George Stadnick, New York State Department of Environmental Conservation, (NYS DEC) telephoned to advise me that our applica- tion for jetty reconstruction is approveable, however, they are unable to issue a permit because the Trustee's approval requires pre-filling with approximately 100 c.y. of clean fill. He advised that the NYS DEC will not allow filling in the tidal wetlands area. As a result, we would like to request that this condition be eliminated from the Trustee permit. If this is acceptable to you and the Board, please confirm in writing so that I can forward same to the NYS DEC for their approval. Thank you for your review and consideration. Harrington III SCTM X90-2-3 Dear Mr. Costello: The following action was taken by the Board of Town Trustees during its regular meeting held on Wednesday, May 28, 1997 regarding the above matter: WHEREAS, Costello Marine Contracting on behalf of PRESTON M. HARRINGTON, III applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated May 8, 1997, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory council for their findings and recommendations, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on Maya8, 1997, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 37-18 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, • 0 RESOLVED, that the Board of Trustees grant a Wetland Permit to reconstruct 40 jetty on a 90 degree angle and pre-filled with approx. 100 c.y. of fill, and, BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency which may also have an application pending for the same or similar project. Permit to construct project will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification.
