Bopp, Jr. Box 403 Mattituck, New York 11952 Re~ F-94-457 U.S. Army Corps of Engineers/NY District Perrrdt Application Bopp, Jr. catwalk, landing and floating dock Town of Southold Request for Additional Information Dear Mr. Bopp: We received a Federal Coastal Assessment Form (FCAF) and permit application for this project on September 1, 1994. However, pursuant to 15 CFR 930.58, the following data and information is necessary to enable the Department of State to adequately assess the coastal zone effects of this proposed project. The information that you submitted does not clearly indicate where the proposed location of the structures would be in relation to water bodies, nor is it sufficient for us to begin our review of your proposal. You should submit a copy of a general location map, such as a street map or "Hagstrom's" map, indicating where the site of the proposal would be in relation to Cedar Creek and other bodies of water. The map should also show adjacent streets and land areas. You should also include a drawing or chart showing depths of water at low tide at the site of the proposal and adjacent to it. The proposed structures should be depicted on such a drawing or chart so that it can be determined whether adequate depths for the proposed structures and its associated uses exist at the site. Given the photographs that you submitted, the information that you submitted in the FCAF is incorrect, and the material that you submitted is incomplete. The following information should assist you in completing the FCAF properly and providing the information necessary for us to adequately assess the effects of your proposal on the coastal area. Item C. 1.d. on the FCAF should be checked "Yes", since the proposed catwalk, landing and John Bopp. Jr. Page 2. float would result in a reduction, to some degree, of existing as well as the potential ability and right of the public to use coastal waters and the foreshore below mean high water. In response to the "Yes" response to item C.l.d. on the FCAF, you should provide a narrative statement indicating whether you or the Town of Southold own the underwater lands upon which the structures would be placed, or if the Town Trustees have made any property right conveyances or interests in and to these lands to you. A copy of a permit issued by the Town may be sufficient. You should also indicate whether commercial or recreational shellfishing, fishing, or bait fishing takes place at the site and adjacent areas, since those water-dependent activities are often affected by docks. Item C.2.a. on the FCAF should be checked "Yes", since the proposed activity would be located within and would affect a State designated tidal wetland. Item C.2.b. should be checked "Yes", since the proposed activity would be located within a designated flood hazard area. It is not clear, since no location map was submitted, whether item C.2.c. should be checked "Yes" or "No". Many of the creeks and receiving bodies of water in Southold are State designated Significant Coastal Fish and Wildlife Habitats. A location map and a clear description or depiction of where the proposed structure would be located in relation to water bodies would help determine whether the proposed structure would be in, or affect a designated habitat. The only water body identified in your application is "Cedar Creek". We can not locate Cedar Creek on the maps in our office, nor can we identify Clearview Road on our maps. We can find Clearview Avenue adjacent to Goose Creek, but we have no way of knowing whether your proposal would be in Cedar Beach Creek, Goose Creek, or Corey Creek. Cedar Beach Creek at Cedar Beach Point is a designated habitat. If your proposal would be in Cedar Beach Creek, then item C.2.c should be checked "Yes". Item C.3.a. should also be checked "Yes", since the catwalk, landing and float would in fact be on the waterfront. When you have completed the checklist, follow the directions in Section D of FCAF. Then, identify the applicable coastal policies, by the numbers that correspond to the "Yes" responses on the FCAF (the applicable policies are in parenthesis after each question), briefly assess the effects of the proposal on the policies, and provide a narrative statement describing how the proposal would be consistent with the applicable policies. The three photographs that you submitted are helpful, however, you should submit photographs of the site and adjacent area taken at low tide, rather than high tide. The information depicted in the photographs will assist us in assessing the appropriateness of the proposal in the area, the effects of the proposal on the intertidal area, and the effects of the proposal on public access to and use of publicly owned resources below mean high water. Please submit a copy of that permit and the conditions included with it. A copy of your original FCAF and a blank FCAF is attached. Please complete the blank FCAF using the preceding information, and forward it to this Department, paying particular attention to the instructions in item C, the instructions for additional steps in item D, and the addition of other supporting information as indicted in the submission requirements in item F.l.c. A copy of the coastal polic/es is also attached for your information, and to assist you in preparing the information necessary for us to begin reviewing your proposal. Any additional information which you believe will facilitate our consistency review of this project would be appreciated. Pursuant to 15 CFR 930.60(a), the review of your consistency certification will begin after we receive and determine that the necessary data and information is adequate to assess coastal zone effects. Page 10 Southold Town Trustees ~/06/94 I would like to apply for an ammendment to Southold Town Trustee Permit # 3795 dated Dec. 22, 1989. Enclosed is the plans for the existing structure as submitted by the previous owner Roscoe Corey, as well as the plans for the proposed modifications and additions. The modifications include raising the height of the dock and the catwalk to 3 1/2 feet above the ground level. The current height does hot meet current DEC regulations. The 4-6 inch locust stakes will be replaced with 6 inch pressure treated poles. The additions include a 6 x 16 feet floating dock 12 feet away from the current dock held by 2 6-8 inch pressure treated poles. There will be a 3 feet wide ramp connect the dock to the floating dock. The components of the ramp will be 2x8 stringers with 5/4x6 decking. The floating dock with be constructed of 2x8 beams with 2x8 decking. Enclosed is a check for $436 to cover the application fee of/$40~lus $396 to cover the new 132 square feet of new construction. The Council approves if the applicant turns the float so it is parallel to shoreline. (The Council would like the Trustees to consider a policy concerning the length of catwalks). Lupton Point Road, Mattituck Vote of Council: Ayes: All RESOLVED to recommend to the Southold Town Trustees approval with stipulations of Wetland Application No. 11-2-89-111-2-11 of John F. O'Grady to construct a swimming pools 16' x 40', retaining wall 115', excavate and regrade rear yard, construct an addition to house. The Council requests the applicants use haybales between the work area and wetlands, and all work stay 10' away from bank. 3258 South Harbor Road, Southold Vote of Council: Ayes: All RESOLVED to recommend to the Southold Town T~stees approval of Wetland Applicaiton No. 11-4-89-80-3-6 to replace withing 18' and existing high retaining wall 76' in length and construct a new wall 6' lower than existing wall to create a terraced effect with returns on east and west sides. West Shore Drive, Southold Vote of Council: Ayes: All RESOLVED to recommend to the Southold Town Trustees disapproval of Wetland Application No. 12-1-89-17-2-1.4 of Antonio Perez and Anne Branch Williams to construct a single family dwelling, pool, sanitary system, well, driveway and truck in fill to raise grade. The CAC disapproves of the project because the road will go across the freshwater wetlands, the septic system would be higher than the pond and more information is needed on the hydraulics of the pond and the property should be staked and marked clearly.
