The purpose of this application: Re-driving or replacing openwork dock or openwork pier piling,
and mooring piles, removal of damaged piling, repair, resetting or replacement of floating docks,
ramps, or decking, all necessitated by ice and storm damage resulting during ~ Winter.

permit and drawing. Provided that all paperwork is in order, you will receive approval within a
week if not immediately.

SPECIAL CONDITIONS
No dredging or filling is permitted.
Repairs to existing structures are limited to replacement of timbers without change in design or dimension.
No repair or replacement of bulkheads is permitted under this permit.
No freshwater or tidal wetlands are to be disturbed under any circumstances.
A yellow permit sign provided by this office shall be displayed on the project at all times while under
replacement.
Groins and bulkheads are subject to inspection prior to issuance of permit.
This office must be notified upon corr~letion of work.

part of the consideration for the issuance of the Permit does unde~tand and prescribe to the fol-
lowing:
1. That the said Board of Trustees and the Town of Southold are released from any at~d
all damages, or cJalm~ for damages, of suits arising directly or indirectly as a result of any oper-
ation performed pursuant to this permit, and the said Permit'tee ~ at his or her own exqaeme,
defend any and all such suits initiated by ~ parties, and the said Permittce assumes full lial:~ty
with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Sour_hold
2. That this Permit is valid for a period of 24 mos. which is considered to be the
esl~mated time required to complete the work involved, but should circumsmces warrant, request
for an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes
to maintain the structure or project involved, to provide evidence to anyone concerned thai: auth-
orization w~ originally obtained.
q. That the work involved will be subject to the inspection and approval of the Board or
irs agents, and non-compliance vAth the provisions of the originating application, may be cause for
revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigadou as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along
the beach between high and Iow water marks.
7. That ff future operations of the Town of Southold require the removal and/or alterations
in the location of the work herein authorized, or if, in the ophaio~ of the Board of Tmatees, the
work shall cause unreasonable obsta-ucrton to free navigation, the said Permittee will be requited,
upon due notice, to remove or alter this work or project herein stated without expenses to the Town
of Southold.
8. That the said Board will be notified by the Permittee ot the completion of the work auth-
orized.
9- That the Permittee will obtain all other permits and comenta dmt may be required sup-
ptemental to this permit which may be subject to revoke upon failure to ob-ai,~ same.

Dear Mr. Haje,
The following action was taken by the Board of Town Trustees
during its Regular Meeting held on January 28, 1998, regarding
the above matter:
WHEREAS, JONATHAN ALL.5/q & WINABETH SMITH, applied to the
Southold Town Trustees for a perrait under the provisions of the
Wetland Ordinance of the Town of Southold, application dated
December 29, 1997 and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on January 28, 1998, at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97-18 of the Southold Town Code,
W~EREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
JONATHAN ALL}i~ & WINABETH SMITH to construct a 4' X 20'
catwalk including steps, a 3' X 12' ramp and a 6' X 14' float
secured by 2- 8" pilings.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

respect to said application on January 28, 1998, at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
JONATHAN ALLAN & WINABETH SMITH to construct a 4' X 20'
catwalk including steps, a 3' X 12' ramp and a 6' X 14' float
secured by 2- 8" pilings.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete pro~ect will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

Project Description
Construct a fixed timber dock, consisting of a 4' x 20'
catwalk (including steps at landward end); a 3' x 12'
ramp; and a 6' x 14' float secured by (2) 8" diameter
ADDENDUM TO FCAF: JONATHAN ALLEN, CUTCHOGUE
2a) Because the proposed dock is located within a NYSDEC classified intertidal marsh
zone, the project must be consistent with Policy 44. The only disturbances resulting from
the project will be the minor distm'banee of marsh vegetation and the temporary
disturbance to the bottom caused by driving of the piles associated with the dock.
Therefore, the project will be consistent With Policy 44, as it Will not affect benefits
derived from tidal wetlands and will require a Tidal Wetlands Act permit from the
NYSDEC.
3a) Because the proposed activity will occur at a waterfront site, it must be consistent with
Policies 2, 21 and 22. As the proposed structure will facilitate water-related recreation by
providing safe dockage and access for recreational boating along East Creek, the project
will be consistent with Policy 21. Policies 2 and 22 do not apply to the project.
