Dear Mr.-Herrmann:
The following action was taken by the Board of Town Trustees
during a Regular Meeting, held on September 20, 2000, regarding
the above matter.
WHEREAS, En-Consultants, Inc. on behalf of LESTER PECK C/0
GEORGE PECK, P.O.A. applied to the Southold Town Trustees for a
permit under the provisions of the Wetland Ordinance of the Town
of Southold, application dated August 4, 2000, and
WHEREAS, said application was referred to the $outhold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on September 20, 2000 at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members
familiar with the premises
and,
have personally viewed and are
in question and the surrounding area,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97-18 and Chapter 37 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approved the application of
LESTER PECK c/o GEORGE PECK, P.O.A.to construct a +/- 145'
timber retaining wall with a 16' westerly return and truck in
approx. 100 cy of clean sand to be used to backfill and planted
with Cape American beach grass (1' on center). Easterly
terminus of retaining wall to be tied into face of proposed
retaining wall to east approved for James & Liliana Mihalios.
In addition the top of the bluff will be regraded, slope of the
bluff will be terraced and planted, no later than June 1st. The
whole bulkhead will be armored and the westerly return will be
armored up top of the bulkhead, and tapered off to the west 20'
to the grade of beach. Any material that had been washed off
the bluff will be recovered and used as backfill.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit' to construct project will expire two years from the date
it is signed. Fees must be paid, if applicable, and permit
issued witin six months of the date of this notification.

To the Board of Trustees:
We are writing to register our strong opposition to the construction of the proposed
retaining wall. We are the adjacent homeowners to the above-referenced applicant,
and we strongly believe that its construction will have a seriously negative impact on
our property based upon the following reasons:
With the exception of our property, the proposed retaining wall(s) will create a
continuous line of bulkheading from the Bailie Beach parking lot for approximately
one-mile to the east. Should the proposed bulkheading be approved, our property
will stand alone as the only unbulkheaded property on this stretch. Our 100 feet of
beachfront will be sandwiched between a running line of bulkheads directly to the
east and directly to the west. Because there will be no other place for high tides
and rushing storm waters to go, our property will bear the brunt and suffer the
consequences of these high waters. This will most surely result in the destruction of
our beach and our vegetated bluff.
During the past four years, we have spent a considerable amount of time and effort
in the restoration of our beachfront and bluff to its natural state. (A conservative
estimate of our time and labor would be nearly 1000 hours.) This work has resulted
in a beautiful beachgrass border measuring 100' x 20' and growing. (See attached
photographs.) We use this beachfront nearly everyday of the year for recreational
purposes: we fish fro~ it, we kayak from it, we birdwatch from it, we walk on it, and
we watch the sunset~ from it. Its natural (unbulkheaded) beauty is one of the
primary reasons we purchased this properly, and we have done everything within
our power to maintain and protect it.
The applicant is requesting a tie into the proposed Mihalios retaining wall directly to
the east, which has not been approved by the Board of Trustees. How is it possible
to tie into a retaining wall which has not been approved and which does not exist?
Additionally, it is our observation that the erosion occurring on both the Peck and
Mihalios bluff is a "top-down" erosion as opposed to a "bottom-up" erosion. It is also
our firm conviction, based upon almost daily personal observations~that the primary
cause of this bluff erosion is due to the unconscionable clearing of land by James
Mihalios in the construction of his house. This construction has been undertaken
without regard for the sensitive nature of the bluff, and it has been the underlying
source of the erosion on this bluff. We believe it is his responsibility to rectify the
erosion problem and bear all costs associated with it. We do not believe the addition of
retaining walls is the answer; it will simply result in further beach erosion, including
severe erosion to our stable beach and bluff.
We have engaged legal counsel to represent us in this matter. Currently, we are
consulting with an environmental specialist to further provide the Board of Trustees
with a professionally qualified evaluation of the effect of the proposed retaining wall
upon our property. Should our stated objections be insufficient to reject the application
currently before the Board, we request that time be allowed for the results of the
environmental study to be completed and reviewed.
