SAWICKI MINUTES SPECIAL MEETING AUGUST 6, 1982 A Special Meeting of the Southold Town Board of Appeals was held on Friday, August 6, 1982 at 7:00 p.m. at the Southold Town Hall, Main Road, Southold, New York. Present were: Gerard P. Goehringer, Chairman; Charles Grigonis, Jr.; Robert J. Douglass; and Joseph H. Sawicki. Absent was Serge Doyen, Jr., Fishers Island. Also present was: Victor Lessard, Execu- tive Administrator (Building Department). The Chairman called the meeting to order at 7:00 p.m. On motion by Mr. Goehringer, seconded by Mr. Douglass, the follow- ing resolution was unanimously adopted: WHEREAS, on July 29, 1982, an application was filed in the matter of Appeal No. 3020 for the same and similar relief as was denied by this board on May 26, 1982 in Appeal No. 2985, for ALICE G. LEVIEN; and WHEREAS, on July 29, 1982, this board adopted a resolution not to change, modify, alter, or rehear this board's decision of May 26, 1982 for this same and similar relief; and WHEREAS, on July 30, 1982, the applicant's attorney filed with this board an "amended" location (different from that which was originally filed on July 29, 1982, and which was denied on May 26, 1982), in the matter of Appeal No. 3020; NOW, THEREFORE, BE IT RESOLVED, that Appeal No. 3020, application for ALICE G. LEVIEN, be and hereby IS SCHEDULED FOR PUBLIC HEARING to be held Thursday, August 17, 1982 in addition to those previously scheduled; and BE IT FURTHER RESOLVED, that this board's resolution of July 29, 1982, in which this board unanimously decided not to change, modify, alter or rehear Southold Town _oard of Appeals -2- August 6~ 1982'Specia~ Mtg. · this same and similar relief as filed on Juiy-29', 1982, be and hereby IS RESCINDED. Vote of the Board: Ayes: Messrs. Goehringer, .Grigonis., Douglass and Sawicki. (Member Doyen, Fishers Island, was absent.) ENVIRONMENTAL DECLARATION: APPEAL NO. 3020. ALICE G. LEVIEN. For permission to construct storage building on a vacant lot. Article III, Section 100-30A. On motion by Mr. Goehringer, seconded by Mr, Douglass, it was RESOLVED, to declare the folloWing Negative Environmental Declaration concerning the matter of Appeal No. 3020, ALICE G. LEVIEN: ENVIRONMENTAL D~CLARATION: Pursuant to Section 617.13 of the N.Y.S. Department of Environmental Conservation Act, Article 8 of the Environmental Conservation Law, and Section 44-4 of the Southold Town Code, notice is hereby given that the Southold Town Board'of Appeals has determined that the subject project as proposed in this appeal application is hereby classified as a TyRe II Action, not having a significant adverse effect upon the environment for the following reason(s): An Environmental Assessment in the short Form has been submitted which indicates that no significant adverse effects were likely to occur should this project be implemented as planned. Letter dated June 3, 1982 was submitted for the record indicating that the N.Y.S. Department of Environmental Conserva- tion does not require a permit under Article 25 for this proposed project. This declaration should not be considered a determination made for any other department or agency which may also be in- volved, nor for any other project not covered by the subject appeal application. Location of Property: Lot No. 25 of Moose Cove Subdivision Filed Map No. 3230; Beebe Drive, Cutchogue, NY; County Tax Map Parcel NO. 1000-97-7-9. Vote of the Board: Ayes: Messrs. Douglass, Goehringer, Grigonis and Sawicki. Member Doyen (Fishers Island) was absent. Southold Town Board of Appeals -3- August' 6, 1982 Special Meeting APPEAL NO. 2930. SPECIAL EXCEPTION APPLICATION FOR SAL CAIOLA. On August 2, 1982 this board received a written request from the applicant's agent, Mr. David E. Kapell requesting that "...in- asmuch as a draft Environmental Impact Statement will cover in detail those issues raised in a long environmental assessment board," th~s board waive the requirement for said form and allow the applicant to proceed directly with the draft E.I.S. On June 26, 1982, this board declared this ~roject to be an "Unlisted Action" and requested that a Long Environmental Assessment Form (EAF) and Draft Environ- mental Impact Statement (D.E.I.S.) be filed as early as possible. The board unanimously agreed that a Long Environmental Assessment Form also be filed, and that the form is not required to be filled out by an en~ineerin~ firm. Mr. KaDell or the aDDlicant seemed to believe that the form could not be filled out by the applicant, and that by the board's requesting a Draft E.I.S. that a Long E.A.F. should not be required. The board wanted to be sure that the inquiries and issues included in the Long E.A.F. would be addressed. If the Lonq E.A.F. is submitted, the Draft E.I.S. would not have to re-address if it reflects the same points or issues. The Draft E.I.S. should address those items included in, but not limited to, the "Position Declaration" adopted by this board on June 26, 1982.
