WHEREAS, the applicant, Patricia C. Moore, propose a site plan for an alteration and addition of 2,206 sq. ft. to the 1,890 sq.ft, existing office with a 770 sq. ff. apartment and 200 sq.ft, car port on a 0.92 acre parcel in the RO Zone; and WHEREAS, Patricia & William Moore, are the owners of the property known as 51020 State Road 25 located on the e/s/o State Road 25, approximately 783' n/o the intersection with Jockey Creek Drive in Southold. SCTM#1000-70-2-8; and WHEREAS, on December 3, 2004, a formal site plan application was submitted for approval; and WHEREAS, on March 7, 2005, the New York State Department of Transportation reviewed and approved the Highway Work Permit 100-04-0715; and WHEREAS, on March 3, 2005, the Architectural Review Committee reviewed and granted conditional preliminary approval of the architectural drawings and associated site plan materials with conditions; and the Planning Board has accepted this approval and determined it to be satisfactory; and WHEREAS, on March 31,2005, the Southold Town Zoning Board of Appeals reviewed an application and granted a special exception and area variance under appeal number 5636 with 3 conditions and the Planning Board incorporates this in this approval; and Moore Law Offices - Paqe Two - 06/14/05 WHEREAS, on April 12, 2005, the applicant submitted to the Southold Town Planning Department all the materials required in the March 3, 2005 A.R.C approval and the Planning Board has accepted this submission and determined it to be satisfactory; and WHEREAS, on April 14, 2005, the Southold Fire District recommended that fire protection is adequate and the Planning Board has accepted this recommendation; and WHEREAS, on May 10, 2005, the Southold Town Planning Board, acting under the State Environmental Quality Review Act (6 NYCRR), Part 617.5 made a determination that the proposed action is a Type II and not subject to review; and WHEREAS, on May 16, 2005, the Southold Town Engineering Inspector reviewed and approved the proposed drainage with conditions and the Planning Board has accepted his recommendation; and WHEREAS, on May 19, 2005, the Suffolk County Department of Health Services reviewed and approved an application under the reference number C-10-05-0007; and WHEREAS, on May 23, 2005, the Southold Town Building Inspector reviewed and certified the site plan for "Professional Office and Accessory Apartment" use; and WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of Public Hearing, has received affidavits that the applicant has complied with the notification provisions; and WHEREAS, the following four items are incorporated and included in the site plan: All outdoor lighting shall be shielded so that the light source is not visible from adjacent properties and roadways. Lighting fixtures shall focus and direct the light in such a manner as to contain the light and glare within property boundaries. The lighting must meet the Town Code requirements. The trench drain indicated at the entrance be of adequate size and the Town Engineer recommends a fifteen (15) inch diameter drainage pipe to the leaching basin. 3. All signs shall meet Southold Town Zoning Codes and shall be subject to approval of the Southold Town Building Inspector. 4. Based on the land banked parking the Planning Board has the dght to review the parking requirements again if a change of use is proposed; and WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold have been met; be it therefore Moore Law Office - Paqe Three - 06/14/05 RESOLVED, the Southold Town Planning Board has reviewed the proposed action to the policies of the Town of Southold Local Waterfront Revitalization Program and has determined the action is consistent provided that the best management practices outlined in the June 8, 2005 memo prepared by the LWRP Coordinator are implemented; and be it further RESOLVED, that the Southold Town Planning Board grant final approval of the site plan prepared and certified by Angel B. Chorno, Architect, dated January 6, 2005 and last revised May 17, 2005, and authorize the Chairperson to endorse the final site plans subject to a one year review from the date of issuance of the building permit. The principal building is shown at 15.9 feet from the westerly (front) lot line, 31.9 feet from the northerly (side) lot line, 67.6 feet from the southerly (side) line, and at least 260 feet from the most easterly (rear) lot line. FINDINGS OF FACT In considering this application, the Board has reviewed the code requirements set forth pursuant to Article Ill, Section 100-71B (ref. 100-91) to establish Apartment uses in the Residential-Office Zone District and finds that the application complies with the requirements for the reasons noted below: 1. REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony, documentation, and other evidence, the Zoning Board determined the following Findings of Fact to be true and relevant: SPECIAL EXCEPTION 1) The establishment of two Apartments are permitted uses in this Residential-Office (RO) Zone District, as noted in the Building Inspector's October 8, 2004 Notice of Disapproval, amended January 14, 2005, and provided by Article VII, Section 100-71.3B reasonable in relation to the District in which is located, adjacent use districts, and nearby and adjacent residential uses. 2) The Special Exception granted will not prevent the ordedy and reasonable use of adjacent properties. 3) The Apartment use(s) will not prevent orderly and reasonable uses proposed or existing in adjacent use districts. 4) No evidence has been submitted to show that the safety, health, welfare, comfort, convenience, order of the Town would be adversely affected. 5) An Apartment is listed under Code Section 100-71B as an authorized use, subject to special exception review action by the Board of Appeals, and site plan approval from the Planning Board, prior to obtaining permits from the Building Inspector. 6) No adverse conditions were found after considering items listed under Section 100-263 and 100-264 of the Zoning Code. AREAVARIANCE 7) Grant of the relief requested will not produce an undesirable change in the character of the neighborhood, or be a detriment to nearby properties. The accessory building is an existing garage presently located in the required rear yard. However, after construction of a proposed addition to the principal building, the yard in which this building is located will be re-designated as a side yard, based on the yard definitions under Section 100-12 of the zoning code. 8) The benefit sought cannot be achieved by some other method, feasible for the applicants to pursue, other than an area variance, because the garage was constructed in its present location more than 30 years ago. We have reviewed 3'our request for us to re-evaluate our recommendation for widening 3'our driveway from fifteen (15) feet to twenty-two (22) feet. We offer the following information in regards to your request. Onr Policy pertaining to entrances to State highxvays states "Home business driveways and small subdivision driveways can, at the discretion of the Department and based on site specific conditions, be designed as either residential or minor commercial driveways, but should be wide enough to permit two-way traffic." The width of your driveway, fifteen (15) feet, xvould not be wide enough to permit two-xvay traffic. While xve are sensitive to the Historic District and the unique visual and historic setting of the Long Island North Shore Heritage Area we must also consider the safety aspect of entrances to the State highway system. Residential driveway widths range from nine (9) to twelve (12) feet for a single lane. Based on these standards a minimum driveway width of eighteen (18) feet would be xvide enough to permit two-way traffic. We xvilL therefore, modify our previous request and we recommend a driveway xvidth that meets the minimum driveway width of eighteen (18) feet. The plans shall be revised accordingly and shall also address the other comments of our December 17, 2004 letter to you. Our Policy pertaining to entrances to State highways states "Home business driveways and small subdivision driveways can, at the discretion of the Departmem and based on site specific conditions, be designed as either residential or minor commemial driveways, but should be wide enough to permit two-xvay traffic." The xvidth of your drivexvay, fifteen (15) feet, would not be xvide enough to permit two-xvay traffic. While we are sensitive to the Historic District and the unique visual and historic setting of the Long Island North Shore Heritage Area we must also consider the safety aspect of entrances to the State highway system. Residential driveway widths range from nine (9) to twelve (12) feet tbr a single lane. Based on these standards a minimum driveway width of eighteen (18) feet would be xvide enough to permit two-way traffic. We will, therefore, modify our previous request and we reconu'nend a driveway width that meets the minimum drivexvay width of eighteen (18) feet. The plans shall be revised accordingly and sball also address the otber comments of our December 17, 2004 letter to you. However, we have a request that you reevaluate the recommendation tham the curb cut be widened from our proposed 15 feet to 22 feet with two way traffic. A 22 foot wide, two way, entrance will drastically alter the character of the office in a Historic District. Our office is located in the Southold Historic Dis~rSct and preservation of the character of the area Js important to the Town and to us. The property is zoned RO-Residential-Office and we have made an effort to preserve the residential look and design of the building and improvements. The zoning only allows professional or business office, we are not permitted to undertake retail sales. Attached is a copy of the relevant zoning code. If you review the curb cut of our neighbor, a comparable sized dental office, you will see that he has also maintained the residential character of the office with a 15 foot wide entrance. The dentist and I landscaped our mutual property lines to enhance the residential and historic look. The historic and residential look of the propersy would be compromised by a 22 foot entrance. The fron~ lawn w~ll become a driveway and our historic and classic looking office will look like the entrance to a shopping center. A 22 foot wide entrance would be appropriate if I change the use of 5he property to a renail use, I would have no objection condi~:ioning this permit on renaining an office use. If I change the use of the property the building department would require me to seek new site plan approval and the site plan would be referred to you in accordance with Town procedures. The entrance is intentionally limited in size and designed. The entrance presently controls parking and vehicle speed into our parking lot ~rom route 25. The existing fence and landscaping discourages our clients or employees from parking on Route 25. The expansion of the curb cut, as you propose~ will require removal of our landscaping and fence, moreover, a 50 year old tree along Route 25 would have to be removed. Your office may not be aware that the Town of Southold has a tree committee who volunteer their time to plant trees along route 25. The Town reacts negatively to tree removal along the Historic District Our law o[fice and the traffic it generates Js limited by the nature of the use, we meet with clients by appointmen~ only. The snarl is also limited in number and has staggered shifts. I me~ with the Planning Board to review the site plan and your recommendations. They also opposed enlarging the entrance.
