[ ] DENIED* Southold Town Clerk Sept. 13,2002 Town Trustees Southold Town Main Road Southold, NY To Whom is May Concern: This week, a sign went up on a property near my own that a couple named Parente have bought a lot on Vineyard View Drive in Cutchogue. It is the third lot in from Stillwater Ave. The other lots are owned by the Lademan's, Wickes and Bakers. On the north side of the lot is Peconic Bay Vineyard. The lot in question, subject to an upcoming meeting of the Trustees, is a drainage ditch. It is open to question whether the lot is buildable at all. For many years, two drainage pipes ran under the road, connecting a Iow lying area on the north side of the lot to the lot itselt: If you stand there you will realize that the entire vineyard and adjacent nursery - nearly 50 acres between Stillwater Avenue and Harbor Lane - drain through this one spot. It was for this reason that the previous vineyard owner, Ray Blum, ran pipes under the road that dumped huge amounts of water into this very lot. This drainage resulted in huge amounts of silt and sand being pushed to the back of the property, where small ditches cut by county vector control connect to a wetland further down. Those pipes were tipped out by the previous owners of the building lot in question, resulting in legal action of some sort. But you can still see them in the gully opposite the lot. With the pipes gone, the water has nowhere to go, so it fills that gully on the vineyard side and, when filled by a heavy rain, that water runs over the road and into the lot itself. This has happened many, many times. Keep in mind that the front of the lot contains fill. The natural level of this lot is eight to ten feet beloxv this. You can see the natural level of the lot in the back. The front was filled ~vith sand to approximate where a house could go. But the level is way below this and the dumping of the sand at the front of the lot does not change that the fact that a huge amount of rainwater noxv pools in the gully on the north side and, because the pipes are gone, runs over the road and into the lot. Again, please understand this lot is a drainage ditch and not a building lot at all. To build a home of the size involved for it to be out of the way of the water - it would have to be built high on stilts. Or, the entire lot would have to be filled with an enormous amount of dirt - an acre of fill, really - to raise it up to road level. That would require the complete stripping of all the trees on the lot, and still rainwater would pour through, only without the trees it would carry even more dirt and silt to the back. As a neighbor, I am terribly concerned about the removal of the trees on this lot because they protect the neighboring homes from serious erosion. You xvill see all this xvhen you stand in the lot itself and realize how low you are. Again, xvith the pipes removed that carried the water from the vineyard, under the road and into the lot, the water pools in the low depression opposite the lot - then fills up and overflows into the lot itself. Since the lot owner can't change the land configuration on the north side of the lot, this water will simply run into his front yard and into the neighboring lots. That can not be allowed to happen. I am not trying to be obstructionist, but I do want you to take a very careful look at this lot and the effect stripping it of trees, filling it with tons of dirt, and then home construction will have on the water flow for all three lots, and the ditch in the back that runs down to the ~vetland. I hope to be able to attend that meeting, but also wanted to express some concerns as an adjacent property owner. ! built my house in 1985. When we did so, the third lot under question had two large drainage pipes that ran from the vineyard, under the road, and ended in the property itself. During heavy rains they brought water from virtually the entire vineyard into this lot, pushing sand and gravel to the back of the property. The map included in the notice I received in the mail says on it "abandoned pipes." They were ripped up and, I believe, blocked off and now sit under fill material and were the subject of a law suit. They perhaps should not have been there in the first place, but without them, water pools in the loxv area on the vineyard side and when that fills, it overflows across the road. The pipes, in other words, served a purpose, although they were hardly fair to the owner of the lot. This overflowing has happened on a number of occasions, as the last properly owners on the road, the Bakers, can attest. My concern is that this area is a natural drainage ditch. Any removal of trees that hold together the sides of this ditch - and without some change in the lay of the land on the vineyard side - and rainwater will tear through this property and affect mine as well. You can see the development ofphragmites that begin right along Stillwater Avenue and run behind the first house, my house, then this property, all the way several hundred yards to the top of the creek. As you know, the volume of runoff generated within the farm fields to the north during a rainstorm is overwhelming. The original design for this minor subdivision allowed for excess runoff to run through pipes under the gravel road and meander through the last undeveloped lot where it would dissipate into the adjacent wetland area· The installation of new concrete leaching pools will provide for additional recharge into the ground water table. The new drainage piping shown on the drawing will allow the remaining runoff to bypass the new construction without creating an erosion problem· The concrete headwall & apron will allow the overflow to dissipate into approximately the same area of vegetated wetlands without eroding the developed portion of the property. I have compared this proposed drainage design with the plans from the original minor subdivision approval and offer the following conclusion· This proposed drainage design meets the minimum requirements established by the Town Planning Board under the original site plan approval. One of the proposed conditions for this permit requires the Town engineering department to provide a drainage design for the north side of the road. I have inspected the above referenced property and agree with your concern regarding potential drainage problems for this location. The acreage north of this site would constitute a considerably large watershed area and will require an engineering design to mitigate the effects of surface runoff that, until now, continued to run through this property toward the wetlands. I do not agree, however, with your requirement that the Town should be responsible for the design. It should be the developer or property owner's responsibility to hire a Professional Engineer to design drainage plans. Drainage plans should provide for recharge to the extent practical and/or allow the existing water flows to bypass the new construction. If runoff is diverted around the proposed construction, it should terminate at a headwall or bubble basin system that would dissipate the energy of the runoff to prevent erosion and allow the water to recharge into the fringe areas of the wetlands.
