A. This application must be filled in by typewriter OR ink and submitted to the outiazng
inspector with the following: for new building or new use:
1. Final survey of property with accurate location of all buildings, property lines,
streets, and unusual natural or topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal(S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains
less than 2/10 of 1% lead.
5. Commercial building, industrial building, multiple residences and similar buildings
and installations, a certificate of Code Compliance from architect or engineer
responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
B. For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and
"pre-existing" land uses:
1. Accurate survey of property showing all property lines, streets, building and
unusual natural or topographic features.
2. A properly completed application and a consent to inspect signed by the applicant.
If a Certificate of Occupancy is denied, the Building Inspector shall state the
reasons therefor in writing to the applicant.

Dear Mr. and Mrs. Principi:
Enclosed please find a copy of the Board's Findings and Determination
rendered at our May 4, 1994 Regular Meeting, during which time you were
present.
You will recall that the Board allowed a temporary, five-year placement of
the seasonal cottage (the size as exists) subject to a future application by
May 1999, and further public hearing, if the building is not proposed to be
located 100 feet, or more, from the top of the bluff. At our May 4th
meeting, the Board also confirmed with you, as agreed, that there should be
no major alterations or extensive changes done during this temporary period
of time since it is very possible that the building may again be the subject
of further soil erosion and related problems and as a result, be required to
be located south of the existing LILCO lines over the next few years -
depending on the weather effects on the bluff sails and the extent of damage
from storms or other activities.
Please be sure to return to the Southold Town Trustees and the Building
Department for a building permit, after obtaining other agency approvals that
may be applicable for this project. For your convenience, we have furnished
the Building Department Office and the Town Trustees' Office with a copy of
this determination for their permanent recordkeeping and update.
Also, we have transmitted a copy of your file to the Suffolk County
Department of Planning in accordance with Suffolk County's Administrative
Code rules and regulations pertaining to projects located within 500 feet of
a waterway. Once we have received their written response, we will forward
a copy to you for your permanent file.

ACTION OF THE BOARD
Appeal No. 4225:
Application of RICHARD AND DOLORES PRINCIPI. This is
a request for a variance based upon the Building Inspector's
March 2, 1994 Notice of Disapproval concerning a building permit
application to relocate a dwelling structure within 100 feet of
the L.I. Sound bluff; ref. Article XX111, Section 100-239.4A-1
of the Zoning Code. Location of Property: Lot #2 shown on the
1985 Map of Blue Horizons; also known as 4660 Blue Horizon
Bluffs Road, Peconic, NY; County Parcel ID 1000-74-1-35.52.
WHEREAS, after due notice, a public hearing was held on
April 6, 1994, at which time those who desired to be heard were
heard and their testimony recorded; and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. PROPERTY LOCATION: The premises in question is located
a distance of approximately 3666 feet from C.R. 48, or Middle
Road, along a private right-of-way at Blue Horizon Bluffs
Subdivision, Peconic, Town of Southold. This property is
identified on the Suffolk County Tax Maps as District 1000,
Section 74, Block 01, Lot 35.52.
2. CHARACTERISTICS OF APPLICANT'S SITE: The subject
premises is more particularly shown on the Map of Survey
prepared by Roderick VanTuyl, P.C. dated November 3, 1993,
and amended February 16, 1994, for this parcel. Shown is the
top bluff at an elevation 38 feet above mean sea level, as well
as low beach areas subject to flooding seaward of this bluff
line, and the remaining variable contours. The dimensions of
the lot are as follow: (a) frontage, or lot width, along the
private right-of-way is shown at 49.67 feet; (b) a lot width

along the ordinary highwater mark of the L.I. Sound of 108.34
feet, (c) the depth of the parcel from the ordinary highway
mark of the L.I. Sound to the private right-of-way is 872.17
feet.
3• OTHER PROPERTY FEATURES: It is noted that a portion
of the northerly upland area consisting of approximately
30 ft. x 105 ft. of upland area, or 3150 sq. ft., of the
premises is located within a restricted Coastal Zone Erosion
area. The regulations under the Coastal Zone Erosion Act
(ref. Chapter 37) prohibits all new residential and other
types of construction seaward of the Coastal Zone boundary line
(30 ft. x 105 ft. of upland area) plus bluff sloping toward the
foot of the bank, and the lowland areas - all shown on the
survey to be a distance south, approximately 126 feet from the
ordinary highway mark of the Long Island Sound.
4. VARIANCE REQUESTED: In this application, relief is
requested for re-location of an existing seasonal cottage
building which cottage building has been unoccupied since its
temporary relocation from the edge of the bluff due to severe
erosion and inadequate foundation support on the north side of
the cottage. The present location of the cottage is temporary
as a result of a Town Board proceeding and a public hearing held
on September 21, 1993 before the Southold Town Board concerning
a violation of Chapter 45 and Chapter 90 of the Code of the Town
of Southold, "Unsafe Buildings." The requested re-location is
substantially different from its previous location before the
heavy erosion, and different from its present temporary
location. The requested positioning is shown to be a distance
35 feet from the present line at the top of the bluff (or bank)
and 15 feet from the easterly side property line. This position
is shown to be south of the Coastal Erosion Hazard line, but
north of the existing power line.
5. CODE REQUIREMENTS: Section 100-239.4 of the Zoning
Code requires a minimum setback at 100 feet from the top of the
bluff, or bank, of the Long Island Sound. The percentage of
relief requested for a re-location, as requested and shown on
this February 16, 1994 survey, is for a variance of 65 feet, or
65 percent, which is substantial in relation to the 100 ft.
minimum requirement. Re-locating the existing cottage would
involve the placement of a new base supports (slab or similar as
required by the N.Y.S. Building and Fire Code), new electrical
hook-up, water hook-up, cesspool hook-up, and suitable step
areas for safe entry. It is the applicant's position that it
would be very costly, in the area of $7,500.00 in a location
other than as requested and further distant due to costs for new
underground wiring and piping. However, no written proof of the

Dear Mrs. Principi:
You asked me to find out what you need to do to get town approvals to
relocate your house. You have temporarily moved your house and gotten a
DEC permit. However, the DEC permit requires you to move the house to the
location showed on the plans prepared by Roderick Van Tuyl dated 11/3/93.
Those plans show a building outline labelled "proposed relocation of
cottage".
The Building Department tells me that you wish to move the house to a
different location than the one shown on the plan. In order to determine
whether the proposed location conforms to the code, you must give the
Building Department a scaled plan showing the proposed new location. You
have not done this, and your application cannot move forward until you do
this.
If the plans show that you want to move the house to an area without the
setbacks required by the code, you will need to get a variance from the
ZBA. Again, this cannot proceed until you bring in scaled plans, get a
ruling from the Building Department, and apply for a variance.
If the plans show that you want to move the house to an area within the
coastal erosion zone, you will need to get a permit from the Trustees.
However, before they proceed they want the assurance that you have the
necessary variances to allow the proposed house placement. Therefore, you
should pursue a variance before you pursue the Trustees permit. You may
also need to amend your DEC permit if you wish to place the house in a
location other than the one specified in your DEC permit.

ASSISTANT TOWN ATTORNEY KIERNAN: Good morning, Mr. Supervisor, Town
Board members. My name is Matthew Kiernan. We're here for a hearing pursuant
to Chapter 90 of the Code of the Town of Southold, an unsafe building hearing
involving the premises owned by Richard Principi and his wife. They have a mailing
address of Box 495 in Amagansett, New York. The property is located tax map
number 1000-74-01-35.52. Present today in addition to the Town Board is Gary
Fish, Building Inspector for the Town of Southold, and the owners of the dwelling
Mr. & Mrs. Principi. We, that is Gary, the Principis, and I, had a conversation
outside the Town Board's presence discussing this matter, in which we've come to
an agreement, which we would like to offer before the Town Board. Mr. Fish has
several photographs of the building, which I'll ask them to pass around to the Town
Board members. Essentially this involves a building located on the Long Island
Sound front, which as the result of erosion is being undermined, and it's in serious
danger. Gary Fish is prepared to testify before the Town Board today to that effect.
The Prinicpis have agreed, have explained to us, that the building is occupied only
on weekends. It's rented out for the summer to a weekend resident. They have
agreed to close the building immediately to allow no further occupancy of the
building by anyone, save for the gentleman, who's renting, moving his stuff out
one day this weekend. In addition, they've agreed to commence proceedings
immediately with the Building Department, and Trustees under their Coastal Erosion
Law, to seek the permits, which are necessary to move the building back off the
Sound, and to make it safe. With those agreements in place, I'm going to ask the
Principis on the record, that that's their agreement. Gary and I would ask that
this Board recess this hearing indefinely, so this agreement can take place. If there's
need to bring it back to this Board for further action, we'll notify the Board, and
do so at that time.
TOWN CLERK TERRY: Any particular time frame in which this will be accomplished?

ASSISTANT TOWN ATTORNEY KIERNAN: The Principis have indicated that the
building is going to remain vacant from here on out until it's moved back. It may
be somewhere between six and nine months before the proper permits are obtained
to make the building safe, so we will, the Town Attorney's Office and Building
Department, will renotice this hearing if need be. Mr. Principi, could you identify
yourself? This is Richard Principi, and Dolores Principi, and you folks are the
owners of the premises located at 1000-74-01-35.52 Suffolk County Tax Map Number,
and you heard the statement I put on the record this morning before the Town
Board, and is it your understanding that I set forth the agreement directly, and
you will have the premises closed to occupancy from immediately save for this
gentleman who will be moving his stuff out this weekend.
DOLORES PRINCIPI: Yes.
ASSISTANT TOWN ATTORNEY KIERNAN: And you agree to make immediate applica-
tion to the Building Department and the Trustees for permits to move the building
back?
DOLORES PRINCIPI: Yes.
ASSISTANT TOWN ATTORNEY KIERNAN: And you received a copy of the notice
setting forth this hearing?
DOLORES PRINCIPI: Yes.
ASSISTANT TOWN ATTORNEY KIERNAN: Do you have any questions?
DOLORES PRINCIPI: We don't have a choice.
ASSISTANT TOWN ATTORNEY KIERNAN: Does the Town Board have any questions?
Let me ask Gary first, if -Gary wants to say anything.
BUILDING INSPECTOR GARY FISH: Not really. I'm pretty comfortable with this
decision, as long as they comply with the unsafe building order.
DOLORES PRINCIPI: Now, you'll tell me how many feet I have to go back?
BUILDING INSPECTOR FISH: Yes, we can go back to the Building Department,
the office, and we'll go over the whole procedure.
DOLORES PRINCIPI: What happens if-the zoning, if I don't have enough setbacks
to move my house back? What happens then?
ASSISTANT TOWN ATTORNEY KIERNAN: You would have to apply for a variance
with the Zoning Board of Appeals.
DOLORES PRINCIPI: Is that usually granted then?
BUILDING INSPECTOR FISH: I couldn't say. It's case by case.
ASSISTANT TOWN ATTORNEY KIERNAN: We certainly couldn't guarantee.
BUILDING INSPECTOR FISH: It mould be up to the Board to decide.

JUSTICE EDWARDS: What is the size of the lot, offhand, do you know?
DOLORES PRINCIPI: Yes. It's 106 feet on the water, but it's also zoned under
RBR.
JUSTICE EDWARDS: How deep is it?
DOLORES PRINCIPI: I don't know. Mr. VanTuyl didn't get a chance to get over
there. I called in August.
JUSTICE EDWARDS: Do you have the deed?
DOLORES PRINCIPI: The deed doesn't show the setback. This is my place here,
but actually my property goes all the way into here, and this here is the part that
has erroded.
JUSTICE EDWARDS: This is still your property?
DOLORES PRINCIPI: This is my property.
JUSTICE EDWARDS: There's plenty of room.
TOWN ATTORNEY ARNOFF: There's plenty of room to move it back. You might
need a side yard variance at some point. It looks pretty narrow. I can't tell from
the scale.
JUSTICE EDWARDS: It looks like about 75 feet in there.
COUNCILMAN PENNY: Narrower than the 106 feet that is at the bluff?
DOLORES PRINCIPI: At the bluff there is 106 feet, and then it narrows down to
35 feet, and over here it's 40 feet, 49 feet.
TOWN ATTORNEY ARNOFF: One end is 49 feet. The other is 106 feet, and there's
I don't know how many 100 feet after that point.
JUSTICE EDWARDS: The tenent is moving out?
RICHARD PRINCIPI: Yes. We're going to have him move out.
JUSTICE EDWARDS: When the tenant moves out will the premises then be locked,
so there's no vandalism in there?
DOLORES PRINCIPI: We lock it. Yes, but you know there's..
RICHARD PRINCIPI: He's the only one there, so when he moves out.
JUSTICE EDWARDS: So, kids can't get in. That's the only thing I'm concerned
with. They get in there, and start bouncing around
BUILDING INSPECTOR FISH: They could have a fence around possibly.

DOLORES PRINCIPI: Alright, just so long as we're all aware of what's happening.
RICHARD PRINCIPI: We're not going to just leave it there.
