Box 1179 Southold, New York 1197[-0959 CONSERVATION ADVISORY COUNCIL TOWN OF SOUTHOLD MINUTES Tues., May 10, 2005 Down's Farm Preserve 6:00 PM A meeting of the Southold Town Conservation Advisory Council was held Tues., May 10, 2005 at Down's Farm Preserve. Present Were: Don Wilder, Chairman Tom Schlichter, Member Doris McGreevy, Member Jack McGreevy, Member Alicia Marin, Member Jennifer Mannino, Member Peggy Dickerson, Trustee Lauren Standish, Secretary Absent Was: William Cook, Jr., Member CALL TO ORDER Chairman Don Wilder called the meeting to order at 6:00 PM CHAIRMAN'S ANNOUNCEMENTS REPORTS Doris McGreevy reported she received the draft report for Mattituck Inlet from the Army Corp. of Engineers. Jack McGreevy attended the Board of Trustees meeting on April 20, 2005 and was pleased with the fact that the Trustees considered the recommendations of the CAC. Alicia Marin reported that June is her last month with the CAC as she has been accepted into Duke University. APPROVAL OF MINUTES Moved by Don Wilder, seconded by Tom Schlichter to Approve the Minutes of April 11, 2005. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by Don Wilder, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of GRACE KEHLE to construct a 4'X 95' timber catwalk terminating with stairs down to the water, elevated 2.0' above grade and composed of fiberglass grating. Located: 450 Strohson Rd., Cutchogue. SCTM#103-10-20 The CAC recommends Approval of the application with the Condition the eroded bank is replanted with native vegetation. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Doris McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH CONDITIONS of the Wetland Permit application of DENNIS HRANITZKY to construct a 4'X 25' fixed dock, 3'X 12' ramp and 6'X 20' floating dock. Located: 4105 Wickham Ave., Mattituck. SCTM#107-9-2.1 The CAC recommends Approval of the application with the Condition the docking facility doesn't exceed 1/3 across the width of the creek and no turf seaward of the dwelling. Vote of Council: Ayes: All Motion Carried Moved by Alicia Marin, seconded by Tom Schlichter, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH CONDITIONS of the Wetland Permit application of LUCILLE SEITZ to construct a 10'× 16' shed and a 3'X 40' timber dock with 3'X 6' steps to grade. Located: 675 Lake Dr., Southold. SCTM#59-5- 17&18 The CAC recommends Approval of the application for the "as-built" shed, and Approval of the docking facility with the Condition the overall length doesn't exceed 20'. 3 Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Jennifer Mannino, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of MICHAEL & KlM KENIN to remove the existing in-ground swimming pool and construct an 18'X 40' deck. Located: 420 Lakeview Terrace, East Marion. SCTM#31-9-11 Vote of Council: Ayes: All Motion Carried Moved by Doris McGreevy, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of LYNNE ANGELSON to renovate and construct additions to the existing residence. Located: 950 Park Ave., Mattituck. SCTM#123-7-13.1 Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Alicia Marin, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of RICHARD KUBIAK to construct a one- story addition, approx. 14.9'X 17.4' to existing house landward of the existing deck. Located: 185 Willow Point Dr., Southold. SCTM#56-5-25 Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of GABRIEL SClBELLI to construct a swimming pool, deck and garage. Located: 450 Cedar Point Dr. East, Southold. SCTM#90-2-15 The CAC recommends Approval of the application with the Condition drywells are installed on the landward side of the pool, to contain the pool backwash. Vote of Council: Ayes: All Motion Carried 4 Moved by Don Wilder, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH CONDITIONS of the Wetland Permit application of ASPSIA ISRAFIL 8, VlVlAN LINDERMAYER to construct a set of 4'X 129' stairs and platforms from the top of bluff to beach. Located: 17877 Soundview Ave., Southold. SCTM#51-1-4 The CAC recommends Approval of the application with the Condition no treated lumber is used, a 20' non-turf buffer is installed at the top of the bluff, a re-vegetation plan is submitted for the seaward side of the dwelling, and the landings on the proposed stairs are consistent with the Code. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of DAVID M. WIRTZ to remove 158 linear ft. of deteriorated existing bulkhead and reconstruct in same location new bulkhead with vinyl sheathing. Located: 245 Pine Place, East Marion. SCTM#37-4-13 The CAC recommends Approval of the application with the Condition of a 10' non-turf buffer from the edge of the pool to the bulkhead. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH CONDITIONS of the Wetland Permit application of PARADISE POINT ASSOCIATION to allow the repair and/or replacement of the existing docking facility. Located: Basin Rd., Southold. SCTM#81-1-16.10 The CAC recommends Approval of the application with the Condition no treated lumber is used on the docking facility, there is to be W' spacing between the decking, and all necessary measures are taken to prevent the stormwater run-off from Basin Rd. from running to the basin. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Doris McGreevy, it was RESOLVED to TABLE the Wetland Permit application of KATHRYN NIEDORODA to construct a 24.5'X 50' dwelling with 10'X 24.5' attached deck, on-site sewage disposal system, pervious driveway, clear and maintain a 4' wide pervious path to the proposed dock, 4'X 50' fixed dock with steps to grade. Located: 700 Deep Hole Rd., Mattituck. SCTM#115-12-10 The CAC Tables the application because there was no access to the property. The CAC recommends the property owner clear a small path into the property. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Tom Schlichter, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH CONDITIONS of the Wetland Permit application of GRAHAM HEAD to construct an in- ground swimming pool and surrounding patio and fencing. Located: 1160 Goose Creek Lane, Southold. SCTM#78-8-5.1 The CAC recommends Approval of the application with the Condition of a 50' non-turf buffer and the installation of drywells to contain the pool backwash. Vote of Council: Ayes: All Motion Carried DISCUSSION AND RECOMMENDATION OF APPLICATIONS TO AMEND PERMITS Moved by Don Wilder, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH CONDITIONS of the Amendment application of CUTCHOGUE-NEW SUFFOLK PARK DISTRICT to Amend Permit #5832 to include the existing barrier fence and install a new grade-level boardwalk, 3'X 100'+/- between the existing gazebo and existing restroom facility. Located: 9430 Skunk Lane, Cutchogue. SCTM#104-8-6.1 The CAC recommends Approval of the application for a path with the Condition the path is installed with pervious materials only. The CAC recommends the application for the existing fence be reviewed for passage of native wildlife. Vote of Council: Ayes: All Motion Carried Moved by Tom Schlichter, seconded by Alicia Marin, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Amendment application of JENNIFER & PHILIP STANTON to Amend Permit #5974 to allow for the replacement of an existing fixed timber dock with a dock consisting of a 4'X 56' fixed timber catwalk; $'X 14' ramp and 6'X 20' "T" float secured by (2) 8" diameter pilings. Located: 720 Town Creek Lane, Southold. SCTM#64-1-14.7 The CAC recommends Disapproval of the application and recommends the applicant construct the docking facility as originally approved by the Board of Trustees. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Jennifer Mannino, it was RESOVLED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Amendment application of KEVlN O'MALLEY to Amend Permit #6092 to remove the existing platform, ramps and floats, reconstruct 114' bulkhead within 18" of existing bulkhead, reconstruct existing deck inkind/inplace with railing, dredge no further than 10' seaward of existing bulkhead to a depth of-4.0' below mean Iow water, place 48 cy. dredged material behind existing bulkhead as backfill, install a 4'X 7' cantilevered platform, one (instead of two) 32"X 12' ramp, one 5' (instead of 6') X 34' float and one 10 ton electric boat lift (instead of second ramp and 5'X 24' float). Located: 175 Dawn Dr., Greenport. SCTM#35-5-21 The CAC recommends Disapproval of the application because boat-lifts are prohibited in Chapter 97 of the Town Wetland Code. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Tom Schlichter, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Amendment application of THOMAS J. APREA, JR. to Amend Permit #5844 to resheath existing jetty in-place with vinyl sheathing replacing existing creosoted sheathing, and dredge existing basin to a depth of-5' and depositing spoil (125 cy.) on the beach as beach nourishment. Located: 3140 Gardiner's Bay Estate, East Marion. SCTM#37-7-9.1 Vote of Council: Ayes: All Motion Carried 7 The next meeting of the Conservation Advisory Council has been set for Tues., June 14, 2005 at 6:00 PM.
