The Planning Board establishes itself as lead agency, and as lead agency, makes a determination of non-significance and grants a Negative Declaration; and be it FURTHER RESOLVED, that the Southold Town Planning Board grant conditional sketch plan approval on the maps dated as revised, September 15, 2002, subject to the following condition: The structure located on SCTM#1000-81-3-24 must be moved prior to issuance of any final approval for the proposed lot line modification. The new location of the structure must conform to all applicable setbacks as defined by Section 100-31 as required by the Town Code of the Town of Southold. The Stodt house on Lot 24 was demolished. The owners, at the time, had planned on also demolishing the house on Lot 25 (now 25.1). Demolition was planned because of the age of the house and it would eliminate certain encroachments. The original developers (Miller & Dey) sold the house and lot to Charles and Amy Scharf. Mr. And Mrs. Scharf now own the house on tax map parcel 25.1 and the vacant lot, tax map parcel 26. Rather than demolishing the house, They renovated the existing house and added a screened in porch to the west side of the house. The building department did not realize that they had two separate parcels and the porch overlapped the property line. The owners must either obtain a variance or lot line change in order to obtain a certificate of occupancy for the porch in the existing location. Based on my experience with the Zoning Board, they would prefer that we pursue a lot line change which could make the existing house conforming rather than a variance. It would seem that a lot line change between 25.1 and 26 can be achieved without affecting the overall square footage of each lot.
