Simon http://southoldtown-northfork.net BOARD OF APPEALS TOWN OF SOUTHOLD FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF FEBRUARY 3, 2005 ZB Ref. 5637 - CONSTANCE BEEBE Property Location: 24925 Main Road, Cutchogue; CTM 109-1-18, 19 and 20.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's property is identified on the County Tax Map as Parcels 109-1-20.1, 18 and 19. The property is improved with two dwellings and accessory buildings/structures, as shown on the October 28, 2003 survey prepared by Joseph A. Ingegno, L.S., revised May 28, 2004. CTM 20.1 consists of 33,908 sq. ft., CTM 18 consists of 22,491 sq. ft., and CTM 19 consists of 19,492 sq. ft. BASIS OF APPLICATION: Building Department's September 8, 2004 Notice of Disapproval, citing Section 100-32 in its denial of an application to the Building Department and Planning Board in her request to change lot lines, re-creating the property into two parcels: Parcel 1 of 40,361 sq. ft. and Parcel 2 of 35,530 sq. ft. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on January 20, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant is requesting variances for the sizes of 40,361 sq. ft. and 117 feet in width (proposed Parcel 1), and of 35,530 sq. ft. with 144 feet in width (proposed Parcel 2). REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant-to pursue, -ocher than vadanpes. - No increase in-ferlss •y will be created, and the lot line change will produce rectangular dimensions. 3. The variance granted herein is not substantial. 4. The alleged difficulty has not been self-created. All three of the parcels were legally created before the existence of Southold Town Zoning, and the difficulty, nonconforming lot size, was created by various changes in the town codes, over which an individual property owner has very little control. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a lot line change, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Chairwoman Oliva, seconded by Member Dinizio, and duly carried, to GRANT the variances as applied for, as shown on the October 28, 2003 map prepared by Joseph-A. Ingegno, L.S., revised May 28, 2004. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Beebe and Virginia Beebe and was originally owned by Wilfred Beebe who conveyed it to Douglas Beebe who subsequently conveyed same to Douglas G. Beebe and Beatrice Beebe, his wife, by Deed dated February 9, 1966 recorded in the Suffolk County Clerk's Office in Liber 5911 cp 494. The said Douglas G. Beebe having died a resident of Cutchogue, Suffolk County, New York on July 22, 1974. The said Beatrice Beebe having died a resident of Cutchogue, Suffolk County, New York on March 27, 1987. The Last Will and Testament of Beatrice Beebe was admitted to probate in the Surrogate's Court of Suffolk County, New York on May 4, 1987 and under the said Last Will and Testament of Beatrice Beebe she devised her entire estate to her son, Sidney Beebe. Sidney Beebe conveyed same to Thomas Beebe on February 19, 1988 by Deed Liber 10543 cp 407. Thomas Beebe then conveyed same to himself and his wife, Virginia Beebe on November 29, 1989 by Deed Liber 10974 Page 238. The "so called" middle parcel was conveyed by Wilfred G. Beebe to Sidney Beebe and Constance Beebe on February 8, 1966 by Deed Liber 5909 Page 100. Sidney Beebe thereafter died on October 15, 1988. The parcel has a frontage of 96.50 feet and is adjacent to the first parcel mentioned above on the Main Road. The most easterly parcel was conveyed by Wilfred G. Beebe and Henrietta G. On May 1, 1964 Sidney Beebe conveyed to Sidney Beebe and Constance Beebe, his wife, the last described parcels by Deed Liber 5542 Page 327.
