SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicants' 28,106 square foot parcel is 100.45 feet wide by 191.03 feet deep and is improved with an existing one-family, single-story dwelling with wood deck on roof and small frame shed in the easterly side yard, as all shown on the March 10, 2003 survey prepared by Joseph A. Ingegno, L.S. BASIS OF APPLICATION: Building Department's June 30, 2004 Notice of Disapproval, amended August 11, 2004, citing Code Sections 100-242A and 100-244 in its denial of a building permit application, for the reason that the new construction will create a new non-conformance and increase the degree of nonconformance, with a proposed setback at less than the code required 15 feet on a single side yard. The June 30, 2004 Notice of Disapproval addressed the applicants' request for a +/-3 ft. single side yard, and the August 11, 2004 amended Notice of Disapproval addressed the modification for a 5.5 ft. proposed side yard. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on September 14, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicants wish to construct a two-story addition, 24 feet to the top of the ridge, for 78 ft. linear feet along the easterly side of the dwelling for additional living area, with a side yard setback of 5 ft. 6 in. ADDITIONAL INFORMATION:AMENDED RELIEF: During the August 19, 2004 public hearing, the applicant was requested to increase the setbacks for a possible alternative plan that would be more conforming to the code's side setback requirement of 15 feet. On September 10, 2004, the applicant submitted revised plans: (1) J. Butler P.E., Plan I, with a 6 ft. setback from the side lot line, reducing the length from 78 feet to 58 I.f. for the two-story addition and reducing the square footage by 496 sq. ft. (2) J. Butler P.E., Plan II, for a two-story addition revised at 6' from the northerly end • Page 2 —October 7, 2004 • • ZBA No. 5569—Carol Witschiebein and Janet Larsen CTM Parcel 99-1-5 of the two-story addition, and 8 ft. at the southerly end, from the side lot line, reducing the length from 78 to 58 I.f., and reducing the square footage by 542 sq. ft., and (3) J. Butler P.E., Plan III, revising the setback to a minimum of 8 feet from the side line, reducing the length from 78 feet to 58 I.f. and reducing the square footage by 612 sq. ft. for a two-story addition. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the relief requested will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties because the proposed new construction will increase the non conforming setback by an additional 50%. To clarify the existing side yard setback is 11.2 feet from the property line. The code requirement for a minimum side yard setback is 15 feet as applied to this lot. This existing setback is already 3.8 feet over the code-required limit. The applicant proposes to reduce the existing non conforming setback at least another 2.5 feet to 8 feet from the property line there by increasing the degree of nonconformity an additional 50%. 2. The difficulty is self-created. 3. The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant could add more livable square footage to the existing house without the need for a variance. The board understands that adding to the existing house could trigger regulations that may require extensive upgrading of the existing structure, however, the avoidance of these requirements does not compel the board the grant a variance. 4. The variance requested herein is substantial. The variance if granted would increase the existing degree of nonconformity by 50% and increase the percentage of non conforming linear footage along the property line by approximately 196%, creating new areas of nonconformities where none existed before. To clarify, the applicant currently has a nonconforming setback of 11.2 feet running 20 along the easterly property line. The applicant is proposing to increase the linear footage along the easterly property line from 20 feet to 59 feet. This represents an approximately 196% increase in the degree of nonconformity. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B motion was offered by Member Dinizio, seconded by Chairwoman Oliva, and duly carried, to DENY the variance, as applied for. Box 1179 Southold, New York 11971-0959 °NiNGspriD APPEALS Re: ZBA 5569- Witshiebien-Larsen Dear Chairwoman Oliva: As requested, a site visit was completed on the Witshiebien-Larsen property, Suffolk County Tax Map # 99-1-5, located at 1000 Sound Beach Drive Mattituck, NY, in order to evaluate a second story addition in the eastern side yard. The site visit identified that the house and proposed addition are located south of a fully vegetated low-lying (1-2 feet) dune. The beach was in good condition with no active erosion. Although the high tide line indicates that the house is not threatened by daily tidal fluctuation, flooding should be expected during significant storm events due to the low elevation of the house. To reduce the possibility of future erosion it is imperative that the vegetation between the beach and the house remain intact. It is especially important that any vegetation inadvertently destroyed during the construction of the extension be replanted as soon as possible. The house itself, is fitted with gutters and downspouts and is sited on sand. It appears that all roof runoff is infiltrating into the ground and not causing any erosion problems. It is recommended that the extension also be fitted with gutters and downspouts to compensate for the increase in impermeable surfaces. • 423 GRIFFING AVENUE . SUITE 110 . RIVERHEAD, NY 11901 / N 0 As you maybe aware, Long Island Sound is continuously threatened by nutrient and bacteria pollution to such a degree that low oxygen levels (anoxia) suffocate aquatic life and shellfish beds and beaches are contaminated with bacteria. In response to the high nitrogen levels, the US-EPA designated the LI Sound with a Total Maximum Daily Load (TMDL) for nitrogen, in hopes of reducing these anoxic conditions. In regard to bacteria levels, the NYS DEC and local Health Departments close shellfish beds and beaches, to protect public health when bacteria levels are high. Failing septic systems along L.I. Sound have been identified as a contributor to both nutrient and bacteria pollution. Thus, the primary concern associated with this extension is the onsite septic system, which is not shown on the site plan. If approved, this extension will double the size of the house and thereby increase the potential occupancy. An appropriate and functional septic system should be sized according to the final area of the house. Since this residence is located in such close proximity to Long Island Sound (142 feet horizontally and less than 10 feet vertically) it is essential that existing onsite septic system be evaluated to ensure it is properly functioning and to determine its maximum capacity. If required, the septic system should be upgraded with respect to the final area of the house. Such action will reduce the threat of septic system failure, thereby reducing pollution loading within Long Island Sound.
