As per your request of October 2, 1989, I researched the
Planning Board files for more information on the
above-referenced subdivision.
I cannot find a file on this subdivision which was approved
in 1963 . However, there is a record of the approval process in
the Planning Board minutes for 1963 . It is possible that there
is a file in the basement, but I do not have time to go through
all the dead files to find it. Hopefully, the enclosed copy of
the minutes will be of sufficient assistance to you.

Mr. Young, and Mr. Unkelbach.
A representative of Frederick and Harold Ree-as appeared before
the Board for an informal discussion relative to Southold Shores at
Arshamomaque. Mr. van Tuyl presented a revised preliminary plan of
the layout. In the new layout drainage easements are provided. After
7.. examining the map the Board advised that they would require a 100 ft.
by 100 ft. turnaround where the road ends at the canal on the wester-
ly side of the development. They advised that this turnaround could
be retained. as private property reserved for the interior lots with
the provision that it be dedication to the Town for highway purposes,
r: when the roads are dedicated.
_ . The Board also advised that the road and drainage layout should
be approved by the Highway Superintendent before a final map is
drawn and water tests should be made and approval from the Health
Department secured. - Map by Otto W. Van Tuyl & son dated March 21,
19624 revised December 6, 1962 and February S. 1963.

i Kr, garold Reese appeared before the Board to make application
" for tentative approval of his subdivision to be known as Southold
h sw=ee at Arshamomaque. The Board reviewed the map which indicates
51 lots. all over 20,000 sq. ft. in most cases, and most of them
fronting on Peconic Bay or proposed canals. There was a question'
relative to drainage being run into the canals but it was found this
!mold be the most favorable solution. There was a further question
_ relative to the 100 ft. turn-around at the road ending at the westerly
post canal. This road end is shown as tapering to 100 ft. at tht canal
rad the Board requested that it be shown as a 100 ft. by 150 ft. turn- E
around, t

Daar Mr. Fisbart
I am in receipt of the vacant land certificate of
occupancy which you issued in respect to the subject property
on April 8, 1982. I am enclosing a copy of same for your
review.
I draw your attention to the final paragraph which
you inserted in the "certiicate of occupancy•e
"No building permit may be issued
until Tarpon Drive has bean
improved to the satisfaction of
the Planning Board, The Planning
Board has been requested for such
approval.'
I would like to draw to your attention that you
1 issued a certificate of occupancy (vacant land) for the adjoin-
ing parcel on December 28, 1981 under number z 10032. That
vacant lru.d certificate of occupancy contains no such restric-
tion.
I would also like to bring to your attention that
the subject parcel is a lot on an approved subdivision. The
subdivision has been approved by the Southold Town Planning
Board. As you realize, there are streets in a subdivision.
By approving the subdivision, the Planning Board has approved
the streets.
I mind it ludicrous that the restriction has been
placed in the subject certificate of occupancy. As you are
well aware, there are a number of houses already erected
within that subdivision.
George H. Fisher,
Building Inspector -2- April 9, 1982
It is hereby demanded that you issue an amended
vacant land certificate of occupancy excluding the above
quoted paragraph.
very truly yours,

re: SOUTHOLD SHORES BOAT BASIN
Dear Mr. Kujawski:
I represent Southold shores Boat Basin, and am requested by its
president, Harold Malone, to respond to the Town Attorneys comments
in connection with its applicationfor installation of 385' of 4'
width floating docks.
Addressing the inquiries of Mr. Schondebare:
L. Who or what is Southold Shores Boat Basin, Inc.?
RESPONSE: Southold Shores Boat Basin, Inc. is a Type "A"
Not for Profit Corporation formed in 1983 by a group of 13
property owners who were also members of the Southold Shores
Property Owners Association (also a Not for Profit Corporation,
formed prior to 1976 ) to take title from the developer (REESE)
to Lot 52 for purposes of bathing beach activity and boat basin,
(Liber 8139 p 276) by a later deed in 1980 it took title to from
the developer (REESE) to the roads and title, if any, to
underwater lands in the Boat Basin" Liber 8857 p 244)
2. Does Southold Shores have a homeowners association
corporation and if so what is the relationship, if any, between the
two corporations.?
RESPONSE: Southold Shores Property Owners Association, Inc.
was formed prior to 1976 as aforementioned. In 1983 it was faced
with a claim to the underwater lands comprising the boat basin
abutting lot 52 which the developer had conveyed to the Property
owners association by deed L8139 p 276 in 1976 for use in common
for the owners in the development
The heirs of the Sage Brickyard, adjoining owners
who claimed title to all the underwater lands abutting the Southold
Shares filed map, demanded for payment for the underwater lands.
Attempting to thwart the claim the Property owners Association
obtained a further deed from the developer Liber 6857 p 244
recorded July 23 1980 which purported to convey The roads on the
Map, and all right title and interest of the parties of the first
part, IF ANY to the waters and lands under the waters of that
portion designated on the aforesaid map as "Boat Basin. . .
In 1983 it became apparant that only the boatowners,
among the association membership, were interested in resisting or
meeting the Sage claim to secure title to the underwaterlands so
that they might maintain the floating docks which they individually
had placed in the area of the Boat Basin abutting the Association
owned lot 52
When it became clear that the Property Owner's association
membership was not going to resist nor meet the claim to the
underwater land of the heirs of Sage, realizing that their right to
maintain their floating docks could be in jeapordy, this group of
13 property owners formed Southold Shores Boat Basin Inc. and
purchased from the heirs of Sage, a deed for the underwaterlands
immediately abutting lot 52, with title insured by Ticor Title
Insurance Company and have since furnished the investment capital
to construct the existing floating docks.
Ultimately in 1987 Association members, not stockholders
in the Boat Basin Corporation commenced a legal action, settled by
stipulation (copy annexed) which established a waiting list among
the Association members who not only were lot owners but have
completed houses in the development, for subscription to share
ownership predicated upon payment of the proportionate cost of the
expansion of the existing docks so as to create additional docks.
3. How does the corporation claim title to the upland area?
RESPONSE: Southold Shores Property owners Association, Inc
holds title to Lot 52, for use all lot owners in common, which
include the individual shareholders of Southold Shores Baot Basin,
Inc. Its consent or joinder in the application may be readily
obtained.
4. Does Southold Shores have a homeowners assocation
corporation, and if so what is the relationship, if any between the
two corporations.
RESPONSE: Southold Shores Property owners Association, is
the Homeowners association. The relationship between the two groups
is spelled out in a stipulation of settlement executed in
connection with settlement of an action in the Supreme Court
Suffolk County, index #87 14315 copy annexed which effectively
provides a waiting list of Association members (who own dwellings)
and provides for capital contributions by new members equal to the
cost of construction of additional docks for their use.
5. How does the corporation claim title to the upland area?
RESPONSE: The upland area, lot 52 is deeded to SOUTHOLD
SHORES PROPERTY OWNERS ASSOCIATION, INC. whose consent or joinder
may be readily, to cure any technical defect which may pertain,
since the underwater lands are held by SOUTHOLD SHORES BOAT BASIN,
INC by deed dated August 16 1983, such title being insured by TICOR
TITLE GUARANTEE CO its title #T1283 2780
6. Since this application is for an addition to existing
docks, what do your files show on approvals for present facilities:
RESPONSE:
NYS Dept of Environmental Conservation, (DEC)
permit #10-88-1266 annexed
NYS Dept of State, Coastal Management Program
Application pending
US Dept of Army,Corps of Engineers, application
pending, file #13434-88-1422-12 copy annexed
7. Is this a not-for profit corporation or are they
operating a business in the zoning district by constructing and
selling boat slips.?
RESPONSE: This is a not for profit corporate joint venture
on behalf of and limited to the private owners who own houses .in
the subdivision to construct and maintain docking facilities for
their own private use, within the scope of Section 100-31 (3) . The
docks are not "sold", instead shareholders are assessed a prorata
portion of the cost to construct
In Summary, and opposite the implied view of the Town Attorney, it
is submitted that the subject permit may be issued within the
purview of Section 100-31 (3) of the Southold Zoning ordinance
without the requirement of any proceedings before the ZBA, upon the
consent or joinder of the upland owner SOUTHOLD SHORES PROPERTY
OWNERS ASSOCIATION, INC. which will be forthcoming. .
If you require anything further in this matter please feel free to
call my office.
Yours very truly

In regard to your public notice number 13434-88-1421-L2,
dated the 27 of September, 1988, a number of concerns have been brought up.
I would like a clarification of " non-commercial " marina.
The existing site plan shows moaring potential for twenty-one boats. Are
there any guarantees that this proposal will not exceed that number, because
the possibility exists to greatly increase this amount.
Substantial development in this area would necessitate
proper parking facilities. Where would these cars be parked? It's seems to
me that this situation itself would definitely have a negative impact on
the value of my property.
In a small harbor with limited access already, wouldn' t
a dangerous precedent be set for additional future development? Before any
more development or plans are established, I feel that a public hearing on
this matter should be planned.
Sincerel

in the letter does not rebut a single point made by 1[r. Pomy in
his analysis and accordingly no reply on these issues is necessary.
The one point that I as aospelled to address is the issue of
the applieatien Of Oauthold a0,oree. My n] 1.,.6-e wr— /M1470IM to
as that they were not aver@ of that application, nor do they
support that application. In facts Messrs. Meissann and Flynn are
preparing comments to be submitted to the Town Trustees t not only
opposing the application to &upend the dockage, but polnting out
that the existing improvements are themselves illegal. Messrs.
weisaann and Tlynn dlannvereA thle upon their own indereedent

it is important to note that Southold shores, Inc. is the Base

The applicant is A separate corporation, Southold shores most

not shareholders in, and have no relationship with whatsoever.
My clients most certainly support a public hearing by the AM
Corps on the Southold Shores application to enable the Coxps to got
to the bottom of this apparently illegal activity. Mr. Tobil 's
reference to the Southold Shoves Marina expansion as "tbeir ovn
unmentioned marina expansion" referring to my clients is vithout
basis in fact, and inexcusable.
My clients ash only that you consider all the facts presented

Dear Mr . Infurna :
In response to your letter of October 27 , 1988 (copy enclosed) ,
the following is my response to Mr . Chilton' s letter of
October 22 , 1988 (copy enclosed ) :
1 . ) By a "non-commercial" marina , it is meant that
the docking shall be linited to the Southold
Shores Boat Basin, Inc .
2 . ) As you can see from the site plan submitted with
the application, we are restricted to the amount
of docks constructed by the area we have to work
with and this will leave us with no area for
future expansion.
3 . ) There are no plans by the applicant ' s for further
a development of the site . With this , there is no
need for , nor will there be future need for parking
facilities . As Mr . Chilton knows , being a homeowner
in the area , the roads in the neighborhood are private,
are posted as private and no parking is allowed on
them. Each one of the houses in the neighborhood
is in walking distance to the docks .
In closing , I would like to state again that there are no
plans for further development, no shall there be a need for a
future parking area .
As always , should you or any member of your staff have further
questions or comments with regards to this proposed project ,

Dear Mr. Just:
The Department of Environmental Conservation has reviewed the application
referenced above. Before a final decision can be made, additional information
is required.
A. Please submit proof of the date of construction of the
existing mooring facility, and/or the DEC permit number
for this project.
B. A portable pumpout facility must be provided for the
proposed boat basin. The applicant must provide
information including type, capacity and location of
pumpout facility, and disposal of effluent.
C. The project as proposed will require significant
amounts of dredging in the future. The applicant should
consider redesigning the mooring facility so that less
dredging will be required, perhaps extending the existing
docks (see attached) .

Dear Mr. Ha,je:
Pursuant to 15 CFR 930.58, the following data and information is necessary
to enable the Department of State to adequately assess the coastal zone effects
of this proposed project.
1 ) Although an additional 435' of floating dock is planned, the
application indicates that no additional boats will be accommodated
by this marina expansion. Please explain this apparent conflict.
Also, supply a more exact figure which reflects the number of boats
now using the marina. Whai will the pioposed dock be u ed for, if not
to provide mooring for more boats?
2) The installation of either fixed or portable pumpout facilities at
this marina may be a necessity. Please discussed your clients'
reasons for not installing vessel pumpouts. Are any available in the
vicinity of the marina? Where are the nearest pumpouts located? What
are the lengths and drafts of the boats that are now and will be
utilizing this marina?
3) Please provide a profile view of the proposed dredging area from a
north-south perspective, showing the dredge area slope and edge in
relation to the nearby intertidal marsh vegetation. How will the
wetland be protected during the dredging operation?
4) Please indicate the distance from the 265' dock section to the
opposite shore of Mattituck Creek at low and high tides. What are the
creek depths off this dock section?

Dear Mr . Corey:
As per your letter of August 1 , 1988 (copy enclosed) , please
be advised of the following:
1 . ) Enclosed please find the recent photographs which
you requested.
2 . ) There are no existing marine services such as gas
docks or upland storage buildings nor are any planned.
3 . ) All the boats that are currently using the site and
all of the boats that are planning to utilize the site
are 23 , or less in length. The boats probably draw
less than 3 ' a piece . Please be advised that none
of these boats have a head aboard them and the proposed
docks are for residents of Southold Shores only, there
will be no transient docking. With this , there
should be no need for any pumpout facilities . A
pumpout facility is located , however.
4 . ) As stated in the above section, the proposed docks
are for Southold Shores residents only and it is
doubtful that the proposed expansion will clash
with the character of the community. Please also
note that as previously mentioned, a commercial
marina already exists in the immediate area . There
will be no resulting increase in demand or existing
municipal services .

RE: Application of Southold Shores Boat Basin, Inc. installation of
385' of 4' width float docks.
Before any conclusion can be made on this application please
determine the following:
1 . Who or what is Southold Shores Boat Basin, Inc.?
Z. Does Southold Shores have a homeowners association corporation,
and if so what is the relationship, if any, between the two corporations?
3. How does the corporation claim title to the upland area?
4. Since this application is for an addition to existing docks what
do your files show on approvals for present facilities?
5. Is this a not-for-profit corporation or are they operating a
business in the zoning district by constructing and selling boat slips?
6. Under the new zoning code the premises are in an R-40 district.
Accessory uses and accessory buildings are referred in the R-40 to those
requirements stated in the A-C district at 100-31C and 100-33. Based on
the information contained in the file I fail to see how their application
can be granted without first obtaining ZBA approval. Section 100-31 (3)
"Boat Docking facilities. . ." is referring to a private landowner building
a docking facility for his own use. The present application does not fall
within this section.
July 10, 1989
Southold Shores Boat Basin
Page 2
7. Also if this corporation is some sort of a membership club then
upland parking facilities are required which will need ZBA and Planning
Board approval.
Frankly speaking, there are to many questions and without a clearr
history and understanding of "who and what" this is all about no clear
answer can be given to your question.

Re : Application No . 665
Applicant: Southold Shores Boat Basin , Inc.
Gentlemen:
I am a resident of Southold Shores and own the premises
located approximately 175 feet notth of applicants premises
and also fronting on the wast side of Sage Cove . It appears
that the above application has been made to your Board for
• the purpose of obtaining such permit or permits as are nec-
essary to increase the size of an existing illegal dock .
As far as can be determined no permit or permits were
ever applied for or obtained for the construction of and
additions $made to the dock and slips now used by the applic-
ant or for% the use and maintenance thereof and, of course,
no certificate of occupancy ever obtained.
The 6z18ting maiina and dock is in violation of the
applicable town ordinances. The owner of the dock does not
have title to any upland premises and no access to its dock
except by water. The upland to which its dock is attached
does not belong to applicant but to Southold Shores Assoc-
iation , Inc. which is a separate entity unrelated to applic-
ant and should not be confused with applicant. Applicant
cannot comply with the parking and other requirements of the
town zoning ordinance or the town ordinance regulating boats ,
docks and wharves . See Code of the Town of Southold, Chapter
100 Article VIII , Sec. 100-80 , subd. B(9 ) ; Sec. 100-81 and
Chapter 32 .
The application states its purpose is to enlarge the
existing illegal facility to allow 1121 slips, one for each
• homeowner in Southold Shores" ; : an impossibility. The fact is
that there are presently 34 homes in Southold Shores and
there are a total of 51 homesites (lots either improved with
homes or upon which homes may be built) on the filed subdiv-
ision map of Southold Shores.
- 1 -
G Z!. //P.CppJ4 •
Accoeding to the " applicatimn-the premises are located
in the "Light Industrial" zoning district. Such is not the
case. The premises are under water and are shown as not
zoned in any zoning district on the present zowing map of
the town. The adjoining upland areas are zoned in the "A
Residential and Agricultural District" and by the terms of
the zoning ordinance, Town Code Chapter 100 Article II
Sec. 100-22 subd. G the adjoining underwater land is like-
wise zoned. Therefore the application does not conform with
the zoning ordinance or any of the existing land use regul-
ations as alleged in the application or in the Short Envir-
onmental Assessment Form. The applicant ' s request is cont-
rary to and in violation of all applicable local ordinances.
The answer to questiop,10 of the Short Form Environ-
mental Assessment Form submitted with the application is
also misleading and incomplete in that permits are also
required from, at least, the Building Department, the Zon-
ing Board of Appeals and the Planning Board.
Another and additional real threat to the environment
and the delicate ecology of the cove already seriously threat-
ened by the operation of an existing commercial marina is pre-
sented by this application. The cove having a very limited •
tidal flushing renders it imperative that a thorough and com-
plete Draft Environmental Impact Statement pursuant to the NY
Environmental Conservation Law and the applicable SEQRA reg-
ulations adopted in accordance therewith, especially in view
of recentounty legislation that makes applicant' s proposal
a Type 1 ,aiction requiring a lmng form environmental impact
statement and undoubtedly a full-fledged en4ironmental impact
statement
There appears to be a strange form of ownership with
respect to the dock and slips now existing and proposed. The
stockholders or members of the applicant corporation represent
that they own and may sell their individual docks or slips.
There appears to have been the sale of at least one and that
at least another is being offered for sale. It is suggested
therefor that before any other proceedings are had that an
appropriate application be made to or an opinion be obtained
from the New York State Attorney General under the provisions
of Article 9B of the Real Property Law and the N.Y. Attorney
General ' s Regulations Vol. 13 Sections 1B and 19 NYCRR and
the appropriate provisions of the General Business Law, by
applicant before any further proceedings be had in this matter.

1 ) Please submit recent photographs which depict the existing docking
facility.
2) Are any marina services such as a gas dock or upland storage
facilities being planned for this docking area expansion?
3) Please indicate the size and draft of the boats using' the existing
facilities. Will boats of a similar nature be using the facility
following expansion?
4) Please discuss this expansion in terms of compatibility with community
character. Will there be a resulting increase in demand on existing
municipal services such as water and waste treatment due to the
addition of more boats at this facility?
Pursuant to 15 CFR 930.60(a) , the review of vour consistency certification
will begin after we receive and determine that the necessary data and
information is adequate to assess coastal zone eff—ts.

Dear Mr. Tasker :
I enclose copy of letter from the New York State Department
of Environmental Conservation regarding the Harold Reese
application to extend his canal in the subdivision of "Southold
Shores" . "Southold Shores" is a subdivision on the excepted list
in the Code of the Town of Southold.
It appears that the Southold Tom Planning Board has no
jurisdictional authority in this matter at this time. Pair. Raynor
has directed me to write you for a determination as to whether
any other agency in the town does have approval authority.

Dear Mr. Raynor:
During a conversation 1/4/80 with Muriel Tolman, I got the impression
that your town board has found that it may not have an approval to issue
on the above referenced proposal.
If this is the case, you cannot be designated lead agency since you
have no jurisdictional authority. In that case NYSDEC will become lead
agency when you submit to us a statement that you have found that no ap-
proval on this project is required from the town planning board.
However, if you have found that the board has approval authority,
please let us know what permit is required from the town. Also let us
know what information you have requested from the applicant to make a
determination of significance of the actionand whetber a SEQR hearing
will be made by your agency.

Dear Ms. Tolman:
On September 12, 1979 we sent you a letter inquiring about the status
of the above referenced project with the Town Planning Board.
As a result of Mr. Raynor's letter of November 8, 1978 requesting
lead agency and our letter of November 21, 1978 confirming your assumption
of lead agency, a determination of significance of the action and whether
a SEAR hearing should be held needs to be made by your agency. Has the
determination been made?
Please advise us on the status of this project as we have a tidal
wetland application on it being held in abeyance pending your decision.

Dear Mr. Reese:
The Southold Town Planning Board referred your
completed Environmental Assessment Form to the Conservation
Advisory Council for advice and comments. The Council
reviewed the form at its regular meeting on April 24th.
The following are its comments.
Page 3 - #13 - Council disagrees with answer

in the 100 year flood plain
Page 5 - Part 2 - redo #1

The following are recommendations made by the Council.
1. 50 foot canal seems to pose some navigational hazards and
the extension could be wider than the existing canal,
possibly by 15 feet. Some sort of turnaround in the
canal should be designed at the terminus.
2. Any further bulkheading should be built taking into consider-
ation the substrata of clay.
3. Depositing of 8,000 cubic yards of this kind of material
on the adjacent uplands would cause severe siltation into
the existing and proposed canal.
4. The Council would. like to see the terminus of the canal as
far as possible away from Route 25 because of the movement
of the salt water interface inland.
5. Consideration should be given to surface drainage systems
to prevent siltation into the canal.
Mr. Harold Reese -2- May 9, 1979
6. Further engineering studies should be done to insure that
the effect on the existing fresh water table is kept at a
minimum.
If you would like assistance in preparing the additional
information which the Council requests, we would be happy to
have you attend our next meeting. It will be held on May 22nd
at 7: 30 in the evening at the Town Board Meeting Room at the
Town Hall. A call to the office would be appreciated if you
wish to attend. (765-1938)

Gentlemen:
Your letter requesting any comments the Board of Town
Trustees may have in connection with a proposal of Harold
Reese to extend his present canal in the subdivision
"Southold Shores" for approximately 435 feet was reviewed.
This matter is not in the jurisdiction of the Town
Trustees as it is all upland. There was some question of
the fresh water which is apparently on top of clay but which
is not a source of well water in the community. Suggestion
was made that James I. Monsell, Supt. of Utilities of the
Village of Greenport, be asked for his recommendations and
the Malcolm Pirnie report be referred to.

Dear Mr. Olsen:
Your December 6, 1978 letter to the Regional Director has been referred
to this Office for reply.
Concerning the first matter, if you will supply us with specifics, an
on-site investigation will be made. The activity may be in violation of Tidal
Wetlands, Stream Protection or other Environmental Conservation laws. If so,
appropriate action will be taken.
Concerning the second matter, the groundwater resources of the Town of
Southold are limited both from a quantity and quality standpoint. Therefore,
any additional stress to the groundwater system will only further deteriorate
the already fragile water supply of the Town.
This concern of the effects of inland dredging of channels is described
by Malcolm Pernie Engineers in a June 1967 report "Investigation of Water Re-
sources, Town of Southold", in which the report recommends no further inland
dredging of channels.
In addition, it has been our experience that the quality of the surface
waters in these long dead and canals deteriorates during the summer months.
To summarize, we feel the project is generally objectionable for these
two reasons. We trust these comments prove useful to you.
Very truly yours,

Dear Mr. Raynor:
I have received your letter of November 8, 1978 regarding the above pro-
ject and designation of a lead agency.
This Department and the Suffolk County Department of Health Services do
not wish to act as lead agency and therefore your agency should assume that
role as requested.
As lead agency you are to determine the significance of the action and
whether not a SEAR hearing should be held. In making those determinations
you should consider the views and recommendations of the other involved agencies.
Initial review of the project indicates potential adverse effects upon the
water quality of the canal. It is likely that this Department will object to
the proposal to extend the canal at its own tidal wetland hearing.
By copy of this letter the Suffolk County Department of Health Services
is notified of your role as lead agency and should comment to you directly.
Very truly yours,

Dear Mr. Reese:
The Planning Board has been advised to review the few subdivisions
which we have approved and waived performance bond and the construction
of highways upon the owner's statement that he would dedicate to the
Tawe as soon as possible. The Town, some time ago, established new
specifications for dedication. The Planning Board has been requiring
-` performance bonds for highway construction in subdivisions. Accord-
ingly, we would appreciate hearing from you as to the condition of
the roads in the subdivision, Southold Shores, located in Southold.
We would also like to know what progress you have made toward dedication
of the roads to the Town of Southold, and what progress you expect
to make in the next six months.
Very sincerely,

ENVIRONMENTAL ASSESSMEtiT - PART II
PROJECT IMPACTS AND THEIR MAAGNITUDE
General Inforratian (Reed Carefully)
- In ccrpleting the form the reviewer should be guida^_ by the question: Have my decisions and determinations
been reasonable? The reviewer is not expected to be an expert environmental analyst.
Identifying that an effect will be potentially large !column 2) does not mean that it is also necessarily
significant. Any large effect must be evaluated ii ='.R' 3 to determine significance. By identifying an
erfect in coluan 2 simply asks that it be looked it 'urger.
- The ExambTes provided are to assist the reviewer by s":;ing types of effects and wherever possible the threshold
of rrTs ituce thac would trigger a response in colur. Z. The examples are generally applicable throughout the
State and for most situations. But, for any sceci=ic project or site other examples and/or lower thresholds
may be more appropriate for a Potential Large Impact rating.
- Each project, an each site, in each locality, will vary. Therefore, the examples have been offered as guidance.
They do not constitute an exhaustive list of impacts and thresholds to answer each question.
- The number of examples per question does not indicate_ the importance of each question.
INSTRUCTIONS (Read Carefully)
a. Answer each of the 18 questions in PART 2. Answer Yes if there will be any effect,.
b. Maybe answers should be considered as Yes answers.
c. If answering Yes to a question then check the acorooriate box (column 1 or 2) to indicate the potential
size of the imoact. If impact threshold ecuals or exceeds any examole provided, check column 2. If
impact will occur but threshold is lover than exaroie, check column 1.
d. If reviewer has doubt about the size of the imoact :ijau_ consider the impact as potentially large and
proceed to PART 3.
e. If a potentially large impact or effect can be reduced by a change in the project to a less•tlian large
magnitude, place a Yes in column 3. A No respe^se indicates that such a reduction is not possible.

3. Based on the information available, decide if it is reasonable to conclude that this impact is important
to the minicipality (city, town or village) in •whicn the project is located.
To answer the question of importance, consider:
- The probability of the impact or effect accurring
- The duration of the impact or effect
- Its irreversibility, including permanently los: resources or values
- 'Whether the impact or effect can be controlled -
- The regional consequence of the impact or affect
- Its potential divergence from local needs and goals
- Whether known objections to the project apply to this impact or effect.
