PROPERTY FACTS/DESCRIPTION: The applicant's 21,031 sq. ft. parcel has 100 ft. frontage along Anchor Lane, Harbor Lights Estates, Section One, in Southold. The property is improved with a one-story dwelling situated at 75+-feet from the wood bulkhead adjacent to the dredged canal. BASIS OF APPLICATION: Building Department's April 8, 2004, Notice of Disapproval, citing Code Section 100-239.46 in its denial of a building permit application concerning reconstruction of the existing dwelling, with enlargement. The reasons stated in the Notice of Disapproval is that a minimum 75 ft. setback is required, and the distance is shown at 61.61 feet to the closest (adjacent lot) bulkhead. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 20, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant wishes to construct reconstruct the existing dwelling at a location 61.6 feet from the (closest) neighbor's bulkhead, and 69.75 feet from the applicant's wood bulkhead adjacent to the high water mark of the dredged canal. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the relief requested will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The addition will be placed at the rear of the applicant's home approximately 69.75 feet from the wood bulkhead, adjacent to a tidal water/dredged canal, instead of the code required 75 ft. setback minimum. After careful review, the Board finds that the location is almost unnoticeable and without change in the character of the neighborhood. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The home has existed in its present location for more than 20 years. The lot is substandard in size with an area of 21,031 sq. ft. The immediate neighbor's bulkhead was installed closer than the 75 ft. setback requirement of the code. 3. The variance granted herein is not substantial, resulting in a 69.75 ft. setback, for a reduction of 5.25 feet from the code required 75 ft. setback. 4. The difficulty was self-created since the home has existed for at least 20 years, and is nonconforming in its present setback from the bulkhead. 5. No evidence has been submitted to suggest that reconstruction in this location will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of this relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an addition, after reconstruction, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Chairwoman Oliva, and duly carried, to GRANT the variance as applied for, as shown on the survey prepared February 12, 2004, amended March 12, 2004, by Young & Young, L.S. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. This is an outline form of specifications, wherever possible lists of materials and/or manufacturers will be used. All work shall comply with applicable National, State, and Local Codes and Ordinances. C. The contractors shall call to the attention of the architect and general contractor any discrepancies or errors in the drawings or specifications which might have a bearing on the work and shall be responsible for damages resulting from neglecting to do so. Unless expressly stipulated otherwise in the contract documents, the purpose of the plans and specifications is to provide guidelines for a finished product. All other incidental work necessary to provide a finished product whether or not specifically shown on plans or mentioned in specifications shall be included as part of the contract. G. The contractor shall guarantee his work and the work of his subcontractors to be free of defective materials and workmanship for a period of one year from the date of substantial completion, such date to be determined by the architect. All materials and equipment normally carrying a longer guarantee or warranty than one year shall have these guarantees or warranties extended to the owner. All manufacturers directions, diagrams, etc. supplied with the materials or equipment shall be kept intact by the contractor and supplied to the owner at the completion of the job. All materials and equipment which have printed manufacturer's specifications shall be installed in accordance with those specifications. H. All miscellaneous work to insure a complete job shall be done. If no details are shown, good practice and consistency with other details shall be followed. The contractor is responsible for all work included in the plans and specifications and shall point out to his individual subcontractors all work to be included by the particular subcontractor whether included in that trade's section of the specifications or not. I. Allowances given in the specifications are budget amounts to be included in the contract price for certain indefinite areas or items at the time of pricing. Each of these items must have definite prices determined before they are incorporated into the job. They are stated as including labor and materials(L&M) or material only(M). If the allowance is for material only, the contractor should include the labor necessary for installation in the contract price. When arriving at the actual cost of allowance items, it is expected that a credit will be included for any savings that might occur by the allowance item being incorporated. The same applies to any "alternates" in the specifications. J. The scope of the work shall consist of an addition to the residence as shown on the working drawings, the specifications and supplementary drawings supplied during construction. K. Substitutions for materials and methods shown or specified shall be made on approval by the architect. The architect shall be told the cost difference involved on any substitution before said substitution is implemented. This may be done verbally, with the information in writing sent to the architect within a week of such verbal commitment. If substitutions are made without following this procedure the contractor must bear any additional cost due to the substitution or pay the owner any credit due to the substitution. L. Where alternates are indicated on plans, in specifications, or in schedules, contractor shall submit price difference for alternates requested. M. Building permit and all other permits and approvals as required by law shall be obtained by contractor. At the completion of the job, the contractor shall obtain the Certificate of Occupancy. N. The contractor shall provide the architect with a complete fist of subcontractors including addresses and telephone numbers. O. The contractor will be furnished free of charge, 3 sets of drawings and specifications. Additional sets will be furnished at the cost of reproduction. At the completion of the job all sets of drawings and specifications shall be returned to the architect. The contractor shall reimburse the architect for the cost of printing any sets not returned. Contractor shall provide the architect with a construction schedule in outline form, indicating each phase, expected start and completion date and final completion date. R. General contractor shall keep the site orderly and clear of trash throughout the project period. S. Owner shall be responsible for all charges by utility companies for hook-ups required. DIVISION TWO SITE WORK A. The new addition shall be located as shown on the site plan. The contractor is responsible for observing legal setbacks, and height restrictions. B. Clearing the site shall be minimum and only what is necessary to obtain grades and for the execution of construction. Protect all remaining bushes from damage and remove all debris from the site. Scrape all top soil in areas to receive fill and stock pile to be reused. C. The owner shall be responsible for removing, maintaining and replanting any existing plants and shrubs which may be damaged by construction. D. The Contractor shall protect all adjacent property during grading and earthwork operations. He shall plan all operations so as to prevent damage to other property(public or private) in the event of rain occurring while the grading operations are in progress. E. The Contractor shall provide temporary sanitary facilities for his workers during construction. F. Contractor shall provide new driveway, pea gravel over 6" marl base, with metal edging, and concrete apron in front of garage door. DIVISION THREE 1. CONCRETE A. Pour concrete footings in forms on firm undisturbed soil, using 3000 lb. concrete, cured by approved method. Footing depths as indicated on drawings and in no case less than 40 inches below finish grade. Set all required anchor bolts, reinforcement bolts, inserts etc., for the work of other trades. B. Foundation and walls shall be formed to thickness and height indicated on the drawings. Forms shall be adequately tied together and braced to form true lines, square corners and plumb walls. Concrete shall be 3000 lb., well vibrated and/or rodded. Set 1/2" x 12" long 22 April 04 4 galvanized threaded anchor bolts 12" from each comer and no more than 4'-0" o.c. Provide all utility sleeves, duct, window and vent openings. Provide block-outs for beam seats where required. C. Provide 2" rat slab at crawl spaces over 6 mil polyethylene vapor barrier on 6 inches compacted sand. D. No admixtures allowed in any concrete without prior approval. E. No concrete shall be placed subject to freezing conditions or on frozen ground. 2. DEMOLMON A. Demolition of the designated existing portion of the structure shall be done under the supervision of the General Contractor. Care should be taken to assure that portions of the building supported by elements to be removed are adequately braced and supported to prevent failure before new supporting elements are installed. B. At no time is the building to be left open to weather. If it is, Contractor is responsible for repair and/or replacement of all portions of building damaged by wind, rain, snow, etc. at no additional cost to Owner. C. Contractor shall remove and store safely on site, all salvageable and movable items from the areas of construction. D. Contractor shall patch and/or repair any damage to surfaces adjacent to new work and leave them in a condition equal to or better than before new work began. E. Contractor shall provide for removal of all demolition debris and construction scrap from site. All debris containing asbestos shall be removed and disposed of in accordance with all applicable New York State requirements. F. Beams and wood lintels shall be Trus Joist MacMillan, Boise, ID. parallams, timberstrand headers, sizes as indicated on the drawings. B. Lumber for floor joists shall be Trus Joist MacMillan, Boise, ID. TJI/Pro series as noted on framing plans. Rim boards shall be timberstrand as noted on drawings. Provide all items of rough hardware by SMIPSON, TECO or equal (galvanized)and to be of type and gauge as requested by Architect. C. Sills on foundation walls shall be 2" x 8" ACQ, installed over metal termite shield and fiberglass insulated sill strip. Sills to be securely fastened to anchor bolts with galvanized nuts with appropriate washers. D. All sills, deck framing and/or other lumber exposed to moisture, concrete or ground contact shall be pressure treated unless otherwise noted. Treat wood exposed to deterioration by moisture, such as items in contact with roofing, flashing, waterproofing, masonry, concrete or in the ground. Treat wood subject to insect attack. E. Interior wall studs shall be 2" x 4"s, No. 2 or better, douglas fir, max 16" o.c. unless 2" x 6" are required in certain walls to accommodate plumbing, HVAC risers, etc. Warped members shall not be used. All openings shall be double studded. F. Exterior wall studs shall be 2" x 6"s, No. 2 or better, douglas fir, max 16 o.c. Warped members shall not be used. All openings shall be double studded. G. Exterior wall sheathing shall be 1/2" APA-EXT. sheathing grade fir plywood. Nail in accordance with American Plywood Association specifications. Plywood in contact with grade shall be preservative treated in an approved manner. H. All plywood sheathing to receive wood siding shall be covered with 15 pound felt building paper, horizontal laps at 6". I. Sub-flooring shall be 3/4" T& G B-C plywood. Glue and nail to floor framing in accordance with American Plywood specifications. 22 April 04 a J. Blocking, bridging, cats, furring, etc. shall be as required by good practice. Use well seasoned No. 2 common or better, 1" x 3" wood cross bridging for 2x lumber and solid blocking for trus joists as required by manufacturer. K. Nailing throughout shall conform to applicable building codes and National Forest Products Association National Design Specifications. All exterior nails to be hot dipped galvanized, unless noted otherwise. L. Rough hardware bolts, lags, etc. as required and/or as indicated on drawings shall be installed in accordance with the applicable building code and the National Forest Products Association National Design Specifications. Exposed fastenings shall be galvanized, unless otherwise indicated on drawings, all floor and roof framing members abutting other framing members and being supported thereon shall have galvanized metal hangers (skewed 45 degrees where required) having I.C.B.O. (Uniform Building Code) approval. All manufactured hangers, connectors, etc. shown on drawings with a model number are as manufactured by the SHVIPSON COMPANY, but equals may be substituted, if approved. M. Furring, blocking, and backing shall be furnished and installed where required for reception of wall board, formation of architectural features, concealment of pipes, conduits, ducts, attachment of supports for boiler room accessories, building specialties and other fixtures. Contractor shall consult with trades concerned and set furring and blocking as required. 2. ANCHORING A. All components of building should be adequately anchored and continuously connected from the foundation to the roof to prevent collapse or permanent lateral movement under wind force. B. All fasteners and connectors including nails, bolts, steel wind anchors and truss plates should be hot-dipped galvanized, unless otherwise noted. C. Attic flooring should be fastened with 8d annular or spiral thread galvanized nails. Such fastening should be supplemented by waterproof industrial adhesive. D. Floor beam splices should be located over supports. Their ends and tops should not be exposed to the weather and they should be in sound and serviceable condition. Bottom plates should have breaks under a wall stud. 22 April 04 2. INTERIOR FINISH CARPENTRY& MILLWORK A. The entire work of this section shall be performed in accordance with the best standards of practice relating to the trade, and shall be under the constant supervision of a competent foreman who shall carefully plan and lay out the work in compliance with the intent of the drawings. Moulding to be painted shall be poplar or clear pine. All wood trim shall be put on in full lengths without piecing, except when the use of a single length would be impractical. Where piecing is required,joints shall be clean cut, tight fitting miters. No butt joints allowed. All finish work shall be accurately fitted to their intended locations, true to line, level and plumb, and shall be securely fastened with appropriate fastenings. All joints shall be cut clean and fitted tight. Where woodwork adjoins other work, tight scribe joint shall be used. All external angles shall be mitered and interior angles coped unless otherwise detailed. All finish surfaces shall be sanded clean, free of roughness of any kind, dents or scratches. All securing of finish material shall be carefully done with finish nails, set. B. Door frame for Interior Doors 3/4" thick stock rabbeted with stops square-edged and mitered at corners. Frame material, clear white pine or poplar, router mortised for hinges, all exposed edges eased. Door frames prepared for paint finish on interior and paint finish on exterior. C. Nailing/Fastening of all exposed interior finish work shall be with finish head nails, screws (preferably sheetrock type), and bolts (where necessary). Blind nail all tongue and groove and/or shiplap material wherever possible. If screws and/or bolts are used in exposed locations, counter bore and plug all holes with material to match and/or as indicated on drawings. Set all finish nails for filling. D. Gluing of finish woodwork under this section where necessary and/or indicated on drawings shall be with Titebond or equal with all excess glue removed. E. Bathroom vanities and countertops are to be supplied and installed by Contractor. F. Closet poles and shelves shall be poplar. G. Stair parts by L.J. SMITH, handrail, LJ-6400 P. DAMPROOFING A. All foundation walls shall be waterproofed below grade and treated with a masonry paint finish coat above grade. B. Lay all interior slab work on 6 mil polyethylene plastic. 2. INSULATION A. Fiberglass batt insulation where shown shall be OWENS-CORNING or equal. Exterior spaces shall have vapor barrier facing inside. B. Exterior stud walls shall have 5-1/2", R-19 fiberglass batts with paper back vapor barrier, facing the interior. C. Interior walls around bathrooms shall have 3-1/2" fiberglass batts for sound barrier. Vapor barrier is not required on inside walls. D. Floors shall have 5-1/2" R-21 Batt. Ceiling joists to have R-38 Batt insulation. E. Around wall and roof openings provide loosely but fully packed fiberglass insulation. This includes around frame shim spaces and electrical outlets. F. Install all insulation in complete conformity with manufacturer's recommendations and specifications. Batts or blankets shall fit tightly at all edges. All tom or loose insulation shall be replaced at no cost to the owner. G. Check construction details. Maintain all ventilation spaces in framing construction. H. Provide sound absorbing insulation at walls between kitchen and living and dining rooms. 3. EXTERIOR SIDING. TRIM & DECKING. ETC. A. Exterior siding shall be 18" red cedar perfection shingles. over 15 pound felt building paper. B. Soffits and eaves shall be constructed with I x F.J. Pine. C. Use flashing caulking and sealants wherever required for watertight construction and good practice. They shall not be used as a filler for poor joints and where used shall be of best quality, manufactured for the purpose of use, concealed where possible and if not, neatly done. Painting shall not commence until this contractor has inspected all the areas to be painted and ascertained that all other contractors have fulfilled their contractual obligations in preparing work involving painting and finishing. Any work found to be deficient shall be reported to the contractor immediately. After prime coating all gypsum board surfaces, this contractor shall report to the contractor all areas requiring additional spackling for correction under Division 9, GYPSUM BD WALL& CEILING FINISHES. All manufactured hangers, connectors, etc. shown on drawings with a model number are as manufactured by the SIMPSON COMPANY, but equals may be substituted, if approved. M. Furring, blocking, and backing shall be furnished and installed where required for reception of wall board, formation of architectural features, concealment of pipes, conduits, ducts, attachment of supports for boiler room accessories, building specialties and other fixtures. Contractor shall consult with trades concerned and set furring and blocking as required. 2. ANCHORING A. All components of building should be adequately anchored and continuously connected from the foundation to the roof to prevent collapse or permanent lateral movement under wind force. B. All fasteners and connectors including nails, bolts, steel wind anchors and truss plates should be hot-dipped galvanized, unless otherwise noted. C. Attic flooring should be fastened with 8d annular or spiral thread galvanized nails. Such fastening should be supplemented by waterproof industrial adhesive. D.
