No. 5631 — PETER GAILLARD Southold Town Clerk Property Location: Mansion House Drive, Fishers Island; CTM Parcel 6-5-8 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 13,068+- sq. ft. parcel is located along the west side of Mansion House Drive and the south side of Sappho Road, Fishers Island. The property is improved with a single-family, two-story frame dwelling and as-built deck, as shown on the survey prepared by CME Associates Engineering and Land Surveying dated 6/9/2003, amended 10/28/2003. BASIS OF APPLICATION: Building Department's December 24, 2003 Notice of Disapproval, citing Section 100-244, disapproving a building permit application for an "as built" deck addition at less than the code required minimum 35 ft. from the front yard line. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on December 16, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant wishes to obtain a building permit and certificate of occupancy for an as-built deck addition at the southeast corner of the dwelling, and a 4.7 ft. section of the deck is nonconforming to the code's 35 ft. setback requirement, resulting in a 30.3 ft. setback from the front lot line (facing Mansion House Drive). REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. The granting of relief will not produce an undesirable change in the character of the neighborhood, or be a detriment to nearby properties. The applicant's 13,068 sq. ft. lot is situated on a corner with frontage along two streets. The applicant has applied for a building permit concerning a raised wooden deck that was built more than 30 years ago. A 4.7 ft. corner section of the deck was built beyond the code's 35 ft. setback limitation. The deck is open to the sky (unroofed), and has existed for at least 30 years without an undesirable affect in the character of the neighborhood or nearby properties. 2. The benefit sought by the applicant cannot be achieved by some other method, feasible for the applicant to pursue, other than an area variance. The existing deck construction has been maintained for about 30 years in its present location. • • Page 2 —December 29, 2004 • • Appl. No. 5631 —Peter Gaillard 6-5-8 at Fishers Island 3. The requested variance is not substantial, since it is pertaining to only a small 20+- sq. ft. section of the deck within the 35 ft. setback restriction. 4. No evidence has been submitted to suggest that the proposed construction will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood, or district. There are also no wetlands or other sensitive environments on the property. 5. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy an open, unroofed deck, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dinizio, seconded by Member Goehringer, and duly carried, to GRANT the relief requested for an unroofed, open deck addition, as shown on the survey prepared by CME Associates Engineering and Land Surveying dated 6/9/03, amended 10/28/2003. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action.
