Box 1179 Southold, New York 11971-0959 Telephone (6311 765-1892 Fax ,631) 765-1366 July 21,2004 BOARD OF TOWN TRUSTEES TO~'N OF SOUTHOLD Ms. Catherine Mesiano Catherine Mesiano, Inc. 12 Mill Pond Lane East Moriches, NY 11940-1222 RE: JAMES SWEENEY 2950 MINNEHAHA BLVD., SOUTHOLD SCTM#87-3-42 Dear Ms. Mesiano: The Board of Town Trustees took the following action during its regular meeting held on Thursday, July 21,2004 regarding the above matter: WHEREAS, Catherine Mesiano, Inc. on behalf of JAMES SWEENEY applied to the Southold Town Trustees for a permit under the provisions of Chapter 97 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated June 30, 2004, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on July 21,2004, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approve the application of JAMES SWEENEY to hand trim the phragmites down to 12" each year, and to construct a 4'X 33' catwalk utilizing fiberglass grid material, a 3'X 20' ramp, and 6'X 20' floating dock, with the condition the overall length of the docking facility doesn't exceed 67', and all as depicted on the plan prepared by Sea Level Mapping last dated 12/27/04. Permit to construct and complete project will expire two years from the date the permit is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of $50.00 per inspection. (See attached schedule.) No debds is permitted in tidal wetlands or protected buffer areas. There shall be no unauthorized disturbance to vegetated tidal wetlands or protected buffer areas as a result of the permitted activities. The dock or catwalk shall be constructed with fiberglass gdd matedal in place of decking. The walk shall not exceed 4 feet in width and shall be a minimum of 2 above grade* over tidal wetland areas (*as measured from ground to the bottom of the dock/catwalk grating). The use of wood treated with pentachlorephenol or other wood treatment not specifically approved by the Department for use in wetlands and/or marine waters, is strictly prohibited in the construction of structures that will be in contact with tidal waters. Floats and ramps may not rest on or be stored in any vegetated tidal wetlands. No dredging, excavating or other alteration of the shoreline or underwater areas is authorized by this permit, nor shall issuance of this permit be construed to suggest that the Department will issue a permit for such activities in the future. No permanent structures shall be installed on docks/catwalks/floats without first obtaining wdtten Department approval (permit, modification or amendment). Docks/catwalks/floats shall not (a) extend laterally beyond property lines, (b) be placed so that docked vessels extend laterally over property lines, (c) interfere with navigation, interfere with other landowner's ripadan dghts.
