was held at 7:30 PM, Thursday, July 6, 1967, at the Town
Office on Main Road, Southeld, New York.
There were present: Messrs: Robert W. Gillispie, Jr.,
Chairman; Robert Bergen, Fred Hulse, Jr.
Absent: Messrs: Charles Gringonis, Jr., Serge Doyen, Jr.
PUBLIC HEARING: Appeal No. 1120 - 7:30 PM (EDST), Upon
application of Rensselaer G. Terry, Jr., Esq., Main Road,
Southold, New York, a/c Thomas-P. Dougherty, et al, 168 Elm
Avenue, Glen Cove, New York, for recognition of access in
acczrdance with the State of New York Town Law, Section 280A.
Location of property: south side North Bayview Road, Sou%hold,
New York, bounded north by Hilto-Epp-Ors., east by J. Shipule-
McCarthy, south by North Bayview Road, west by H. Schumacher.
Fee paid $5.00.
The Chairman opened the hearing by reading the application
for a special exception, .legal notice of'hearing, affidavit
attesting to its publication in the officialnewspaper, and
notice to the applicant.
The Chairman noted that the application was accompanied
by a sketch of the proposed parcels by Robert A. Kart, Land
Surveyor, 138 RoanokeAvenue, Riverhead, New York.

THE CHAIRMAN: Is there anyone present who wishes to speak
for this application?
MR. RENSSELAER G. TERRY, JR.: I do.
THE CHA~: What is this line on the sketch?
MR. TERRY: I will present a guaranteed survey showing the
location of the buildings.
(Mr. Terry explained that the line was drawn by himself,
and that the land was purchased as one tract.)
THE CHAIRMAN: We have heard for this application. Is there
anyone present who wishes to speak against this application?
(There was no response.)
After investigation and inspection the Board finds that.the
same roadway will be used by the prospective purchaser as by the
former owner and this roadway has been used for many years, is
in good condition, provides suitable and reasonable access for
all emergencyvehicles, occupants, visitors, etc.~ to the premises.
On motion by Mr. Hulse, seconded by Mr. Bergen, it was
RESOLVED that Rennsselaer G. Tery, Jr., Esq., Main Road,
Southold, New York, a/c Thomas P. Doughterty, et al, 168 Elm

applied for.

present, ~ut that they had been detained.)

· T~E:CHAIRMAN: The application is/~by a sketch on
the back of the application for a building permit indicating that
the proposed two-car garage would be 24~ x 24'~ dimensions~ at
least 10 feet from the southerly line,~ but does not indicate how
far from the westerly line. Is there anyone present to speak for
this application?
(There was no response.)
T~E CHAIRMAN: I will speak for it. I investigated it this
afternoon and myunderstanding is that the proposal here is to
divide this large lot into four parcels. The size of the lot is
561 feet on the east line, 473 feet on the west linem. 228 feet,~
approximately on the Sound. Part of the reason why weshould
gr~nt this application is that other properties have garages in
the front-yard area. Is thee anyone present who wishes to speak
against this application?

After investigation and~inspection the Board finds that
the applicant has requested avariance for permission to locate
a garage in the front yard area~ and that several others in the
same area have their garages so located.
The Board's findings are in agreement w~ththe reasoning of
the applicant. Other preperties in this vicinity have also placed
their garages in the front yard area in order to cons rye their
view of the So,nd. The condition for granting this permission is
that the garage be placedno closer than 10 feet from the right.of-
way to the Sound,~ and no closer than five feet to the Sardi line
to the east.
The Board finds that the public convenience and welfare and
justice will be served and the legally established or permitted
use of neighborhood property an~ adjoining use districts will not
be permanently or substantiallyinjured and the spirit of the
Ordinance will be observed,

THE CPIAIRMAN: Notice of disapproval from the Building
Department indicated that the application is disaplkroved on
grounds of insufficient frontage of either~lot. Is there
anyone to speak for this application?
MR.~ AURICHIO: For the application~ as previously stated,
lots 44 and 48 each have approximately the, same frontage as
otherlots in the area as clearly indicated- 75',~ 80~. 60',,
etc. Inasmuch as'it conforms with all the rest of the lots it
would not be changing the character of .the area~ butwill still
.retain the same character as it now exists.

application.

keep unauthorized persons from using the private beach, and to
prevent the private road frombeing used as a speedwayendangering
the lives of children in the area.

to speak- for bit., Schild. (Mr. Aurichio explained to the Board
~he exact location of the property and the depth-of same, etc.
He cited that it was very important that the sign be retained in
order for the' business to be seen when coming from the east. )

After investigation and inspection the Board finds that
Edward Schild~ ownerofArrow Fishing Station, Old]M~ain Road,
Southold,, New York~ has applied for a special exception for
permission to retain a ridgesign. Due to the location of the
property,~ the applicantnotes that without this sign his
business wouldbe out of sight when coming from the east. The
Board agrees' with the reasoning of the applicant and Mr. Aurichio.

THE CHAIRMAN: Is there anyone present who wishes to speak
for this application?
MR.' GEORGE L, PENNY: Everything is explanatory.- it's
necessary for our business - it's approximately~1½ blocks off
the main road.
THE CHAIRMAN: Is.there anyone here to speak'against this
application?
(There was no response.)
THE CHAIRMAN: Location ora business off the main road
occurs in a lot of areas in the Town, and solely for that~reason
we have not granted any permission for businesses to advertise.
(The Chairman explained,that if everyone who wanted to advertise
their business it would indicate a general business area, as
well as flood the area with signs.) We would not be willing to
grant~ you an exclusive use of something that has been denied
everyone else in the Town - therefore, it would be easy to deny
it~but the Board thinks it's in the public interest to designate
this sign as one whichcoutd include other businesses - other
people -if they wish to join you on a proportionate-cost basis
and share the sign with you.
MR. PENNY: Permission is granted by the' owner just for the
two of us - he was very reluctant to do that. His son has asked
us to remove the sign, but they have agreed to let us leave it
there.
THE ~: If you want~to keep the sign you have to get
~ir. Locastro~s permission.
MR. BERGEN: We ~ouldn't want the sign any larger than it is.
THE CHAIRMAN: In other words, if you'had two more applicants,~
or four should go on the same sign. Otherwise, we are in the
position of ~ranting you two fellows something denied to others.
This is something that hasn't been given to anyone else. (The
other party with.Fir. Penny was Mr. August Rolfse,. o~ner of
Mattituck Iron Works.)

After /nvestigation and inspection the Board finds that
GeorgeL. Penny., Inc., and Mattituck Iron'.Works~ Sound Avenue,
Mattituck,. New York, have requested a special exception for
permission to retain a directional sign on the property of
Locastro on the northeast corner of Main Road and Pacific Street,~
Mattituck~ New York, for the reasons that they are 1½ to 2
blocks off the MainRoad,. and that the sign is eseentiml' to
delivery,men and potential customers~ and will help to avoid a
traffic situation that is hazardous.
On motion by Mr, Bergen, seconded by Mr. Giliispie, it was
RESOLV~hat George L. Penny, Inc., and Mattituck Iron
Works, Sound Avenue, Mattituck, New Yorka be granted permission
to retain a directional sign on the property of Locastro on the
northeast corner of Main~Road and Pacific~Street, M~ttituck,
New York, on condition that M_r. Penny'and Mattituck Iron Works
make space-available on the present structure for at least two
more prospective-applicants; if such applications are-made to us,~
that space be made available to them~within 60 days from the
time permision is granted by this Board. If, in this time, you
are unable to persuade Mr. Locastro to go along with you, you ,are
in the position of losing'the sign.

to erect a sidewall sign in lieu of a ground sign because he
feels it Will be seen.more readily by people using~the main
traffic streeton the south side of the store. Is there anyone
present who wishes to speak-against this application?

After investigation and inspection the Board finds that
S~rge-J.. Doyen, Jr.,, Fishers Island, New York,,, desires to place
a sidewall sign on his place or'business in lieu of a gound sign
and feels that this sign will better advertise the business in
question since it will be more readilyseen by those passing the
store.
On motion of Mr. Bergen, seconded by Mr. HUlse, it was
RESOLVED thatMr. Serge J. Doyen~ Jr.~ Fishers Island,, New
York~ be granted permission to place a sidewall sign on his
place of business in lieu of a ground sign in front of the
building. This permission is granted for one year andmaybe
~ .... ~renewedk-by.~letter. Also subjectto subsequent changes
in the Zoning Ordinance.

MR%- AUGUST~ROLFSE%~ Owner of Mattituck'Iron Works: I feel
it is necessary to have this sign on the side wall beCause the
roof has asbestos shingles and with brackets on the roof when
the wind comes from the north itwould-break the~sign and rip
off the shingles.

After investigation and inspection the Board fin~s that
Mattituck Iron Works desires to retain a sidewall sign on their
business on the southeast side of Sound Avenue and Pacific
Street~. Mattituck, New York. Applicant prefers a sidewall to
a roof sign because of the type of roofing and the danger of
damaging the roof should a high wind rip the sign therefrom.
The Board is in accord with the thinking of the applicant,~ and
that it will be to the advantage of the public to have this
sign placed on the east side of the building because it will
place fewer signs on a publichighway.
On motion of Fur. Hulse,. secondedbybir~ Bergen,' it was
RESOLVED thatMattituck Iron Works,, Sound Avenue, and
Pacific Street, Mattituck~ New York~ begranted a special
exception for permission to retain a side wall sign. This
permission is granted for one year,, renewable by letter,, and
subject to subsequentchanges in the Zoning Ordinance of the
Tow~.
