There were present: Messrs: Robert ~ Gillispie, Jr., Chairman; Robert Bergen; Charles Grigonis, Jr.; Fred Hulse, Jr~ Also present: Mr, Howard Terry~ Building inspector~ Absent: ~r. Serge Doyen, Jro 7:30 PoM~ - Decision in co~ection with Appeal No. 1757, Charles 0. and Florence Ac Ziegler, 1600 Bay Avenue, East Marion, New York~ THE C~&~RMAN: The decision on this appeal was postponed from M~y 10th to tonight. I have consulted with the To%~ Attorney with r~ference to what this Board may or may not do in this decision. The investigation of the Board indicates that the premises were laid out according to a plan approved by the Building Department in 1959-60~ The applicants now wish to divide the property in order to sell individual parcels. The reason for dividing it is that they are not able to sell as a single unit. It is non-oonformingunder the present up-dated zoning regulations so the applicant needs some relief particularly as to the size of building lots, ~ud the general method of division of the property. Southold Town Board of Appeals -2- May 24, 1973 The applicants have furnished us with a survey indicating that the main residence fronts on Bay Avenue; to the south is a one story frame duplex (two units - 32' x 24'). There is also a duplex on the most westerly part of the property, which is 24' x 45'S the duplex on the most northerly part of the property is 24' x 48' and is fairly close to the duplex on the westerly part of the property. As I understand it, the proposal is to divide this property so that none of these lots will be less than 12,500 sq. ft. in size, which was the minimum lot size in use at the time you got your "M" zoning here, when zoning started. This Action will be subject to obtaining a survey from you, which will divide this property in a manner which will yield 12,500 sq. ft. per lot so that you will have four lots, all of which will be at least 12,500 sq. ft. (Mr. and Mrs. Ziegler discussed the Map with the Board). MR. C~RLES 0. ZIEGLER: We have found the original surveying points. THE CHAIRMAN: We would want to give as much clearance to each of these houses as possible. MR. ZIEGLER: We have enough property in back to add to this if necessary. THE CMAIRMAN: Fence lines are irrelevant. We want 12,500 sq. ft. in each lot that you sell. You want to sell each one of these separately? MR. ZIEGLER: Yes. TH~ CtIAIRMAN: Where are the cesspools? MR. ZIEGLER: There is only one. The Board of Health said to put in a 26' x 20' unit. MRS. ZIEGLER: I don't think there would be any problem in dividing it because the Southold Bank holds both mortgages. We Just developed part when we first built and then a few years later we developed the other part. There ~s an existing driveway there now. THE CHAIRMAN: You said something about enlarging one of these lots. How would you do it? MRS. ZIEGLER: We could do it because the mortgage has been reduced. We have a very small mortgage on this section. I don't think the bank would have any objections. The mortgage to start with was $16,000 and it has been reduced to about $10,000 or $11,000 so even if we had to cut it off here (referring to map), there is still more than sufficient property here. ZIEGLER: They are fully insulated and heated~ MRo BERGEN: ~e can't allow you to sell in individual parcels ~nd expect ohs person to buy and live in half of it~ They should be made into minimmu~house sizes~ MRS. ZIEGL. ER: Houses in existence are sold as individual homes that are not 850 sq, ft, THE CF~iRMAN: They have less than 50~ of the fleer area~ L~SqS, ZIEGLER: How can we control wh~t people w~ut to do with these? THE.CH_&IRMAN: ~nrough this Action, You would sell on this basis° We have had this situation come up before where people want to sell a group of cottages~ and they can not be sold for year round use, It would defeat zoning and the use of space. ~RS~ ZIEGLER: These were built as all year round homes, MR. BERGEN: Yes, but they were rented out. The~ are smaller than the average hOme~ Now you want to sell them and you want to split them up, MRS, ZIEGLER: The squ~re footage is greater than what was required in ~ultiple Zoning at that time~ I don~t see any difference if we =ent all of them out all year ro,~nd. ?HE C~a~PJ~_N. Apparently I misuuderstood you at the public hearing~ I thought that one of these was going to be ~de into a residence. ~.. ZIEGLER: This OhS here (referring to Map) could be made into a single unit. The Board finds that it world be an ~uusual hardship to deny this application~ and agrees with the reasoning of the applicant. Board of Appeals -12- May 24, 1973 ~. TERRY: The access to this property is excellent for our purposes - emergency vehicles. After investigation and inspection the Board finds that applicant requests pe~nission to construct dwelling on Let ~69, Map of Cleaves Point, Section III. The findings of the Board are that the Highway Department verbally approves the ~mprcve- merit of the roads in this subdivision; approximately one half of the lots bare been sold out of the subdivision; in the interim between the purchase of this lot and the present day, there has been an up-grading of the Ordinance to 40,000 sq. ft., which does not affect subdivisions which have been approved by the Planning Board prior to December 2, 197~. For these reasons the Board agrees ~¢tth the reasoning of the applicant. The Board finds that strict application of the Ordinance wo%~d produce practical difficulties or unnecessary hardshipS the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance ~ll not change the character of the neighborhood, and ~11 observe the spirit of the Ordinance.
