WHEREAS, application under Appeal No. 3447, a request for a Special Exception to establish one or more C-1 Heavy Industrial Zoning uses, has been duly filed on December 20, 1985; and WHEREAS, the board members have personally viewed and are familiar with the premises in question, as well as the surrounding areas; and WHEREAS, after due notice, a public hearing was held by the Board of Appeals on March 13, 1986 at the Southold Town Hall, Main Road, Southold, New York; and WHEREAS, at said hearing all those who desired to be heard were heard and their testimony recorded; and WHEREAS, all testimony and written documentation have been carefully considered; and WHEREAS, the board made the following findings of fact: l. The prem.ises in question is located in the "C-Light" Industrial Zoning District along the east side of Horton Lane, Southold, with a total area of 6.89 acres (or 300,128 sq. ft.), and is identified on the Suffolk County Tax Maps as District lO0 Section 63, Block 1, Lot lO. 2. Variances to the Zoning Ordinance, Article XIV, Section 100-141B(1) and C(1): (1) for permission to establish truck rental business as an accessory use, in addition to the Special Exception use condi- tionally approved 9/10/87 under Appl. No. 3660, and as limited by Condition No. 10; and (2) for approval of extended (modified) height of principal building, in excess of that approved under Special Exception Condition No. 8. Premises is zoned Light Industrial (LI) and is located at 1040 Horton's Lane, Southold, NY; County Tax Map Parcel No. 1000-063-01-010. WHEREAS, a public hearing was held on January 11, 1991; and WHEREAS, at said hearing all those who desired to be heard were heard and their testimony recorded; and WHEREAS, the Board has carefully considered all testimony and documentation submitted concerning this application; and WHEREAS, Board Members have personally viewed and are familiar with the premises in question, its present zoning, the surrounding areas; and and WHEREAS, the Board made the following findings of fact: 1. By this application, appellant seeks Variances for: (a) approval of a 35' by 90' maximum area between Buildings "E" and "D" for parking of hauling trucks (Ryder Rental or the like) for use by those privately renting the mini-storage units at the subject parcel, and not for rental to the public; (b) approval of the increased roof height of building "D" from the restricted 15 feet to 18+- feet. 2. The subject parcel is a described tract of land containing 6.89 acres with five one-story buildings and the subject building, use for "mini-storage" and office use. Page 2 Appl. The subject parcel is located in the LI (Light Industrial) Zone District having a frontage of 351.93 feet along the east side of Horton Lane, Southold, and is more particularly identified on the Suffolk County Tax Maps as District 1000, Section 63, Block 1, Lot 10. 4. For the record, it is noted that this property has been the subject of the following applications before the Board of Appeals: (a) Appl. No. 3660-$E to vary the height of the mini-storage buildings to a maximum of 15 feet and with minimum setbacks as corrected by John A. Grammas and Associates dated August 5, 1987 {see ZBA findings for measurements); (b) Appl. No. 3625 rendered June 30, 1987 for six one-story mini-storage buildings {at 12 ft. height). 5. In making this determination, it is noted that all conditions (including Condition No. 8) as rendered by this Board under the above-noted determinations remain in full force and effect. 6. It is the position of this board that in considering this application: (a) the variance is not substantial in relation to the code requirements; (b) the relief requested is minimal under the circumstances and within the intent of the zoning code; (c) the difficulties are uniquely related to the property and are not personal in nature; (d) the variance will not adversely effect the essential character of the neighborhood; (e) the variance will not in turn be adverse to the safety, health, welfare, comfort, convenience or order of the town and neighboring properties; (f) in view of all the above, the interests of justice will be served by granting the limited relief, as noted below. Accordingly, on motion by Mr. Goehringer, seconded by Mr. Dinizio, it was RESOLVED, to GRANT approval for: (1) permission to establish private truck rental business, accessory and incidental to the ,~e 3 - Appl. No. 3984 .4atter of PUDGE CORP. Decision Rendered February 1, 1991 mini-storage operations at the subject site; and (2) increased height of Building "D" not to exceed 18+- feet, as applied and SUBJECT TO THE FOLLOWING CONDITIONS: 1. The height increase to 18+- (+- meaning an additional 11.9 inches maximum) shall apply only to Building "D." 2. Rental-truck parking area shall be screened from the property lines with 6' to 8' live screening or plastic-slatted chainlink fence so as not to be seen from Horton's Lane. 3. Ail conditions of the prior ZBA determinations shall remain in full force and effect; 4. Sign for accessory "truck rental" use will require separate approval by the Board of Appeals by formal application. Vote of the Board: Ayes: Messrs. Goehringer, Grigonis and Dinizio. SC~ ~ 1000-63-1-10 DATE: September 24, 1991 An inspection of the above-noted property by Planning Board staff on August 28, 1991 revealed that the site has not been developed in conformance with the Zoning Board of Appeals' decisions and the Planning Board's site plan approval. The points of non-conformance are: The approved site plan and the Zoning Board's decisions of April 8, 1987 and September 10, 1987, refer to Building D as being of dimensions no greater than 50' by 140' The building measures 50' by 144' There is no prevision on the approved site plan for an office. Neither of the 1987 decisions of the Zoning Board on the Special Exception makes reference to an office, although the ZBA's February 1, 1991, decision refers to this site as being used for a mini-storage and office use. The February decision also stated that all prior conditions imposed by the ZBA in its previous determinations were to remain in full force and effect, and those decisions expressly prohibited the installation of electricity, and toilet facilities. Our inspection revealed that electricity and toilet facilities have been installed. Condition 2. of the February 1, 1991, variance issued by the Zoning Board requires the installation of screening. This screening has not been installed. with electricity and toilet facilities. The Planning Board recommends that the site owner be required to return to the Zoning Board to correct the record with regard to the increased length of Building D.; and, also, to ask for a ~evised Special'Exception for the office use along If the applicant is able to obtain Zoning Board approval for the office use, then an application should be submitted to the Planning Board for approval of an amended site plan. Special Exception Conditions for Mini-Storage Units You have requested assistance concerning what appears to be a question or concern in that the ZBA may have conditioned one of its determinations on the Horton's Lane, Southold property that would prohibit the installation of a bathroom inside the business office area of Southold Self Storage. During September 1987, the ZBA made a determination concerning the Special Exception for the Mini-Storage units, and in its findings made reference to the fact that the applicant was not proposing to have bathroom facilities within the mini-storage units. Please be aware that the Board of Appeals' decisions have no conditions which would prohibit the installation of a bathroom facility for the business office for the Self Storage Business use. However, since the findings of the 1987 Special Exception action make reference that the mini-storage units will be used for storage purposes and not have plumbing facilities installed within the actual storage units, there should be no plumbing (bathroom) facilities within the actual storage units unless further application is made to the Board of Appeals. Following deliberations, the Board took the following action: WHEREAS, a public hearing was held and concluded on August 20, 1987 in the Matter of the Application of PUDGE CORPORATION under Appl. The Board has also considered subsections [a] through [1] of Article XII, Section 100-121(C)[2] of the Zoning Code in making this determination. Accordingly, on motion by Mr. Douglass, seconded by Mr. Goehringer, it was RESOLVED, to GRAI~T a Special Exception with modificatioli of Condition No. S from a maximum height of 12 feet to 15 feet (one-story) as applied and proposed, TOGETHER WITH THE FOLLOWING CONDITIONS [reiterated from the prior June 30, T987 decision of this Board under Appl. No. 3625]: 1. Proposed six-foot high chainlink fencing to be slatted and placed near or along all property lines which abut resi- dentially-used properties, as well as the fencing proposed between the existing buildings, and Buildings E and D. [The areas which do not require slatting will be along the east and southerly property lines.] 2. Hours of operation shall be limited as requested from 8:00 a.m. through 5:00 p.m. Monday through Saturday, 3. No storage of toxic chemicals, fuels, oils, or other flammable materials; 4. No storage of vehicles, trucks or major equipment, boats, etc.; 5. No trailers or tractor trailers; 6. No storage of fuel tanks; no outside storage of any materials; 7. All lighting must be shielded to the property (mushroom- type) and shall not be adverse to neighboring properties; 8. Maximum height shall be at 15 feet (one-story) as applied herein; 9. The points of non-conformance are: The approved site plan and the Zoning Board's decisions of April 8, 1987 and September 10, 1987, refer to Building D as being of dimensions no greater than 50' by 140'. The building measures 50' by 144' 10". There is no provision on the approved site plan for an office. Neither of the 1987 decisions of the Zoning Board on the Special Exception makes reference to an office, although the ZBA's February 1, 1991, decision refers to this site as being used for a mini-storage and office use. The February decision also stated that all prior conditions imposed by the nBA in its previous determinations were to remain in full force and effect, and those decisions expressly prohibited the/ installation of electricity, and toilet facilities. our inspection revealed that electricity and toilet facilities have been installed. Condition 2. of the February 1, 1991, variance issued by the Zoning Board requires the installation of screening. This screening has not been installed. The Planning Board recommends that the site owner be required to return to the Zoning Board to correct the record with regard to the increased length of Building D.; and, also, to ask for a revised Special ~xception for the office use along yith electricity and toilet facilities. If the applicant is able to obtain Zoning Board approval for the office use, then an application should be submitted to the Planning Board for approval of an amended site plan.
