In compliance of permit # approved on ~'//~_'5-/zooo , the undersigned owner of the
above captioned premise cleared the brush up to the bluff edge in preparation of the bluff
restoration. Specifically to replace approximately 200-400 cubic yards of screened sand
upland by machine on to the bluffarea which is seriously eroding.
If the shrubs were left in place, surely the machine traversing through them would have
uprooted them, causing a greater problem. By carefully clearing the shrubs we have kept
the root system in place and thereby preventing further erosion.
This is to confirm that the undersigned will replant native growth, rosa ragussa, etc,
across the new bluff' edge to further stabilize the bluff in addition to sod cover throughout
the open spaces of the lot.
If requires I will be happy to submit to the Board of Trustees a landscape plan of the
premises as soon as it is available to me.

Dear Mr. Angel:
In yom- recent letter to me, you state you were engaged by Mr. and Mrs. Mihalios to prepare
documents as a result of my letter to Alan Rubin, Esq. of the First American Title Company. I am
most happy you are in the picture. You have an excellent reputation. However, you advised me on
March 164, pursuant to your client's instruction, that unless I put the quitcliam deed and the
easement document in escrow now, Mr. Mihalios may renege on his obligation. Therefore. this
correspondence is necessary. It is necessary in the anticipated hope of preventing the financial, as
well as the environmental consequences ora breach of contract precipitated by him.
You may already know some of which I am about to say but historical perspective is
important. You and I have had extensive trial experience, and as such I trust we can bothanalyze
the quality of potential evidence in case this matter is ever litigated. I hope the scope of your
representation extends to advising your client as to the future consequences of his actions.
Lloyd Hamilton, the father of Marilyn Gatz, originally owned all of the property which is
now the Honeysuckle Hills development, as well as ali of the land westward to the Mattituck Inlet.
It was under his auspices that the original disputed sun'ey marker was established. He became
lifelong friends with my father, and in reliance of that marker he and my father with some help from
me installed the split rail fence. This was in 1952. That event was quite memorable to me.
Enclosed is a photocopy ora photograph taken of me by the fence in the spring of 1967, fifteen )'ears
after the fence was installed. I remember repainting the fence and planting the border trees in 1966,
the first year of my marriage. I will show you the actuhl photograph, if you wish. Legally, a claim

(the marker), an enclosure (the fence), improvements (the planting o fborder trees) plus maintenance
for almost fifty years, and the testimony to support it, in my judgment, make for a strong adverse
possession claim. Your client knew of this claim of title before the construction of the wall
commenced. If you share this opinion, I trust you will advise your client that removal of the wall
is still a legal option. I believe Alan Rubin shares my view, and as you can see by the enclosed
survey of March 31, 2000, the wall is almost totally?n my property, title of which was acquired by
adverse possession. - -
After an acrimonious winter and early spring, your client and I came to an oral agreement
and with some modifications is incorporated within the proposed written agreement you sent to me.
The escrow arrangement was first proposed by Mr. Mihalios on December 12, 2000 in a han&vritten
letter, a copy of which I assume you have. Prior to December 12, 2000, the arrangement was
delivery of the quitclaim deed upon completion. (See paragraph 12 of his April 2000 proposal.)
I never contracted with Rambo. I did tell Tom Samuels that I was going to contribute
$10,000.00 to the project which was later increased to $16,000.00. (I have sent a copy of this letter
to Tom Samuels along with the balance of monies totalling that $16,000.00 figure.) Since I was to
contribute a flat rate and Mr. Mihalios was in control of the project, I was never too concerned about
the overall cost. I do feel a moral obligation to Tom Samuels. He did improve my property after
your client scarred it.
I remember distinctly Mr. Mihalios in discussing payment with Tom Samuels said "Is full
payment within 30 days after completion acceptable to you:" Tom Samuels responded by saying
"Yes." Thirty days have long passed since completion.
You did not attend tbe permit hearing before the Board of Trustees. l, my wife, Tom
Samuels, Rob Herrman, as well as my neighbors, Lucy and Gary Cutler, did. At the first meeting
Mr. Mihalios stated on the record that he was responsible for all of the damage caused to my
property and he would fix it. Reliance upon that representation was a factor in inducing the Board
to grant the permit. I have not ordered the minutes 3'et. I did recently talk to Tom Samuels and hc
specifically remembers Mr. Mihalios' acknowledgment of responsibility.
I recently spoke to Ed Forrester of the Southold Building Department, and i£I am quoting
him correctly, he advised me he would not issue a C.O. to your client unless the whole project,
including the reclamation of my property was complete. As an aside, the first time I spoke to Mr.
Forrester was early last winter when I did not realize the footing encroached on my record title. He
advised me at that time he could not order a wall movement based upon an adverse possession claim.
He said he would order it as an incident to the permit process if I could prove encroachment by
means ora sur,'ey. Ironically, by means of subsequent developments, your client has provided me

with the proof(the Schnaurr survey of March 31,2000). I do not know whether Mr. Forrester is of
the same mind as he was last winter, but ifl were your client I would be concerned.
I have no idea, nor do I care, how your client is financing his project. If there is a lending
institution involved, their security would be undermir~ed !_fthe wall had to be removed in the future.
I have never complained to the D.E.C. I have not done so because I felt your client was
moving with the dispatch in trying to correct the damage caused. I am getting a different feeling
now. Part of the basis for this feeling was a result of my last telephone conversation with Mr.
Mihalios. He advised me he did not care how long "even years" the deed remained in escrow.
Therefore, I question the sincerity of his commitment to Tom Samuels. I hope I am ~vrong. But I
continually ask myself the question why he may anticipate such a delay when the permit requires
work to be completed by June 1, 2001.
I invite you to enter upon and make use of my property for a personal inspection. I believe
it would be of help in advising your client. I have also enclosed a photograph of what the original
encroachment looked like last winter. Mr. Mihalios was ordered to remove all of the braces on my
property by the Southold Police Department.
I wish to reiterate that the way I view this transaction involves the conveying of interest in
real property. For a non-monetary consideration (bulkheading, terracing and planting), I am
granting an easement right as welt as releasing a claim of title by means ora quitclaim deed. In the
normal course of dealing, this is accomplished at a closing by the passing ora certified check. 1
certainly am willing for you to be the escrow agent to hold the appropriate documents as security
for future work (terracing, regrading and planting). It makes no sense to me for you to hold items
as security for work already done (bul'kheading), payment for which by Mr. Mihalios to Tom
Samuels is long overdue. You have advised me Mr. Mihalios does not want a sit down meeting.
He does not have to attend. I will appear at your office. I assume Tom Samuels will also, at which
time you can pay off Samuels and I will si~ and deliver the documents in escrow.
As you know, our oral agreement gave control of the entire project on my property to Mr.
Mihalios. He is better qualified than l to do the overseeing. He is responsible for the cost of the
remaining work. Should the terms of our oral agreement not be completed (by him not completing
the terracing work on my property), then how does he intend to do the terracing work stopping at
his line? That would be quite an engineering feat, since he would be stopping in the middle ot'a
washout gully, the cause of which was created by him and would be contrary to permit specifications
which envision "non dipping" and continuous terracing tiers. I doubt the Town of Southold in
carrying out their environmental responsibilities would look fax orably on this.

Gentlemen:
As you recall, when the above mentioned permit was issued, the xxork was required to be
done in two phases - first the bulkheading and secondly the terracing and planting.
I am under the understanding that the bulkheading part of the project is complete. I have
every reason to suspect that the project was completed in a super workmanlike manner. However,
I am no expert on this.
I have requested over the telephone an inspection of the bulkheading. Consider this letter
a written request as well as authorization to enter onto and use my property for whatever purposes
you need. Obviously, it would not be to anyone's advantage to start the terracing and planting if
there were problems associated with the bulkheading.

The following action was taken by the Board of Town Trustees
during a Regular Meeting, held on September 20, 2000, regarding
the above matter.
WHEREAS, En-Consultants, Inc. on behalf of JAMES & LILIANA
MIHALIOS applied to the Southold Town Trustees for a permit
under the provisions of the Wetland Ordinance of the Town of
Southold, application dated January 3, 2000, and
WHEREAS, said application was
Conservation Advisory Council
recommendations, and
referred to the $outhold Town
for their findings and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on September 20, 2000 at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of th~ town,
NOW THEREFORE BE IT,
RESOLVED, that 'the Board of Trustees approved the application of
JAMES & LILIANA MIHALIOS to construct 93' timber retaining wall,
to be tied in west (Peck) property and east (Reis) property,
armored with stone, terraced as per plan, planting done no later
than June 1st including regrading bluff crest to remove existing
vertical lip andrestore a more graduall slope and filling,
terracing, planting bluff face to re-establish a stable angle of
repose. Double row of staked hay bales with staggered joints
around the upper perimeter bluff side of construction.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct project will expire two years from the date
it is signed. Fees must be paid, if applicable, and permit
issued witin six months of the date of this notification.

Dear Mr. Wieland:
As I warned you, please f'u~l attached what I hope to be finalized project plans for the referenced applications,
pursuant to my extensive discussions with the Town of Southold Trustees as to how the)' wished to see the
comprehensive bluff restoration project undertaken for all four parcels.
Specifically, the Board requested I - 3 ton stone toe armor to be placed along the toe of each of the proposed
retaining walls, including and especially the westerly return on the Peck property and the easterly return on the
Rochelle Reis property. Moreover, the)' requested an approximately 20' westerly extension of the toe armor on the
Peck property so as to more gradually transition from the armored to unarmored portions of the Peck bluff. Finally,
on the parcel owned solely by Rochelle Reis, the Board required that the regrading of the vertical lip below the
bluff crest be eliminated so as to preserve a cluster of what we believe to be cliff swallow nests located immediately
beneath the bluff crest.
Accordingly, I am providing you with (4) sets of revised project plans for each of the four properties for purposes
of final review of the Peck, Reis, and Reis applications and issuing an amendment to the Mihalios' Tidal Wetland
Permit No. 1-4738-02453/00003. Should you have any questions regarding these changes or require any additional
information, please contact me at your earliest convenience.
By copy of this letter and attached plans, I am similarly providing the Town of Southold Trustees with final plans
for purposes of permit issuance.

As discussed during the Board's regular meeting of 23 August 2000, please find enclosed (3) copies of
revised plans for each of the captioned applications, depicting a more comprehensive bluff restoration
project, including regrading of the bluff crest to remove the existing vertical lip and restore a more
gradual slope; and filling, terracing, and planting the bluff face to reestablish a stable ~__.$ie of repose.
Please also find enclosed a copy of the upland drainage plan prepared by E.S. Kalogeras, P.E., for
James and Liliana Mihalios, which I understand was submitted to the Town Engineer last week.
Please review these materials in conjunction with the plans recently submitted with new applications
for the same projects proposed for the two properties to the east (owned west to east by George &
Rochelle Reis and by Rochelle Reis, respectively), also to be undertaken in conjunction with the Peck
and Mihalios projects.

Enclosed please find a copy of the site plan for the above referenced project. The
drainage calculations and design proposed for the site will be adequate to handle a two (2")
inch rain fall over a twenty four hour period. This design meets the minimum requirements
of the Town Code.
One item that should be reviewed by the Trustees is the location of the end of the
proposed retaining wall. A 100' setback from the top of bluff is required by Code and will
require Zoning Board approvals to encroach upon this setback. As proposed, the wall
terminates at the coastal erosion line that is only 25' from top of bluff. Even though I believe
this item is out of your jurisdiction I would not recommend extending beyond the required
100' setback. Existing erosion that has already occurred due to disturbance at this location
has proven the area to be fragile. This 100' setback area should be repaired and
landscaped to prevent further erosion along the top of bluff.

Enclosed please find three (3) copies our certified grading and drainage plan and design/hr the above
referenced site. Our drainage calculations are based on storing a 2" intensi .fy rainstorm without utilizing the
benefit of leaching water into the soil, thereby yielding a conservative design. All roof drains will be directed
to the underground storm pools. All concrete decks will be pitched to drain. The storm pools are each 8-tbot
diameter sections of 4-foot height. Three (3) sections and a solid dome comprise each storm xvater unit for
a total voh,.me of 752 cf each.
The 'small area in the blmT protection area will not be disturbed with drainage structures and should
not shed a significant .zmount of storm water. ]?his protected area will be turfed and landscaped to minimize
erosion, as well as the sloped areas around the main residence.

Dear Mr. Krupski:
As you requested during the 26 January 2000 public hearing on the captioned proposal, please be
advised that I have discussed the Mihalios' standing as applicants with the Town Attorney, Gregory
Yakaboski. At his prompting, I again contacted Alex Doroski, President of the Honeysuckle Hills
Property Owners Association, and asked him to formally request the approval of the Association's
members according to their governing rules or bylaws.
The enclosed letter fi.om Mr. Doroski, dated 26 June 2000, indicates that the Association has given the
Mihalios' its conditioned approval to pursue their application for a retaining wall on Association-
owned beachfront. Therefore, please place this application on your August agenda so that the project
may be reviewed in conjunction with the application recently submitted for Lester Peck. Specifically,
Mr. Peck, the adjacent owner to the west, also wishes to install a retaining wall to be constructed with
and tied into the Mihalios retaining wall.
You may recall that in 1995, based on similar authorization fi.om the same Association, your Board
granted Coastal Erosion Permit No. 99-3-4.5 and Wetland Permit No. 4408 (copies enclosed) to
Ronald McGreevy to implement a virtually identical project. In fact, those permits allowed Mr.
McGreevy to bulkhead across the Association's right-of- way providing access to the beach.
For your reference, please also fred enclosed a copy of the Mihalios' permit for the project from the
New York State Department of Enviromnental Conservation. I thank you for your attention to this
matter.

Item A: Permittee Accepts Legal Responsibility and Agrees to Indemnification
The permittee expressly agrees to indemnify and hold harmless the Department of Environmental Conservation
of the State of New York, its representatives, employees, agents, and assigns for all claims, suits, actions, damages,
and costs of every name and description, arising out of or resulting from the permlttee's undertaking of activities or
operation and maintenance of the facility or facilities authorized by the permit m compliance or non-compliance with the
terms and conditions of the permit.
Item B: Permittee's Contractors to Comply with Permit
The permittee is responsible for informing its independent contractors, employees, agents and assigns of their
responsibility to comply with this permit, including all special conditions while acting as the permittee's agent with respect
to the permitted activities, and such persons shall be subject to the same sanctions for violations of the Environmental
Conservation Law as those prescribed for the permittee.
item C: Permittee Responsible for Obtaining Other Required Permits
The permittee is responsible for obtaining any other permits, approvals, lands, easements and rights-of-way that
may be required to carry out the activities that are authorized by this permit.
Item D: No Right to Trespass or Interfere with Riparian Rights
This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights
of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real
or personal property held or vested in a person not a party to the permit.
GENERAL CONDITIONS
General Condition 1: Facility Inspection by the Department
The permitted site or facility, including relevant records, is subject to inspection at reasonable hours and intervals
by an authorized representative of the Department of Environmental Conservation (the Department) to determine
whether the permittee is complying with this permit and the ECL. Such representative may order the work suspended
pursuant to ECL 71-0301 and SAPA 401(3).
The permittee shall provide a person to accompany the Department's representative during an inspection to the
permit area when requested by the Department.
A copy of this permit, including all referenced maps, drawings and special conditions, must be available for
inspection by the Department at all times at the project site or facility, Failure to produce a copy of the permit upon
request by a Department representative is a violation of this permit.
General Condition 2: Relationship of this Permit to Other Department Orders and Determinations
Unless expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind
any order or determination previously issued by the Department or any of the terms, conditions or requirements
contained in such order or determination.
General Condition 3: Applications for Permit Renewals or Modifications
The permittee must submit a separate written application to the Department for renewal, modification or transfer
of this permit. Such application must include any forms or supplemental information the Department requires. Any
renewal, modification or transfer granted by the Department must be in writing.
The permittee must submit a renewal application at least:
a) 180 days before expiration of permits for State Pollutant Discharge Elimination System (SPDES),
Hazardous Waste Management Facilities (HWMF), major Air Pollution Control (APC) and Solid Waste
Management Facilities (SWMF); and
b) 30 days before expiration of all other permit types.
Submission of applications for permit renewal or modification are to be submitted to:

General Condition 4: Permit Modifications, Suspensions and Revocations by the Department
The Department reserves the right to modify, suspend or revoke this permit. The grounds for modification,
suspension or revocation include;
a) the scope of the permitted activity is exceeded or a vio[afion of any condition of the permit or provisions
of the ECL and pertinent regulations is found;
b) the permit was obtained by misrepresentation or failure to disclose relevant facts;
c) new material information is discovered; or
d) environmental conditions, relevant technology, or applicable law or regulation have materially
changed since the permit was issued.

( TIDAL WETLANDS)
If future operations by the State of New York require an alteration in the position of the structure or work herein
authorized, or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonable
obstruction to the free navigation of said waters or flood flows or endanger the health, safety or welfare of the people
of the State, or cause loss or destruction of the natural resources of the State, the owner may be ordered by the
Department to remove or alter the structural work, obstructions, or hazards caused thereby without expense to the
State, and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other modification of
the watercourse hereby authorized shall not be completed, the owners, shall, without expense to the State, and to
such extent and in such time and manner as the Department of Environmental Conservation may require, remove
all or any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood
capacity of the watercourse. No claim shall be made against the State of New York on account of any such removal
or alteration.
The State of New York shall in no case be liable for any damage or injury to the structure or work herein authorized
which may be caused by or result from future operations undertaken by the State for the conservation or
improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any such
damage.
Granting of this permit does not relieve the applicant of the responsibility of obtaining any other permission, consent
or approval from the U.S. Army Corps of Engineers, U.S. Coast Guard, New York State Office of General Services
or local government which may be required.
AIl necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids,
sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, [eachate or any other environmentally
deleterious materials associated with the project.
Any material dredged in the conduct of the work herein permitted shall be removed evenly, without leaving large
refuse piles, ridges across the bed of a waterway or floodplain or deep holes that may have a tendency to cause
damage to navigable channels or to the banks of a waterway.
6. There shall be no unreasonable interference with navigation by the work herein authorized.
If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the
applicant shall, without expense to the State, and to such extent and in such time and manner as the Department
of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore
the site to its former condition. No claim shall be made against the State of New York on account of any such
removal or alteration.
If granted under 6NYCRR Part 608, the NYS Department of Environmental Conservation hereby certifies that the
subject project will not contravene effluent limitations or other limitations or standards under Sections 301,302,303,
306 and 307 of the Clean Water Act of 1977 (PL 95-217) provided that all of the conditions listed herein are met.
9. At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top
portion of the enclosed notification form certifying that they are fully aware of and understand all terms and
conditions of this permit. Within 30 days of completion of project, the bottom portion of the form must also be
signed and returned, along with photographs of the completed work and, if required, a survey

applicant or his agent as part of the permit application.

Prior to any construction or removal of bulkheads and other shoreline stabilization structures all backfill shall be
excavated landward of the bulkhead and retained so as not to enter the waterway, tidal wetland or protected buffer
area.
2. All peripheral berms, cofferdams, rock revetments, seawalls, gab~ons, bulkheads etc. shall be completed prior to
placement of any fill material behind such structures.
3. All fill shall consist of"clean" sand, gravel, er soil (not asphalt, flyash, broken concrete or demolition debris).
4. No excavation of the beach is authorized for the purpose of obtaining fill or stone materials.
5. Equipment operation below apparent high water is strictly prohibited.
6. The existing bank shall be graded and shaped to receive the revetment or other shoreline stabilization structure so
that the final toe of slope extends no further to the tidal wetlands than the existing toe of slope.
7. There shalt be no discharge of runoff or other effluent over or through any bulkhead or shoreline stabilization
structure or into any tidal wetland or adjacent area.
The area of fill shall be planted with beach grass on 12 inch centers and the applicant shall ensure a minimum of
85% su~,ival of plantings by the end of five growing seasons. If this goal is not met, the applicant shall re-evaluate
the restoration project in order to determine how to meet the mitigation goal and submit plans to be approved to the
Bureau of Marine Habitat Protection, Building 40 SUNY, Stony Brook, NY 11790-2356.
9. There shall be no discharge of runoff or other effluent on, in or down the bluff face or onto the beach.

Dear Mr. & Mrs. Mihalos:
On January 4, 2000, the New York District, U.S. Army Corps of
Engineers, received a request for Department of the Army
authorization for the construction of 77 linear feet of timber
retaining wall and two 12-foot returns, to be backfilled with
approximately 150 cubic yards of clean upland sand and planted with
Cape American beach grass. All work would occur landward of the
spring high tide line of Long Island Sound at Mattituck, Town of
Southold, Suffolk County, NY.
Our review indicates that since the proposed work does not
appear to include dredging or construction activities in or over
any navigable waters of the United States, the placement of any
dredged or fill material in any waters of the United States
(including coastal or inland wetlands) or the accomplishment of any
work affecting the course, location, condition or capacity of such
areas, a Department of the Army permit will not be required.
Care should be taken so that any fill or construction
materials, including debris, do not enter the waterway to become a
drift or pollution hazard. You are to contact appropriate state
and local government officials to ensure that the subject work is
performed in compliance with their requirements.

The following action was taken by the Board of Town Trustees
during its regular meeting held on January 26, 1995 regarding
the above matter:
WHEREAS, En-Consultants INc., on behalf of RONALD MC
GREEVY applied to the Southold Town Trustees for a permit
under the provisions of the Wetland Ordianance of the Town of
Southold, application dated October 26, 1994, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on January 26, 1995, at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 37-18 of the Southold Town Code, which will be listed on
a separate page, and,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
RONALD MC GREEVY to construct 142+/- 1.f. of timber bulkhead
to be tied into adjacent bulkhead to east. Construct a 15+/-'
of angled return at west end of bulkhead. Place 100-300 lb.
stone armor in front of return and westerly-most 20+/-' of
bulkhead. Backfill with 250 c.yo of bank run sand to be trucked
in from approved upland source. Construct a 4' X 14' section of
fixed walk to tied into existing stairs down bluff and construct
4' wide steps to beach. Located 250 Lloyds Lane, Mattituck.
Permit to construct project will expire two years from the date
it is signed. Fees must be paid, if applicable, and permit
issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

As per the request of Mr. Garrett Cutler, I personally inspected the above referenced parcel relative to
ascertaining the conditions of the existing bluff face as well as upland/beech condition that would
influence the stability of the shoreline.
My inspection commenced at the Cutler parcel which exhibits a densely vegetated bluff face decending
to a stable beach. It is interesting to note that the beach incorporates a small berm comprised of shells
and cobbles that protect the slope toe and have allowed a significant area of Amedcan Beach Grass to
colonize the upper beach area. The Cutler preparty appears extremely stable with no current erosion
evident.
The Peck parcel adjoins the Cutler property on east, and exhibits characteristics identical to the Cutler
property. The present bluff face is densely vegetated with a wider protective beach beml.
Mihalios adjoins the Peck parcel on the east and represents a classic example of how bluff stability can
be influenced by upland development. Inspection of this parcel indicated that the majodty of the lot area
landward of the bluff top has been cleared with no implementation of a proper soil erosion and
sedimentation plan. This omission has resulted in overland water flow generated by significant
precipitation events being channeled directly to the bluff edge. The waterfiow down the bluff face has
resulted in the slumping of the bluff as well as loss of vegetation, siltation of the beach area and erosion
of the bluff soils. None of this erosion has been caused by storm/wave attack at the toe.
Based upon this evidence it is clear that remedial action must be undertaken on the Mihalios property to
direct upland flow southward (away from the bluff face). Once this is completed, the bluff can be
regraded, top soiled and planted with salt tolerant native grasses and shrubs. Erosion blankets similar to
curlex or equal may be required over hydroseeded mulch/seed mixture. If toe protection is desired, a
simple installation of Long Island boulders (1-2 ton) can be installed along the slope tea on filter fabdc to
protect the bluff dudng major storm events. This rock installation can extend into the portion of Peck

parcel affected by the Mihalios erosion without disturbance of vegetated bluff areas. The rock installation
will serve to protect the toe while vegetation matures and will prevent scouring and wave deflection often
associated with the vertical wall of a bulkhead.
Thus implemented the erosion control plan will serve to stabilize and maintain the eroded bluff while
preventing the potential for causing erosion on parcels that are presently stable.

Dear Supervisor Cochran:
Over the weekend my wife and I started opening our summer house. At that time we
noticed the severe erosion problem on the easterly side of our propen'y resulting frota the
Mthalios's wall project presently under conslxuction. About two weeks ago~ Mx. Forrester
informed me the Town was very aware of the problem and may, in conjunction with the
building authorization process, require Mr. and Mrs. Mihallos to take corrective action.
It is my understanding that Mr. and Mrs. Mihalios have (or will soon reapply with the
permission of the Honeysuckle Hill's Association) a bulkheading application in progress.
Assuming the Town authorizes this project, and if you deem it advisable to have the
bulkhead extend on to our property for the purpose of correcting the problem, then you have
our support and approval. Also, if you require some form of terracing which would
necessitate construction on our part of the cliff itself, you have our further suppor~ and
approval. I will execute any documentation you would require in this regard. Since an
assistant within the office of Mr. Forrester was unsure of who would have jurisdiction over
this matter, I bring it to your attention herewith.

I, Alex Domski, am President of the Honeysuckle Hills Property Owners Association,
which owns property known as Suffolk County Tax Map No. 1000-99-3-4.21, located
adjacent to and north of that owned by James Mihalios (SCTM No. 1000-99-3-4.1). The
Association members have been made aware of Mr. Mihalios' proposal to construct a
retaining wall at the toe of the bluff located on the Association's property and fronting Mr.
Mihalios' upiand property, which includes the bluff crest and a portion of the bluff face.
The Association has no objection to this proposal, provided that Mr. Mihalios and his
contractor assume full responsibility for maintaining the integrity of the retaining wall a~er
it is constructed, and that the Association bear no liability for any damage caused to the
