No. 5612 - Kristopher Pilles Property Location: 395 Cedar Drive and 50 Stars Road West, East Marion CTM 22-2-37, 36 (merged) SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: Applicant's property is located on Cedar Drive in East Marion. It is an unimproved lot containing an area of 6,000 sq. ft. as shown on the survey prepared by Young & Young, dated July 30, 2004, and referred to as No. 37 on the County Tax Maps. The adjoining lot to the north, No. 36 as shown on the Suffolk County Tax Map, contains 8,000+- sq. ft and the applicant's house, and is located on the corner of Cedar Drive and Stars Road (a/k/a Town Road). FINDINGS OF FACT BASIS OF APPLICATION: Building Department's August 27, 2004 Notice of Disapproval, citing Section 100-25 in its denial of an application for a building permit for a merger determination. The reason stated in the denial is that the lands have been merged since 1983. APPLICANT'S REQUEST: Applicant requests a Waiver of Merger, pursuant to Article II, Section 100-26 to unmerge County Lot No 37 from County Lot No. 36. The Zoning Board of Appeals held a public hearing on this application on November 18, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. The title search prepared by First America Title Insurance Company indicated that Alice Baldes first purchased the subject lot (37) in 1952, recorded 3/25/52 at Liber 3333 Page 371. On March 22, 1952 Alice Baldes purchased the adjoining (house) lot No. 36. Page 2 December 16, 2004 Appl. No. 5612 - Kristopher Pilles CTM 22-2-37, 36 (merged) 2. Alice Baldes died 1/1/1998, and her Executor, conveyed both Lot Nos. 37 and 36 to Richard Pilles on 12/11/98. 3. Richard Pilles died, and within approximately 12 months of his father's passing, the applicant Kristopher Pilles inherited both Lot Nos. 37 and 36 by deed dated September 7, 2004. 4. In considering this application the Board notes that merged Lot Nos. 36 and 37 have been held in common ownership for 52 years. 5. Grant of a waiver of merger would recognize a 6,000 sq. ft. lot that is substantially smaller than most lots in the district and that is inconsistent with the sizes of lots in the neighborhood. 6. Grant of a waiver of merger to construct a single-family residence would result in an increase in density in the neighborhood due to the small size of the property. 7. No evidence was submitted or testimony presented to show that a waiver of merger would avoid an economic hardship. PILLES: Good morning. r 24 CHAIRWOMAN OLIVA: Yes, sir, good morning, 25 how are you? November 18, 2004 40 1 2 MR. PILLES: Pretty good. Going through 3 this process, I guess there's four questions I 4 have to address in front of you guys. The first 5 being that the variance will not affect the 6 density of the neighborhood. From looking at the 7 tax maps, there's several other similarly sized 8 lots in the neighborhood. With that said, my 9 plans -- obviously this is a long process going 10 from here, if I gain your approval with the 11 Suffolk County Department of Health and other 12 agencies. 13 CHAIRWOMAN OLIVA: Let me interrupt you. 14 Do you have Greenport Water there? 15 MR. PILLES: No, I don't. I would have to 16 get a variance after putting in a test well. 17 So from looking at the other properties in 18 the area, I think that the lot just from my 19 opinion should be room for a variance without 20 affecting the density of the neighborhood. 21 The next question is is it consistent with 22 the size of the lots in the neighborhood. My 23 feeling yes, again, from looking at the tax maps. 24 Additionally, not on the tax maps is an existence 25 of the private road that runs between Stars Road November 18, 2004 41 1 2 and Aquaview Drive, which would reduce the size of 3 some of the other lots that are there, making it 4 even smaller than the one I'm proposing to build 5 on. 6 In regards to economic hardships, 7 realistically, to live on the north fork is 8 expensive. I came into this property through my 9 father's passing, and I'm in the process of 10 renting the other house in order to pay the 11 mortgage. I don't know, I think that to stay out 12 on the north fork I probably need to keep that 13 house rented, use that positive cash flow to pay 14 down the mortgage on building on this lot, and 15 then I can stay here. 16 To address the fourth issue, the lot, the 17 natural details and characters and contours of the 18 slopes of the lot will not be affected. The lot's 19 pretty clear. I wish the lot was a little bigger 20 but I kind of have to work with what I have. 21 CHAIRWOMAN OLIVA: What are the dimensions 22 of the lot? 23 MR. PILLES: It's 50 by one 20. 24 CHAIRWOMAN OLIVA: We did some 25 investigation and all of these small lots were, November 18, 2004 42 1 2 shall we say, merged or unmerged back in the 160s. 3 These are old lots when we didn't have zoning. It 4 just started and it's one acre zoning, of course, 5 in that area. And we try to make our lots come up 6 to somewhat near at least R40 in one acre zoning. 7 I understand your plight and what have you, but 8 these lots were merged back in the 150s and when 9 you purchased it back in 198, I believe it was. 10 They were still merged; were you aware of it? 11 MR. PILLES: No, I wasn't. In all honesty 12 my father's intention was to be standing here 13 himself. Now it's fallen on my shoulders. 14 CHAIRWOMAN OLIVA: Let me ask our Board. 15 Mr. Goehringer? 16 BOARD MEMBER GOEHRINGER: I kinds of 17 mirror or what the Chairwoman is saying. The lot 18 is extremely small, and it doesn't have any 19 utility such as public water, and I grew up on a 20 block very similar to this one out here, and I 21 understand what a 50 foot lot is, and I understand 22 that there are a couple in the neighborhood. But 23 certainly the elongation of that house would serve V 24 well, if one were so inclined to do so, into 25 building on this property rather than trying to November 18, 2004 43 1 2 squeeze it on. If you wanted to in the future, 3 even if you agreed, if you felt you had to sell 4 it, I think it's more valuable leaving that lot in 5 it's existing condition, and that's my opinion. 6 CHAIRWOMAN OLIVA: Vincent? 7 BOARD MEMBER ORLANDO: I'm looking at the 8 Town property card when your dad purchased it in 9 198, I have to ask the assessor, maybe the town 10 attorney, but it says $80, 00 for two parcels. 11 MR. PILLES: That's what he paid at the 12 time. Coming into it from an estate, I had to pay 13 fair market value. 14 BOARD MEMBER ORLANDO: I had to ask the 15 assessors what it stands for, it looks like two 16 parcels. Do you concur with that? 17 TOWN ATTY. CORCORAN: Looks like it's 18 parcels. I suspect that means, were there two 19 other tax map parcels? 20 CHAIRWOMAN OLIVA: No. Owners were 21 purchased back in the 150s so they merged and even 22 when Mr. Pilles bought them in 198 they were still 23 merged. 24 TOWN ATTY. If there 7 was a perforation between those two lots, meaning 8 dotted lines, I suspect that the assessors would 9 have said the house parcel/parcels if that was the 10 case, but since it's a solid line and maybe you're 11 receiving two tax bills that's the reason they use 12 the plural not notwithstanding the fact that 13 zoning exists and they are merged. 14 MR. PILLES: Can I ask a question? My 15 confusion is when these lots were created, the 16 intention was for two building lots, correct? I 17 mean, when the zoning many, many administrations 18 ago. 19 BOARD MEMBER TORTORA: One lot was created 20 prior to zoning, Lot 36 was created in 1952, prior 21 to zoning. Both lots have been merged since Lot 22 36 was purchased in March of 152 and the other was 23 in August 156. What relationship are you to Alice 24 and George Blaze? 25 MR. PILLES: None. That's my opinion, of course, as always I 21 think the Town is remiss that they don't notify 22 people that they do things. Unless you read the 23 Suffolk Times thoroughly every day, every week, 24 then you may miss out. There's no law that says 25 you have to buy the Suffolk Times. MOORE: I don't have any relationship 8 with Mr. Pilles, but I want to put something on 9 the record that I think the Board should keep in 10 mind. We are going right now through several 11 hamlet studies and the stewardship meetings and so 12 on, and the whole emphasis of it is to try to 13 create diversity of neighborhoods and provide for 14 alternative or affordable housing, not to say that 15 this lot is necessarily going to be an affordable 16 lot, but it's certainly going to be less expensive 17 than a one acre, two acre lot anywhere else in the 18 neighborhood. 19 I know I've had various applications on 20 behalf of clients on Stars Road and I know the 21 Zoning Board has been reluctant to I say 22 "grandfather" the subdivision that got approved 23 with the Star's Road subdivision that created this 24 property, but maybe it's time to start thinking 25 about the policies and the goals that the Town November 18, 2004 47 1 2 Board has expressed. We are doing all these 3 studies these moratoriums, a lot of community 4 input is being sought for the purposes of creating 5 some density. Why are we creating density in 6 other areas and creating a whole process when we 7 have these existing preexisting subdivisions that 8 provide that alternative housing types. Stars 9 Road is an example of it, Mattituck has some 10 examples. Where I live we have a diversity size 11 parcels. Where I live on a half acre, my neighbor 12 a nice man lives in a small cottage on a parcel 13 that is about the same size. We can create 14 diversity in this community, and we have the 15 zoning controls through setbacks and variances so 16 that the houses that get built on these 17 substandard lots are in conformity with the 18 neighborhood. But to force the merging of 19 properties where zoning has already through 20 history provided for a neighborhood that is 21 diverse, we should try to keep that in mind or I 22 ask the Board to keep that in mind because we seem 23 to be trying to move forward but going backwards 24 at the same time. 25 I know you're constantly considering that November 18, 2004 48 1 2 balancing, and you do a very good job with that. 3 I know your hearts are in the right place, but 4 also keep in mind that Stars Road somewhat middle 5 income homes are 'available to the public, and I 6 think you have an applicant right here who is an 7 example of that. 8 CHAIRWOMAN OLIVA: The problem is going to 9 be to get the Board of Health approval? 10 MS. MOORE: That's always a problem, but 11 even the Health Department recognizes that in 12 subdivisions that are substandard, if you're the 13 last guy to be developed, there has to be some 14 flexibility, and that's what the Board of Review 15 is there for. You can't blame the last guy to be 16 developed to fit the bill for everybody else's 17 sanitary and well. You don't have to be the 18 enforcement body for the Health Department. 19 CHAIRWOMAN OLIVA: I realize that, thank 20 you. Yes, sir? 21 MR. SAKELLIS: I'm a neighbor of this 22 particular lot. My name is George Sakellis. I 23 did bought the house a few years back with the 24 idea that I will have some peace and quiet, and of 25 course, it doesn't look like it's going to work. I can't imagine that out here we're 4 going to have similar city buildings, close to 5 each other, 20 footers and 15 footers, and I think 6 this is ridiculous that we going to allow this 7 man, which I don't know, to build one house on 8 this particular lot. Many people as you see in 9 the areas spend a lot of money for lots for 10 buildings, and they are not squeezing in between 11 driveways to make the house. This man has been 12 renting the house and the new house that he's 13 going to do, he's going to have to rent it, 14 there's no way. So if that's what we want to do, 15 rent our houses up there, I think it's very good 16 idea for him to build a nice 20 footer house. I'm 17 very opposed to it and I'm very aggravated.
