MINUTES SPECIAL MEETING SEPTEMBER 16, 1982 A Special Meeting of the Southold Town Board of Appeals was held on Thursday, September 16, 1982 at 7:00 o'clock p.m. at the Southold Town Hall, Office of the Board of Appeals, Main Road, Southold, New York. Present were: Gerard P. Goehringer, Chairman; Charles Grigonis, Jr.; Robert J. Douglass; and Joseph H. Sawicki. Absent due to illness: Serge Doyen, Jr. (Fishers Island). The Chairman convened the meeting at 7:00 p.m., and each of the members signed the "Waiver of Notice of Special Meeting" form. ADDITIONAL SET-UPS FOR REGULAR MEETING: On motion by Mr. Douglass, seconded by Mr. Sawicki, it was RESOLVED, that the following appeals be and hereby are scheduled for public hearinqs to be held at the next Regular Meeting of this board, to wit, Septamber 30, 1982, and that the same shall be published in the local and official newspapers pursuant to law: Appeal No. 3022 - Herbert H. Seaman. Garage addition with an insufficient sideyard setback at Grange Road, Southold. Appeal No. 3021 - Mary Sayegh. Addition with reduced sideyard and reduced frontyard setback at Shore Drive, Greenport. Appeal No. 3034 - Joseph Smalley. Garage addition with reduced frontyard setbac~ on "reservation for highway easement." Gold Spur Street, Oregon View Estates, Cutchogue. Vote of the Boa~: Ayes: Messrs. Goehringer, Grigonis, Douglass and Sawicki. (Member~Doyen, Fishers Island, was absent.) This resolu- tion was unanimously adopted. REASON(S) SUPPORTING THIS DETERMINATION: (1) An Environmental Assessment in the Short Form has been sub- mitted which indicates that no significant adverse effects to the environment are likely to occur should this project be implemented as planned. REASON(S) SUPPORTING THIS DETERMINATION: (1) An Environmental Assessment in the Short Form has been sub- mitted which indicates that no significant adverse effects to the environment are likely to occur should this project be implemented as planned. Vote of the Board: Ayes: Messrs. Goehringer, Grigonis, Douglass and Sawicki. (Member Doyen, Fishers Island, was absent.) This resolu- tion was unanimously adopted. NEW APPEAL: NO. 3033. BERT AND MARYLIN CRYSTAL by A. Siemerling as agent. It is the unanimous agreement of the board members that this matter not be scheduled for public hearing until an updated survey showing all construction on this parcel is received. NEW APPEAL: NO. 3031. THOMAS AND JACQUELINE OCCHIOGROSSO. Requests permission to change location of proposed dwelling. Prior appeal was granted October 11, 1979. The board asked the secretary to forward a letter to the applicants advising them of the prior decision and prior D.E.C. approval. On~motion by Mr. Douglass, seconded by Mr. Goehringer, it was RESOLVED, that correspondence be forwarded to the applicants Southold Town Board o~ Appeals -4- SeptemDer 16, 1982 Special Meeting (Appeal No. 3031 - Thomas Occhiogrosso, continued:) in Appeal No. 3031, Thomas a.nd Jac~ueline Occhiogrosso, transmitting copies of the 1979 approvals for the proposed construction of a new one-family dwelling on the parcel in question. Vote of the Board: Ayes: Messrs. Goehringer, Grigonis, Douglass and Sawicki. (Member Doyen, Fishers Island, was absent.) This resolu- tion was unanimously adopted. APPROVAL OF MINUTES: On motion by Mr. Goehringer, seconded by Mr. Douglass, it was RESOLVED, to approve the minutes of the Regular Meetings held July 29, 1982 and November 5, 1981. Vote of the Board: Ayes: Messrs. Goehringer, Grigonis, Douglass and Sawicki. (Member Doyen, Fishers Island, was absent.) This resolu- tion was unanimously adopted. FINAL INSPECTION iR-O-W): APPEAL NO. 2917. CONSTANCE MESSINA- CROSS. The board agreed to re-inspect the right-of-way in question next Saturday as to whether the right-of-way complies with the board's November 24, 1981 specifications. Mr. Davis has submitted his report and recommendations to the board. PENDING HEARING: APPEAL NO. 3024 - Matter of PASQUALE ROMANELLI. Requests: (1) approval of access and (2) insufficient frontyard set- back for new dwelling. Haywaters Road, Cutchogue, NY, "Map of Point Plesant, Lot No. 1. The public hearing on this matter commenced on Septembe~ 9, 1982 and was recessed until the next Regular Meeting, September 30, 1982. The board asked the secretary to forward a letter to the Nassau Point Property Owners Association concerning this recessed date inasmuch as Mr. Gardner of Nassau Point indicated at the original hearing that the Association is aware of the application and are waiting for a written notification. APPEAL NO. 2985. ALICE LEVIEN. RESERVED DECISION PENDING. The board deliberated and reviewed this matter. A decision was not rendered. Southold Town Board of Appeals -5- September 16, 1982 Special Meeting RESERVED DECISION: Appeal No. 2914. Rehearing in the Matter of the Application for NORMAN C. BOOS, One Cedar Street, Massapequa, NY 11758, by Stephen F. Griffing, Jr., Esq., for a Variance to the Zoning Ordinance, Article III, Section 100-31 and Article V, Section 100-51 for permission to reduce land area for existing marina by dividing premises into two parcels, one as a marina and one for residential use, each having insufficient upland area. Location of Property: South side of Bay Avenue (a/k/a 8000 Skunk Lane), Cutchogue, NY; bounded north by Bay Avenue; west by Brickley; south by Gross; east by Hochbaum; more particularly identified as Suffolk County Tax Map Dis- trict 1000, Section 104, Block 8, Lot 2.1. The public hearing on this matter was held on August 17,1982. This board by a unanimous vote agreed to review its original decision in this Appeal. This matter was reheard at a regular meeting of this board held on August 17, 1982. At such rehearing, appellant presented new and further evidence, all of which is set forth in the minutes of said rehearing. Based upon such new evidence, this board finds that strict compli- ance with the zoning code would result in practical difficulties and, accordingly, grants the variance SUBJECT, HOWEVER, TO THE FOLLOWING CONDITIONS, to wit: 1. That the permission granted herein is only for the construction of one private one-family dwelling on the premises (comprising 117,871 square feet of which 47,364 square feet are under water), it being speci- fically understood that the marina located on the premises shall never be considered a separate parcel of property, and the entire premises shall remain in one ownership. [In effect, this property shall not be permitted to be subdivided with the existing uses.] 2. That a parking plan with a minimum of forty-three (43) parking spaces for the marina use shall be submitted to and approved by the Planning Board. 3. That thew new dwelling proposed to be constructed by the appellant shall be located on the premises as indicated on the map entitled, "Broadwaters Cove Marina," initialed by the Chairman on August 17, 1982; and that the construction of said dwelling shall com- ply in all respects with all laws and rules and regulations applicable thereto. Location of Property: South side of Bay Avenue, Cutchogue, NY; more particularly identified as Suffolk County Tax Map No. 1000-104- 8-2.1. Vote of the Board: Ayes: Messrs. Goehringer, Grigonis, Douglass and Sawicki. Absent was: Member Doyen (Fishers Island). This resolution was unanimously adopted. Southold Town Board of Appeals -6- September 16, 1982 Special Meeting NEW APPEAL: APPEAL NO. 2930 - SAL CAIOLA. SEQRA pending. Draft Environmental Impact Statement was filed on 9/9/82. The board members unanimously agreed that copies of the D.EI.S. and related documents be forwarded to the Town Conservation Advisory Council and the N.Y.S. Department of Environmental Conservation. The Chairman stated that the C.A.C. will be meeting on Septem- ber 28, 1982 and the Z.B.A. should be in receipt of their reply by our September 30th meeting. The board agreed that "acceptance of the D.E.I.S." will be discussed at the next regular meeting. Being there was no further business properly coming before the board at this time, the Chairman declared the meeting adjourned. Respectfully submitted, Linda F.
