Dear Mike,
Please let this letter serve as an explanation of the current situation at the above
referenced site and a basis for us to move forward with all involved agencies.
As you are aware, our building pernfit called tbr this project to be a major
renovation of the premises with very little of the existing structure to remain intact. We
are permitted to add on to the structure to the east and west as well as add porches to the
side of the home facing the water. In order to accomplish this, the architect specified that
we add on to the existing foundation in some areas, remove some of the lbundation in
others, and to make sure that what remained had sufficient capacity to handle the new
loads that the new structure was to generate.
Upon onr excavation for the new areas of the foundation as per all of our permits,
we discovered that the portion of the foundation that we were tying in to xvas unstable.
We immediately called the Architect for his inspection and advice. After his thorough
investigation he issued us a change order delineating the areas that needed to be addressed
at that time. We then submitted this information to Damon at the Building Department,
and he attached it to our plans to become part of the file.
As we proceeded to follow these plans it became apparent that the very, small
remaining portion of the existing foundation walls were also unsuitable to be built upon
as the5' collapsed under their own weight and instability. We were left with no alternative
other than to replace these few old collapsed walls in their same exact location.
Unfortunately, as these circumstances unfolded, it was impossible Ibr anyone
involved to anticipate this exact scenario. Ho~vever, we feel that we are within the spirit
and scope of the existing approvals.
The facts of this situation, in my opinion, do not alter the impact to the upland
area in which we are working, the protected wetland area that we are buffered from and
the navigable waters of Baldwins Creek. Our "as built" survey demonstrates that we are
in exactly the same location as we are permitted by all involved agencies, and the only
things that have changed from the original approvals is that the old basement walls are
now new. We look forward to a speedy resolution with all involved agencies and your

tidal wetlands vegetation.
Any activity outside that area on your lot is non-jurisdictional and would not require a pemfit
from the Board.

This determination is not a determination from any other agency.

existing single family dwelling". I have submitted an application to the building
department for the proposed activity. Michael Verity, Chief Building Inspector,
will not write the Building Permit because we have not obtained a Wetlands
Permit for the proposed septic system. Please note that the NYSDEC and the
SCHD has approved the location and design of the system. It should be noted
that the leaching pools are 100' from the edge of the Tidal Wetlands.
Enclosed please find a copy of a survey of the above referenced property with
the proposed septic system indicated As you can see, the surveyor has added a
notation to the map indicating the 100' distance between the cesspool and the
wetland. Kindly provide me with a letter of non-jurisdiction.
If at all possible, I would like to pick up the letter at tonight's hearing. I will
provide you with an actual copy of the revised survey.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, April 25, 2001 regarding the above matter:
WHEREAS, Catherine Mesiano on behalf of GRACE KEHLE applied to the Southold Toxvn
Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold,
application dated April 4, 2001 and
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees xvith respect to said application on
April 25, 2001 at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are fanfiliar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold
To'am Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of GRACE KEItLE for a first
and second story addition to the existing single-family dwelling.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Permit to construct and complete project xvill expire t~vo years from the date it is signed. Fees
must be paid, if applicable, and permit issued within'six months of the date of this' notification.
Two inspections are required and the Trustees are to be notified upon completion of said project.

16, 2001, the following recommendation was made:
Moved by Melvyn Morris, seconded by Scott Hilary, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the
Wetland Permit application of GRACE KEHLE '103-'10-20 for a first and second story
addition to the existing single-family dwelling and DISAPPROVAL to construct a 4'X
150' fixed timber dock with steps to grade.
