Dear Mr Krupski,
I would like to advise the Board that I had to reconfigure my floating docks and pilings so my customers could
more safely enter and exit their their assigned floats.
I have not gone outside the scope of my existing permit ,in fact [ have reduced the number of slips by 3.
I have also added some extra support pilings to sure up the slips to keep them from shilling from normal
tide and wave action and loss of support from winter ice conditions The pilings that were added at this time were
removed from a previous reconfiguration and had been stored on land.
I would gladly meet and discuss these changes with the Board on their next field inspection if they feel it is
necessary

Dear Mr. Petersen:
The following action was taken by the Board of Town Trustees
during their regular meeting held on September 28, 1989 regarding
your request to amend the above permit.
RESOLVED that the Town Trustees Approve the request of Ron
Petersen to amend permit number 1786 to reflect installation of a
railway and travel lift and changes in dock configuration at
Petersen's Marina on Mattituck Creek, Mattituck, N.Y.
This letter is to notify you that we will amend permit on
payment of fees for work to be done and the amended permit shall take
effect as soon as payment is received. All other terms and
conditions in the original permit granted shall remain.
FEES DUE: 480.00 for 80 lineal feet of bulkhead.

In response to your request as to whether a site plan would
be needed for the above-referenced application before your
Board, the Planning Board would require a site plan only if the
proposed changes to the site will have one of the following
consequences:
1. increase the need for parking;
2. cause a change in the parking configuration that was
shown on an approved site plan;
It appears that the application before you will have no
such effects on the upland. A site plan will not be required at
this time.

In response to your November 16, 1983 letter, I enclose a
new application for this project as modified.
The attached work plan indicates that the location of the
retaining wall has been moved slightly landward to satisfy the
request of tha NYSDEC which has now issued a permit.
In addition, the dredging has been eliminated and three
pilings added.
I am in receipt of a Trustees permit for Genevieve Robin-
son for the adjacent property. As the location of this bulk-
head is essentially the same, I assume no new application to
the Trustees will be required.
I also have received Town wetlands permits for both projects.
Again, as the modified project varies only slightly from
that which was approved, I assume no new permit will be required.
If these assumptions are correct, would you please notify me.

Dear Mr. Petersen:
The Trustees have asked me to write to you in reference
to your applications that have been on file since March 4, 1983,
as above referenced.
At the Trustee meeting, held on April 5, 1983, this application
has been approved, but after sending out several notices of action,
with a bill for the work that was to be done, we have not yet
received your payment.
It is stated on the Notice of Action, if payment is not
received in ninety(90) days, the person will have to reapply.
Since this is the case, and no Town Permit has been issued, if in the
future you plan to do this work, it will be necessary to apply again.
If work has been complete, you are in violation of the Town Code.

Please excuse the deley in responding. Mr. Petersen was seriously
injured in a tug boat accident and was hospitalized for several months.
During this period, no decisions could be made on the location of the
bulkhead, etc.
The situation at the facility has changed since my last correspondence.
It is no longer imperative that Mr. Petersen locate the bulkhead as shown.
We are therefore agreeable to your suggestion to relocate the structure
13' landward on the north end while holding the southerly end the same.
Stakes have been placed in these locations for your inspection if desired.
Please drop the request to dredge. No dredging will be done at the
present time. Backfill for the bulkhead will be trucked in from an upland source.
Please add three 1~" diameter pilings 40' off the line of piles and
walk as shown on the drawing. These will be connected by a cable and serve
to moor boats.
As I believe all DEC concerns have been met by this modification,
would you please make every effort to complete processing and issue the
permit as soon as possible.

protection and utilization of important resources. The benefit which
reasonably may be expected to accrue from the activity must be balanced

relevant to the activity will be considered including the cumulative
effects thereof; among those are conservation, economics, aesthetics,
general environmental concerns, wetlands, cultural values, fish and
wildlife values, flood hazards, flood plain values, land use, navigation,
shoreline erosion and accretion, recreation, water supply and conservation,
water quality, energy needs, safety, food production and, in general, the
needs and welfare of the people.

Pursuant to Section 7 of the Endangered Species Act (16 U.S.C. 1531) and
based upon a review of the latest published version of the threatened and
endangered species listing, a preliminary determination is that the
activity under consideration will not affect those species listed or their
critical habitat.
Based upon a review of the latest published version of the National
Register of Historic Places, there are no known sites eligible for or
included in the Register within the permit area. Presently unknown
archeological, scientific, prehistorical or historical data may be lost by
work accomplished under the required permit.
Review~ of activities pursuant to Section 404 of the Clean Water Act wi ti
include application of the guidelines promulgated by the Administrator,
U.S. Environmental Protection Agency, under authority of Section 404(b) of
the Clean Water Act and the applicant will obtain a water quality
certificate or waiver from the appropriate state agency in accordance with
Section 40! of the Clean Water Act prior to a permit decision.
Pursuant to Section 307(c) of the Coastal Zone Management Act of i972 as

DESCRIPTION OF WORK
The applicant, Peterson Towing Corporation, proposes to construct a
retaining wall and walkway, place pilings and perform maintenance dredging
in Mattituck Creek at Mattituck, Suffolk County, New York, for the purpose
of allowing safe berthing of barges and other deep draft vessels.
The proposed retaining wall would extend one-hundred and thirty feet
approximately ten feet landward of the line of mean high water. Also,
an area measuring forty feet by one.hundred and fifteen feet would be
maintenance dredged to a depth of eight feet below mean low water. The
resulting dredged material, approximately four-hundred and forty-three
cubic yards of sand would be placed on the applicant's upland behind the
proposed retaining wall.
The applicant also proposes to place three mooring piles and construct
a walkway on top of existing pilings.

Because there has been no response in the allotted time from the
New York State Department of Environmental Conservation and the Southold
Town Building Department, it is assumed that there are no objections nor
