SAWICKI MINUTES SPECIAL MEETING DECEMBER 29, 1982 A Special Meeting of the Southold Town Board of Appeals was held on Wednesday, December 29, 1982 at 7:00 o'clock p.m. at the Southold Town Hall, Main Road, Southold, New York. Present were: Gerard P. Goehringer, Chairman; Charles Grigonis, Jr.; and Robert J. Douglass. Also present was Mr. Victor Lessard, Administrator (Building Department). Absent were: Joseph H. Sawicki and Serge Doyen, Jr. (Fishers Island). The Chairman called the meeting to order at 7:05 p.m. ORAL INQUIRY. APPEAL NO. 2932. MATTER OF JAY P. AND M. JOANNE DAVIS SLOTKIN. DECISION RENDERED APRIL 14, 1982. The Chairman advised the board members that on Tuesday, Decem- ber 28, 1982, our office received an oral inqui.ry/complaint from Mrs. Marie Johnson concerning the materials used for the parking and driveway area in the above matter. Mrs. Johnson asked if someone from the town would check the improvements being made as to whether or they it appears to be what the board required in their April 14, 1982 decision. The board members agreed to inspect the project tomorrow. Location: Ackerly Pond Lane & Main Rd, Southold. ADDITIONAL FILES FOR SCHEDULING FOR PUBLIC HEARINGS: On motion by Mr. Grigonis, seconded by Mr. Goehringer, it was RESOLVED, that the following two applications be added to those other matters scheduled for public hearings to be held at our next - Regular Meeting, to wit, January 13, 1983 and that the same be duly advertised pursuant to law: Southold Town Board of Appeals -2- December 29, 1982 Special Meeting (Additional Set-Ups for January 13, 1983, continued:) Appeal No. 3064. Appeal No. 3068. Application for CATHY WILINSKI (Volinski, sic) for wall sign on existing building in B-1 Zone for Gift Shop. 27980 Main Road, Cutchogue. Application of CYNTHIA KAMINSKY for variance for excessive lot coverage. 75 Woodcliff Drive, Mattituck. Vote of the Board: Ayes: Messrs. Goehringer, Grigonis and Douglass. (Members Sawicki and Doyen were absent.) was unanimously adopted. This resolution COMMUNICATIONS. APPEAL NO. 3040. JOSEPH D. BURRUANO, ESQ. On December 20, 1982 our office received a written request from Mr. Burruano, the applicant in Appeal No. 3040, requesting a con- firmation in writing from the board with respect to the exact length, width and name of the access road referred to in the Board's October 21, 1982 decision on 280-a access. The board members authorized the Chairman to send a written reply, confirming the following: 1. That the right-of-way shall be improved a minimum length over the first 208 feet to the subject parcel, and 2. Shall be improved an additional length of either: (a) the first 15 feet along the parcel in question i_~f this is the intended point of physical access for vehicles into the premises to the structure, or (b) along the parcel in question up to the driveway which may be a further distance than (a) above, in order to permit physical access to the [proposed] structure. 3. That the right-of-way shall be improved a minimum width of 15 feet. Ail the members of the board acquiesced. COMMUNICATIONS. APPEAL NO. 2917. CONSTANCE M. MESSINA-CROSS. The board discussed Mrs. Cross' letter received December 2, 1982 in which she requests to withdraw Appeal No. 2917 for the reasons indicated in her letter. It was the consensus of the board members not to act upon Mrs. Cross' request until one of the rights-of-way to the parcel in question has received final approval through the Building Department upon issuance of a Certificate of Occupancy for ~he parcel in question, to wit, 1000-108-3-part of 008. This notice is issued pursuant to Part 617 (and Local Law #44-4) of the implementing regulations pertaining to Article 8 of the State Environmental Quality Review Act of the Environmental Conservation Law. This board determines the within project not to have a significant adverse effect on the environment. Also, please take notice that this declaration should not be considered a determination made for any other department or agency which may also have an application pending for the same or similar project. TYPE OF ACTION: [X] Type II [ ] Unlisted [ ] DESCRIPTION OF ACTION: Variance to construct inground swimmingpool addition to house exceeding the 20% allowable maximum.. ~- LOCATION OF PROJECT: particularly known as: 107-07-028. Town of Southold, County of Suffolk, more 75 Woodcliff Drive, Mattituck, NY; 1000- REASON(S) .SUPPORTING THIS DETERMINATION: (1) An Environmental Assessment in the Short Form has been sub- mitted which indicates that no significant adverse effects to the environment are likely to occur should this project be implemented as planne~ (2) The subject premises is not located within 300 feet of tidal wetlands area. APPEAL NO.: 3064. PROJECT NAME: CATHY WILINSKI (Volinski, sic per application forms) This notice is~issued pursuant to Part 617 (and Local Law #44-4) of the implementing regulations pertaining to Article 8 of the State Environmental Quality Review Act of the Environmental Conservation Law. Being there was no Other business properly coming before the board at this time, the Chairman declared the meeting adjourned.
