Dear Mr. Meagher:
The Board of Town Trustees took the following action during its regular meeting held on
Wed., March 23, 2005 regarding the above matter:
WHEREAS, DECLAN P. MEAGHER applied to the Southold Town Trustees for a
permit under the provisions of Chapter 97 of the Southold Town Code, the Wetland
Ordinance of the Town of Southold, application dated February 18, 2005 and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on March 23, 2005, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of DECLAN P.
MEAGHER to construct a second-floor addition to the existing dwelling, expansion of
the first floor, enclosed screened-in porch, and an in-ground swimming pool, with the
condition drywells are installed to contain the roof run-off from the dwelling, and
backwash from the swimming pool, and all as depicted on the plan prepared by Donald
Alberto, AIA dated February 15, 2005.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

At the meeting of the Southold Town Conservation Advisory Council held Tues., March
15, 2005, the following recommendation was made:
Moved by Don Wilder, seconded by Tom Schlichter, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH
A CONDITION of the Wetland Permit application of DfiCLAN MEAGHER to construct a
second-floor addition, expansion of the first floor, enclosed screened-in porch, and in-
ground swimming pool.

The CAC recommends Approval of the application with the Condition of a 20' non-tuff

most unpleasant evening from a weather point of view.
As a former Trustee and Mayor of a Village in Nassau County, I know that much of your

Dear Trustees,
Please be advised I enclose three copies of the property survey in the referenced matter. It
should be noted that I enclosed copies of the last three surveys as well since there is
intbm~ation on each that may be of interest to you. The earliest survey is from 1970 when
the original house was built and shows the setback t?om the bulkhead to each comer of
the house. The latest from February 2005 shows the topography and the first floor
elevation.
Please note that I staked the area of the ilnprovements on March 6, 2005 as requested. I
also attach fifteen color photographs of the property. This may assist you in 5'our
evaluation and I bring your attention to Photos 4~5~ 10, l I which were taken after I staked
the property so you can see the extent of the work proposed. I also would like to draw
3'our attention to Photo 8 which shows a pool (larger than the one I propose) at 1250 Blue
Marlin which has the same relationship to the water as l propose and is located five
houses down the watert?ont on the Bay.
Please also note that I also contacted (via email) the Officers of the Southold Shores
Civic Association as well as other residents in the Area and have so advised them of my
plans tbr the house. 1 received four replies to that notice and [ attach copies of those
emails tbr .,,'our consideration. I have not received any negative response to my proposed
plans from any of the neighbors in the area.
I will post the notice of hearing as required by statute no later than March 13, 2005.

Meagher Residence alterations at 750 Blue Marlin Drive
Dear President and Officers of the Southold Shores Association,
I am writing to you and the members of the Association (for those of whom f
have an email address) to inform you that I have filed an application with the
Town to alter my residence at 750 Blue Marlin Drive. I am writing as a
courtesy to all the Association members but will also be sending a registered
notice to the President of the Association, informing the Association that my
application will be heard by the Town Board of Trustees at their nexm meeting
on March 23~ 2005 at approximately 700PM at the Town Hall.
Together with our neighbor and architect, Don Alberto AIA (who owns the house
at 415 Blue Marlin), Laura and · are pla~ning to expand the house by adding a
second floor to the existing one story residence. We are not expanding the
ground floor footprint at all and will not be encroaching on any existing side
lot line. We are not adding any bedrooms either though we are moving the
bedrooms to the upper floor. We need to apply to the Town Trustees because we
are planning to add a six foot porch, partiall~ screened, on the rear {water
sime) of the house as well as an in ground swinm~ing pool on the zear side of
the house. From the street, no improvements or changes will be visible except
for nhe second floor addition. Don, Laura and I have designed the house to be
completely compatible with existing homes in the area and I believe the
improvements will oe all out negligible to ou~ fellow residenes in the
Association. We have discussed the plans w~th our in~nediate neighbors,the

Dear President and Officers of the Southold Shores Association,
I am writing to you and the members of the Association (for those of whom I have an email address) to inform
you that I have filed an application with the Town to alter my residence at 750 Blue Marlin Drive. I am writing as a
courtesy to all the Association members but will also be sending a registered notice to the President of the
Association, informing the Association that my application will be heard by the Town Board of Trustees at their
next meeting on March 23, 2005 at approximately 700PM at the Town Hall.
Together with our neighbor and architect, Don Alberto AIA (who owns the house at 415 Blue Marlin), Laura and I
are planning to expand the house by adding a second floor to the existing one story residence. We are not
expanding the ground floor footprint at all and will not be encroaching on any existing side lot line. We are not
adding any bedrooms either though we are moving the bedrooms to the upper floor. We need to apply to the
Town Trustees because we are planning to add a six foot porch, partially screened, on the rear (water side) of
the house as well as an in ground swimming pool on the rear side of the house. From the street, no
improvements or changes will be visible except for the second floor addition. Don, Laura and I have designed the
house to be completely compatible with existing homes in the area and I believe the improvements will be all but
negligible to our fellow residents in the Association. We have discussed the plans with our immediate
neighbors,the Monteleone
s and Ed Bondarchuk, and we have shown the plans to the Monteleones who are supportive of the changes. Ed
is aware of our plans but has not yet seen the plans but will in the coming week and I expect he also will be
satisfied with the design.

Dear Trustees,
Please be advised I enclose a notarized affidavit that I posted the property on March 13.
2005 as I indicated I would do in my correspondence of March 7th to the Board. Please
also note I attach original letters signed by my two neighbors on adjacent sides of my
property (at 650 Blue Marlin Drive and 850 Blue Marlin Drive) indicating their consent
to the proposed improvements. Neither of the neighbors are able to make the Hearing and
they provided these letters in lieu of attendance at the Public Hearing on March 23~'d.
Please also note that I also contacted (via email) the Officers of the Southold Shores
Civic Association as well as other residents in the Area and have so advised them of my
plans for the house. I earlier had sent copies of those emails for your consideration. I have
only received positive responses to my proposed plans from the neighbors in the area.
