In my letter of September 16, 1996, I stated that Mrs. Soo had decided that, for financial rea-
sons, it would not be practical to pay the Trustees' pcmdt at that time, and that she understood
that it would be necessary to re-apply at a later date.
Since the permit application described the project as consisting of two paR;, the house with
deck and thc dock, and since only the dock permit requ/res payment of a fee, I would appreci-
ate it ffthc permit could be issued for just thc house and deck, thc no-tee part of thc project as
applied for.
The permit could be dated as.i~ would have been il'issued when the tee wa~ most recently due.

The Department of State has completed its evaluation of your Federal Consistency
Assessment Form and certification that the above proposed permit activity complies with
New York State's approved Coastal Management Program, and will be conducted in a
manner consistent with this program.
Pursuant to 15 CFR Section 930.63, and based upon the project inforrnation submitted, the
Department of State concurs with your consistency certification. This concurrence is without
prejudice to, and does not obviate the need to obtain all other applicable licenses, permits,
and approvals required under existing State statutes.

The following action was taken by the Board of Town Trustees
during its regular meeting held on Feb~,n~y 28, 1996, regarding
the above matter:
WHEREAS, Proper-T Services on behalf of VIVIEN SOO, applied
to the Southold Town Trustees for a permit under the provisions
of the Wetland Ordinance of the Town of Southold, application
dated December 27, 1995, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and.
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on February 28, 1996, at which time
all interested persons were given an opportur~ty to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THERRFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
VIVIE~ SO0, to construct a single-family dwelling approx. 54'
X 36' overall, with private sewage disposal system, and private
well. Also to construct a dock consisting of 3' X 6' platform,
a 3' X 16' ramp, and a 6' X 20' float with two piles to secure
float, and a 30' non-turf/non-fertilized buffer installed and to
cut phragmites down to 1' in height. Located: 265 Cedar
Point Drive East, Southold. SCTM #90-3-9
Permit to construct project will expire two years from the date
it is signed if not started. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

The Suffolk County Department of Health Services (SCDHS; "Department") has received
your letter dated January 9, 1996, concerning the above-referenced project. The Department has
no objection to your designation as lead agency.
Based on a review of the subject coordination, the Department offers the following
comments. These comments should not be construed as an implicit SCDHS approval or
rejection of the project. All applications are reviewed thoroughly with respect to Suffolk County
Sanitary Code (SCSC) concerns by appropriate departmental personnel when SCDHS
applications are completed.
Article VI Application Status:
An application for this proposed project was received on 12/15/95 and reviewed for
compliance with A~n. icle VI of the $CSC and Standards for construction of water supply and
sewage disposal systems for single family residences. The application has been deemed
incomplete pending submission of revised preliminary surveys (including surrounding well &
septic locations), a town wetlands permit and a NYSDEC Tidal Wetlands permit.
The applicant must comply with the requirements of the Suffolk County Sanitary Code and
relevant construction standards for water supply and sewage disposal. Design and flow

specifications, subsurface soil conditions, and complete site plan details are essemial to the
review of this project. These considerations are reviewed completely at the time of SCDHS
application. SCDHS maintains jurisdiction over the final location of sewage disposal and water
supply systems. The applicant, therefore, should not undertake the construction of either system
without Health Department approval.
