Southampton, NY 11968 RE: LEOBORIO REALTY, LLC 17877 SOUNDVIEW AVE., SOUTHOLD SCTM#51 -1 -4 Dear Mr. Herrmann: The following action was taken by the Southold Town Board of Trustees at their Regular Meeting held on Wed., May 16, 2007: WHEREAS, En-Consultants, Inc. on behalf of LEOBORIO REALTY, LLC applied to the Southold Town Trustees for an Amendment to Wetland Permit #6136 under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated April 25, 2007, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, in accordance with Chapter 268, said application was found to be Exempt from the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, a • RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to Wetland Permit #6136 to remove the existing concrete foundation and any other construction disturbance associated with the construction of a new dwelling located beyond Chapter 275 jurisdiction, with the condition of a 25' non-turf buffer adjacent to the crest of the bluff, and aproject-limiting fence and row of staked hay bales erected along the landward limit of the buffer during construction, and as depicted on the site plan prepared by John C. Ehlers last dated June 18, 2007, and, BE IT FUTHER RESOLVED that the Board of Trustees grants aOne-Year Extension to Wetland Permit #6136, as issued on May 18, 2005 and Amended on May 16, 2007. This is not a determination from any other agency. Ehlers last dated April 19, 2005 and determined the removal of an existing concrete foundation and construction of asingle-family dwelling to be out of the Wetland jurisdiction under Chapter 97 of the Town Wetland Code and Chapter 37 of the Towri Code. Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the Coastal Erosion Hazard Area (Chapter 37) no permit is required.
