectors. Trustee Bredemeyer
advised that the D.E.C. was hopefull to monitor "spat collectors"
in several areas of the Peconics in 1986 to determine whether there is
a scallop "set" during the spawning season. Trustee Bredemeyer
advised that with the brown alge bloom commencing to the west of us,
it will be seen what will happen.
11. From Gregory J. Blass, Presiding Officer, Suffolk County Legislature
regarding Deep Hole Creek,
12. From the Southold Town Baymen's Association regarding the
Alexander Koke Application to be placed in the file.
13. From the Land Use Company a request to delete the dock portion of
the application for Mr. Leonard $chlegal.

RESOLVED to Approve the request to delete the dock portion of the
Wetland Application for Leonard ~chlegal.

so will will continue on with our Resolutions.

RESOLVED that the application for BETTY B. DAWSON for an offshore
mooring in Wickham Creek is APPROVED, with the provision that the
boat will not swing into the channel or interfere with any other
boat.

mooring in Deep Hole Creek is APPROVED, with the provision that the
boat will not swing into the channel or interfere with any other
boat.

Moved by Trustee Smith seconded by Trustee Bredemeyer it was
RESOLVED that the application for STEVE LATSON for an offshore
mooring in Town Creek, Southold is APPROVED, with the provision that
the boat will not swing into the channel or interfere with any other
boat.

4. MICHAEL E. SHEEHAN - MOORING APPROVAL
Moved by Trustee Goubeaud seconded by Trustee Bredemeyer it was
RESOLVED that the application for MICHAEL E. SHEEHAN for an offshore
mooring in Town Creek is APPROVED. with the provision that the
boat will not swing into the channel or interfere with any other
boat, and subject to contacting the Bay Constable for placement of the
mooring.

5. PAUL L. LIBASSI - MOORING APPROVAL
Moved by Trustee Goubeaud seconded by Trustee Bredemeyer it was
RESOLVED that the application for PAUL L. LIBASSI for an offshore
mooring in Little Creek, Cutchogue is APPROVED with the provision
that the boat will not swing into the channel or interfere with any
ther boat.

6. SUFFOLK COUNTY DREDGING OF JAMES CREEK
Moved by Trustee Krupski seconded by Trustee Goubeaud
WHEREAS, the Town of Southold has requested the County of
Suffolk to Dredge a navigation channel in James Creek, Town
of Southold, as designated on accompaying maps; and
WHEREAS, the County of Suffolk proposes to do said dredging;
and
WHEREAS, the Supervisor of the Town of Southold by resolution
duly adopted by the Town Board of said Town of Southold has
been authorized and directed to sign for a~on behalf of the
Town of Southold assurances to the County of Suffolk, that the
Said Town of Southold will preform all acts required to be
performed by said Town in connection with the preparation of
dredging operation as aforesaid and obtaining of all necessary
easements and rights-of-way for said dredging operation and use of
areas indicated on the attached map for spoil areas together with
all necessary rights incidental to said dredging operation;
NOW~ THEREFORE, in consideration of the benefits to the Town
of Southold, as aforesaid, the Town of Southold Town Trustees
hereby WAIVER the need of a Wetland Permit for the performance
of this project.

Moved by Trustee Larsen seconded by Trustee Bredemeyer it was
RESOLVED that the Southold Town Trustees declare itself lead
Agency in regard to the State Environmental Quality Review Act
in the matter of the application of Mathias Mone for a Wetland
Permit on certain property located on Grandview Drive, Orient.

8. VERNON G. STRUB - LEAD AGENCY DECLARATION
Moved by Trustee Larsen seconded by Trustee Bredemeyer it was
RESOLVED that the Southold Town Trustees declare itself lead
Agency in regard to the State Environmental Quality Review Act
in the matter of the application of Vernon G. Strub as submitted
by the Land Use Company for a Wetland Permit on certain property
located on Park Avenue, Mattituck.

RESOLVED that the Southold Town Trustees declare itself lead agency in
regard to the State Environmental Quality Review Act in the matter of
the application of the Land Use Company on behalf of Frank R. Reilly for
a Wetland Permit on certain property located on East Side Avenue, Mattituck.

10. ROGER VORCE - LEAD AGENCY DECLARATION
Moved by Trustee Larsen seconded by Trustee Bredemeyer it was
RESOLVED that the Southold Town Trustees declare itself lead agency in
regard to the State Environmental Quality Review Act in the matter of
the application of En-Consultants, Inc. on behalf of Roger Vorce for a
Wetland Permit on certain property located on a R.O.W. off of Bridge
Lane, Cutchogue.

11. FREDERICK KOEHLER - LEAD AGENCY DECLARATION
Moved by Trustee Larsen seconded by Trustee Bredemeyer it was
RESOLVED that the Southold Town Trustees declare itself lead agency in
regard to the State Environmental Quality Review Act in the matter of
the application of Henry E. Raynor, Jr.on behalf of Frederick Koehler for
a Wetland Permit on certain property located on Old Harbor Road, New Suffolk.

12. JOSEPH MARRAPODI - LEAD AGENCY DECLARATION

RESOLVED that the Southold Town Trustees declare itself lead agency in

the application of Joseph Marrapodi for a Wetland Permit on certain property
located on 4i15 Stillwater Avenue, Cutchogue.

the application of Eh-Consultants, Inc. on behalf of Sal Caiola for a Wetland
Permit on certain property located on Sound Drive, Greenport.

16. DIMITRIOS J. SARIYIANNIS - LEAD AGENCY DECLARATION
Moved by Trustee Larsen seconded by Trustee Bredemeyer it was
RESOLVED that the Southold Town Trustees declare itself lead agency in
regard to the State Environmental Quality Review Act in the matter of
the application of Dimitrios J.Sariyiannis for a Wetland Permit on certain
property located on Kerwin Blvd. and Bay Shore Road, Greenport.

17. BERT ROKE - AMENDMENT TO APPLICATION
Moved by Trustee Larsen seconded by Trustee Smith it was
RESOLVED that the request made by the Land Use Company on behalf of Bert
Roke to amend his wetland application no. 377 to reflect a 20' x 4' fixed
dock, a 15' x 3' ramp and a 20' x 6' float on property located at 2955
Wells Avenue, Southold be and hereby is AM~ENDED.

18. GERALD RUPP - LEAD AGENCY DECLARATION
Moved by Trustee Bredemeyer seconded by Trustee Larsen it was
RESOLVED that the Southold Town Trustees declare itself lead agency in
regard to the State Environmental Quality Review Act in the matter of
the application of Greenport Dock Builders on behalf of Gerald Rupp for
a Wetland Permit on certain property located on Soundview Avenue, Southold.

Moved by Trustee Goubeaud seconded by Trusee Krupski
WHEREAS, the Board members have personally viewed and are familiar with
the premises in question and the surrounding area, and
WHEREAS, the Board has considered ali the documentation submitted concerning
this request; and
WHEREAS, the Board made the following findings of fact:
1. By this request appellant request a Waiver of the Wetland Ordinance
all in accordance with Chapter 97, Section 97-22 from the Code of
the Town of Southodl to make improvements on an existing single family
residence on propety located on 700 Koke Drive, Southold, New York.
2. The property in question is on the Map of Property surveyed for
Marjorie D. Petras at Southold or more particularly known on the
Suffolk County Tax Map Designation as: Dist. 1000, Section 087,
Block 05, Lot 006.
In considering this request, the Board finds and determines:
1. The project as proposed will not adversely affect the Wetlands of
the Town.
2. The project as proposed will not adversely affect the health, safety
and general welfare of the people of the town.
NOW, THEREFORE, BE IT
RESOLVED THAT PATRICIA D. PETRAS be and hereby granted a WAIVER of the
Wetland Ordinance of the Town of Southol for the improvements to an existing
residence on property located at 700 Koke Drive, Southold, subject to the
following provisions:
1. Roof run off shall be discharged into dry wells.
2. Care should be taken so as to preclude the entry of any construction
material into the water. Hay bales should be placed along the bulkhead.
3. Immediately following construction, ali areas of exposed soil should
be properly protected with suitable erosion control devices and/or
vegetated to prevent entry of eroded soil into the nearby waters.

20. SUSAN AND WALTER GREEN - AMENDMENT TO MOORING PERMIT
Moved by Trustee Krupski seconded by Trustee Larsen it was
RESOLVED to APPROVE the request made by Susan and Walter Green to amend
their original mooring permit no. 2096 mooring no. 676 to reflect an additional
mushroom mooring on the aft of the boat, in Jockey Creek, Southold.

21. STEPHEN SHILOTITZ - WAIVER
Moved by Trustee Larsen seconded by Trusee Krupski
WHEREAS, Stephen Shilowitz applied to the Southold Town Board for a change
of Zone, and
WHEREAS, Stephen Shilowitz applied to the Town Trustees for approval for
the construction of a bulkhead and dredging prior to the amending of the
Wetland Ordinance, and
WHEREAS, the Board Members are familiar with the premises in question and
the surrounding area; and
WHEREAS, the Board has considered all the documentation submitted concerning
this request; and
WHEREAS, the Board has made the following findings of fact:
By this request, appellant requests a Waiver of the Wetland Ordinance
Chapter 97, Article II, Section 97-22 for the construction of Condominiums
on §th Street, Greenport,
The property in question is located at the Southerly end of Sixth
Street, Greenport, New York as designated on the Suffolk County Tax
Map or more particularly identified as, District No. 1001, Section
007, Block 01, Lot 16.
In considering this request, the Board finds and determines:
The project as proposed will not adversely affect the wetlands of
the Town.
The project as proposed will not adversely affect the health, safety
and general welfare of the people of the Town.
NOW, THEREFORE, BE IT
RESOLVED that STEPHEN SHILOWITZ BE AND HEREBY GRANTED A WAIVER of the
Wetland Ordinance of the Town of Southold ali in accordance with the plans
and specifications submitted, SUBJECT TO THE FOLLOWING PROVISIONS:

Blacktop shall not be used on this site.

RESOLVED to APPROVE the mooring application submitted by DANA FOX
of Westphalia Road, Mattituck to place an onshore stake, using private
access, in Mattitu~k Creek.

RESOLVED to APPROVE the mooring application submitted by GINNY BORN
to place an offshore stake in Dam Pond, East Marion, using private
access.

BETTY & GERALD WELLS - WAIVER
Moved by Trustee Goabeaud seconded by Trustee Krupski
WHEREAS, Frank A. Kujawski, Jr., c/o A. Reilly & Sons, Contractor
on behalf of BETTY & GERALD WELLS applied to the Southold Town
Trustees for relief of the Wetland Ordinance~ Chapter 97, Article II,
Section 97-22 for the construction of a swimming pool and to grade and
plant, and
WHEREAS, the Board members have personally viewed and are familiar with
the premises in question and the surrounding area; and
W]~EREAS, the Board has considered all the documentation submitted concerning
this request; and
WHEREAS, the Board has made the following findings of fact;
i. By this request appellant requests a WAIVER of the Wetland Ordinance
Chapter 97, Article II, Section 97-22 to construct a swimming pool
and to regrade and plant, and
2. The property in question is identified on a Map of Property located
and surveyed for BETTY & GERALD WELLS at Cutchogue, New York, and
more particularly identified on the Suffolk County Tax Map as: 1000-138-5.
IN VIEW OF THE FOREGOING INFORMATION
NOW, THEREFORE BE IT
RESOLVED that FRANK A. KUJAWSKI, JR. c/o A. REILLY & SONS, CONTRACTOR
ON BEHALF OF BETTY & GERALD WILLS BE AND HEREBY ARE GRANTED A WAIVER OF
THE WETLAND ORDINANCE for the construction of a pool and to grade and
plant on property located on Monsell Lane, Cutchogue, New York subject
to the foiiowing provisions:
1. During excavation the fill must be contained so that it does not wash
into the creek.
2. There shall be no discharge from the pool into the Wetlands or creek.
3. During construction, the Wetland fringe shall be suitably lined with
hay bales to prevent construction material from entering the Wetland
area.

shall be properly protected with suitable erosion control devices
and/or vegetated to prevent entry of soil into the nearby waters.

RUTH ZEIDLER - WAIVER
Moved by Trustee Krupski seconded by trustee Bredemeyer
WHEREAS, the Board members have personally viewed and are familiar with
the premises in question and the surrounding area; and
WHEREAS, the Board has considered all the documentation submitted
concerning this request; and
WHEREAS, the Board made the following findings of fact:
1. By this request, appellant requests a Waiver of the Wetland Ordinance
Chapter 97, Article II, Section 97-22 for the construction of an
inground 16' x 32' pool and a 6' deck around same.
2. The property in question is located at 100 McDONALDS CROSSING,
LAUREL, NEW YORK and more particularly known on the Suffolk Tax Map
as 1000, Section 145, Block 04, Lot 015.
IN VIEW OF THE FOREGOING AND IN CONSIDERATION OF THIS REQUEST THE BOARD
FINDS AND DETERMINES:
1. That the project will not adversely affect the wetlands of the Town.
2. That the project will not adversely affect the health, safety and
general welfare of the people of the Town,
NOW, THEREFORE, BE IT
RESOLVED that RUTH ZEIDLER BE AND HEREBY IS GRANTED A WAIVER OF THE WETLAND
ORDINANCE OF THE TOWN OF SOUTHOLD FOR THE CONSTRUCTION OF a 16' x 32'
INGROUND POOL AND A C" DECK AROUND SAME WITH THE FOLLOWING PROVISIONS:

1. During construction the fill must be contained so that it does not
wash into the creek. Placement of hay bales would be recommended
during construction.
2. Ail discharge from the pool is to be piped away from the creek or
bay.
3. Immediately following construction all areas of exposed soil should
be suitably vegetated.

FREDERICK KOEHLER - DETEP~INATION
The Trustees conducted an on site inspection of the premises located on
Old Harbor Road, New Suffolk, and it was determined that the project
as proposed is an ordinary repair to the existing structure (195 lin.
ft. bulkhead) and no permit is required all in accordance with Chapter
97, Article I, Section 97-12, (5).

27. ROBERT TROCCCOLI - WAIVER
Moved by Trustee Smith seconded by Trustee Bredemeyer
WHEREAS, ROBERT TROCCOLI has requested a WAIVER of the Wetland Ordinance
Chapter 97, Article II, Section 97-22, and
WHEREAS, a permit has been issued under the name of Roger DeMott for a
dock on property located on Jockey Creek Drive, Southold, and
WHEREAS, ROBERT TROCCOKI HAS PURCHASED THE PROPERTY IN QUESTION AND
WISHES TO RECONSTRUCT A DOCK ON SAID PROPERTY to consist of a 5' x 15'

63. GEORGE HESSE GRANDFATHER APPLICATION

RESOLVED to TALBE the application of GEORGE HESSE until the
Board conducts an on site inspection of this property.

The Board discussed the Coastal Erosion Maps that the Building Dept.
had requested the Trustees to review for their recommendation to the
Town Board. It wasthe consensus of the Board to recommend to the Town
Board that this matter be dealt on a case by case basis. Trustee Smith
advised that the problems on the North Fork are unique and we can not
be compared with the Great Lakes or the Atlantic Ocean.
The Board inspected the property owned by the Laughing Water's Property
Owners Association. They had requested a determination on the need of a
Wetland Permit for the placement of sand on their beach area. The Board
determined that no permit is required, this work would be a maintenance
project. A letter is to be sent to Mr. Royal Gifford, President of the
Laughing Water's Association to advise of this determination.
In the matter of Yan Rieger, 15 Harbor Road, Orient, the Board conducted
an on site inspection of the subject property to ascertain if a We~land
Permit would be required for the repair to an existing deck on the.property.
The Board determined that this work is an ordinary repair to the existing
structure and no permit is required from the Board. The Trustees advised
that a letter is to be sent to Mr. Rieger advising same, and that it should
be further advised that if Mr. Rieger wishes to construct a retaining wall,
a permit will be required for that construction.
Trustee Krupski started to discuss the aige bloom. Trustee Bredemeyer reported
that there were counts of one million and a half as of May 29, 1986, in
Flanders Bay. West Creek, Shelter Island had a bloom that had the highest
count, over a million and one-half. Sterling Harbor had a different bloom,
not the Brown tide organism. That bloom was entirely different.

RESOLVED to recommend to the Town Board that the Trustees are in support
of the study of point and non-point sources of pollution.
