Swimmer, who is applying for approval to construct with variances an approximately 8140 square-foot, one-family dwelling; pervious driveway; and sanitary system with concrete retaining walls, all as depicted on the attached site plan prepared by Joseph ingegno, L.S., last revised ail January 2001. The captioned N" S EC permit was issued, for a virtually identical project on 21 June 1990, whose expiration date was extended on 4 December 199 to 31 December 1994, The captioned Southold Trustees permit was issued for that prpject on 26 April 1990 and. extended Mice to 25 April 1993 and 25 April 1994, And the captioned Suffolk County Department of"Health.Services permit was issued :1 September 1993 in accordance with a Board of Review determination rendered 1 October 1991. Although the substance of the current proposal is very similar to that approved by the referenced approvals, l found during my inspection of the property in October 2000 that the subject wetland appears to have migrated landward during the past decade. Specifically, while the limit of the wetland along the southerly property line was located 45' landward of the southwesterly property corner in 1989, the wetland boundary presently terminates 6 ' landward of that corner, i.e., 15' closer to orchard lane, More significantly, rather than running generally parallel with the shoreline in a northerly direction as it did in 1959, the wetland boundary now bends decidedly landward to the north, thereby creating a more restrictive wetland constraint in that area of the property, Although l cannot personally attest to what field conditions at the site were tern years ago, l have inferred from file records and the recollection of Roy B'aje, who represented Ms. Swimmer's in 1989, that while the northerly portion of the property was covered by Phragmites, then as it is now, this area was not nearly as wet or densely inhabited by.partina patens and Ba c aris hal mifol a, This change in conditions appears to be the result of increased tidal flooding associated with, a, vector control ditch running through the parcel, indicated on the site plan as " " wide ditch," Although this ditch appears to have been present at the time of the prior applications, we have no way of knowing how long it had been in existence at that time, Thus, if it was a relatively recent cut in 1959, it is possible that a gradual increase in its width, flow rates, and volume of flow since that time has resulted in the establishment of the high marsh now present. indeed, the correlation between, the locations of the wetland boundary and vector control ditch is apparent on the site plan.
