The only disturbances resulting from the project will be the minor distm'banee of marsh vegetation and the temporary disturbance to the bottom caused by driving of the piles associated with the dock. Therefore, the project will be consistent With Policy 44, as it Will not affect benefits derived from tidal wetlands and will require a Tidal Wetlands Act permit from the NYSDEC. 3a) Because the proposed activity will occur at a waterfront site, it must be consistent with Policies 2, 21 and 22. As the proposed structure will facilitate water-related recreation by providing safe dockage and access for recreational boating along East Creek, the project will be consistent with Policy 21.
